About this file
This document is a Request for an Individual Waiver of the Nonmanufacturer Rule in accordance with FAR 19.505(c) for a federal contract opportunity.
The Department of Housing and Urban Development (HUD) is seeking to obtain Oracle and Java licenses and maintenance currently covered under Contract Number 866152320F00005. The licenses are perpetual, but an annual support and maintenance contract is required. The estimated dollar value of the requirement is $26,182,005.69. This is a re-procurement, with the incumbent being Emergent LLC under Award No. NNG15SC10B/86615320F00005. Market research indicated there are no known small business manufacturers or processors that can reasonably be expected to supply the required products meeting the specifications. HUD is requesting a waiver of the Nonmanufacturer Rule due to the OEM's concerns that small businesses cannot meet the limitation on subcontracting.
