About this file

This is a Draft Scope of Work for Construction Manager as Advisor (CMa) services under a potential IDIQ contract with NAVFAC Washington. The CMa contractor will provide comprehensive project management, program management, and construction management services for facilities and infrastructure projects across NAVFAC Washington's area of responsibility, which includes 13 installations throughout Maryland, Virginia, and Washington D.C., including Naval Support Activity Washington, Joint Base Andrews, Marine Corps Base Quantico, and Naval Air Station Patuxent River. Services span pre-award planning, design, procurement, and post-award construction phases for Military Construction (MILCON), Facilities Sustainment, Restoration, and Modernization (FSRM), and reimbursable (REIM) projects. The CMa must maintain clear delineation between contractor support functions and inherently governmental functions reserved for federal employees, with final determinations, approvals, and official commitments remaining exclusively with the Government Contracting Officer.

The scope requires specialized personnel across multiple labor categories including Construction Executives (15+ years experience, Bachelor's degree or PE/AIA certification), Senior Construction Managers (10+ years), Project Managers (10+ years), Schedulers, Claims Analysts, Cost Estimators, and specialized engineering technicians for mechanical, electrical, concrete/masonry, and life safety systems. Key deliverables include project governance frameworks, project management plans, risk registers, schedule and cost baselines, design quality assurance reviews, construction site inspections, submittal and RFI coordination, schedule and cost analysis, critical systems acceptance, project closeout documentation, and monthly construction management reports with NAVFAC Key Performance Indicators. The contractor must utilize specific Government systems including eCMS for document control, eContracts, Primavera P6 for scheduling, USACE MII for cost estimating, and maintain compatibility with Microsoft Office, AutoCAD, and NMCI military network requirements. The scope also contemplates additional services including claims handling, Government-furnished equipment coordination, special consulting services, and program management services for large, complex programs requiring Earned Value Management System implementation and comprehensive lifecycle management oversight.

EXTENT OF SERVICES

Construction Manager Advisor Services.

The services provided under this contract shall be performed by a company entity, not an individual, to support NAVFAC in its execution of facility projects. The scope of services is divided into two primary phases: pre-award and post-award of the main construction contract. These services will be provided across a range of project types, including Military Construction (MILCON) for the Navy, Marine Corps, and other Defense agencies; Facilities Sustainment, Restoration, and Modernization (FSRM) projects for

CNIC and the Marine Corps; and reimbursable (REIM) project work for various Supported Commands. It is understood that the funding for these pre-award and post-award support services varies depending on the project type, as detailed in the matrix below. The services described herein are distinct from Program Management (PgM), which is the collective oversight of multiple projects for a single stakeholder (e.g., DHA, NSWC) and are aligned with the NAVFAC definition of Project Management (PM) for a singular project, although contractor personnel may be assigned to support multiple projects.

A core principle of the services sought is the clear delineation between contractor support functions and Inherently Governmental Functions (IGF), which are exclusively reserved for Federal employees. The contractor shall perform the preparatory work, analysis, documentation, and coordination required to support Government officials in their decision-making. However, all final determinations, approvals, and official commitments are inherently governmental. This includes, but is not limited to, the determination of Federal program priorities; the initiation, processing, and commitment of funds via contract award or modification; the approval of contract documents; the final acceptance or rejection of contractor products; and the official approval of schedule delays or extensions. Any CMa recommendations regarding payments to other vendors will be provided to the designated Government Contracting Officer's Representative (COR) for their exclusive determination and action.

As a Construction Manager as Advisor (CMa), the contractor will provide comprehensive project management support. The CMa’s Project Oversight role in the post-award phase will include supporting the Government's administration of construction contracts by reviewing submittals, tracking Requests for Information (RFIs), facilitating modification negotiations with the Contracting Officer, and coordinating project closeout activities. Post-award technical consultation and assessment will be provided by staff with relevant pre-award experience. The CMa shall view Risk Management as a critical component of Project Governance and integrate it into all services.

Contract task orders will delineate whether the CMa shall act as a program/project’s primary Program Manager, Project Manager, Construction Manager, or combination thereof. In all scenarios, the CMa is responsible for ensuring overall project success and the project is executed in accordance with NAVFAC policies and construction contract requirements including but not limited to quality, cost, and schedule control. The CMa shall function as a collaborative member of the combined project team and shall provide guidance and expertise throughout all phases of the project. The Government shall enter directly into contractual agreements with designers, construction contractors, commissioning agents and providers of other services; however, the CMa shall be responsible for coordination and communications amongst all project stakeholders while ensuring that entities contracted with the Government meet the obligations of their contracts with the Government. Only the Government Contracting Officer is authorized to make modifications to Government contracts, including this contract with the CMa. The CMa shall provide to the Government expert guidance in relation to modifications to Government contracts. When CMa communicates with Construction Contractors and other Government Contractors, the CMa must ensure it is understood that only the Contracting Officer has the authority to make modifications to contracts. Furthermore, CMa must advise the Construction Contractors and other Government Contractors that if they interpret a communication from the CMa to represent a change to their contract with the Government, they must not proceed with that potential change and must notify the Contracting Officer of their interpretation and request direction.

The CMa is acting as the Government’s Advisor and shall always uphold the best interest of the Government. The CMa shall consistently demonstrate competence and ethical behavior while complying with all applicable laws and regulations. The CMa is responsible for determining the resources required to provide the required services and deliverables. The CMa should be prepared to be flexible and adapt to changing project needs. The CMa shall avoid any action representing a conflict of interest or gives the appearance of a conflict of interest.

Davis-Bacon Act.

This contract is for Construction Management Advisor services and does not include construction, alteration, or repair of public buildings or public works; and is therefore not subject to requirements of the Davis-Bacon Act.
