About this file
Single Source Justification Summary
This is a Single Source Justification form submitted by the Department of State's US Consulate General in Merida, Mexico, requesting approval to award a sole source contract to Megasur SA de CV for the supply of diesel fuel for the Consulate's backup generators. The acquisition falls under the simplified acquisition threshold and is classified as a Non-Residential Utility program expense (BOC 2654, ICASS-OBO utilities building operating expense per 24 STATE 101120). The justification was signed on September 15, 2026, by Mickey H. Ding, who serves as both the Acting Facility Manager for FAC Merida and the Contracting Officer.
The Consulate requires a reliable, continuous supply of diesel fuel to operate backup generators that are critical to facility operations, particularly during the Caribbean-North Atlantic hurricane season. The justification cites that the regional diesel fuel market is highly restricted with only four vendors operating in the area, and diesel pricing is uniform statewide and heavily regulated by the Government of Mexico, eliminating price competition as a differentiating factor. Of the limited vendors available, only Megasur SA de CV is willing to accept standard U.S. Government purchasing and payment terms without delay; other vendors either do not understand or are unwilling to submit required NDDA documentation and instead demand immediate or advance payment, which is inconsistent with U.S. Government acquisition regulations. The contractor has acceptable past performance, has established a working relationship with the post, consistently delivers fuel reliably, and meets the post's operational standards. The Contracting Officer has determined that the anticipated cost to the Government is fair and reasonable.

SINGLE SOURCE JUSTIFICATION NOT EXCEEDING THE SIMPLIFIED ACQUISTION
THRESHOLD
SECTION 1: IDENTIFICATION OF THE AGENCY AND THE CONTRACTING ACTIVITY
Department of State Contracting Activity
☐ Office of Acquisitions Management ☐ Foreign Service Institute ☐ Office of Foreign Missions ☐ U.S. Mission to the United Nations ☐ Overseas Post - US Consulate General Merida, Mexico
Requiring Activity Generator Diesel Fuel for Consulate Building Generators
SECTION 2: NATURE AND/OR DESCRIPTION OF THE ACTION BEING APPROVED
Approval is requested to award on a sole source basis to Megasur SA de CV, Merida for the supplies described in Section 3 on behalf of the Requiring Activity.
SECTION 3: DESCRIPTION OF SUPPLIES/SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS
Post requires a reliable, continuous supply of diesel fuel to operate backup generators critical to facility operations, particularly given the onset of the Caribbean–North Atlantic hurricane season. Uninterrupted generator fuel supply is essential to maintaining power for Consulate-critical operations during potential storm-related outages.
With hurricane season underway, ensuring an uninterrupted diesel supply for generator operations is essential to sustaining post's facility functions and safeguarding continuity of operations during potential weather-related power disruptions. Delays in securing a reliable vendor could jeopardize post's emergency preparedness posture.
Post is following the guidance of Hurricane Season Preparations, 26 STATE 58706.
SECTION 4: IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER THAN
FULL AND OPEN COMPETITION

In accordance with Federal Acquisition Regulation (FAR) 13.106-1(b)(1), the Contracting Officer has deemed only one source reasonably available based on the following:
<Check the correct box and delete the rest> ☐ Urgency ☐ Exclusive licensing agreements ☐ Brand-name ☐ Industrial mobilization ☐ Other Continued. Generator fuel (Diesel) falls within OBO Non-Residential Utility program (BOC 2654), ICASS-
OBO utilities, building operating expense, per 24 STATE 101120.
The regional market for diesel fuel supply is highly restricted, with no more than four vendors operating in the area. Diesel pricing is uniform statewide and heavily regulated by the Government of Mexico, eliminating price competition as a significant, differentiating factor among vendors.
Of the limited vendors available, only Megasur SA de CV is timely willing to accept U.S. Government standard purchasing and payment terms, without delay. Vendors do not understand or are not willing to submit the necessary NDDA documentation. The remaining vendors require immediate or advance payment prior to order release, a condition inconsistent with U.S. Government acquisition regulations and payment procedures.
