SOLE SOURCE JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY.
NAVSUP Fleet Logistics Center (FLC) Jacksonville
Regional Contracting Department
110 Yorktown Avenue
Naval Air Station Jacksonville, FL 32212
2. Description of the Action Being Approved.
This justification and approval authorizes the issuance of a firm-fixed-price sole source award to
BellSouth Telecommunications, Inc. d/b/a AT&T Southeast (herein after referred to as AT&T), 2180
Lake Blvd., Mail code 11B01, Atlanta, GA 30319-6004 for maintenance and technical support contract services for AT&T owned telephone cabling infrastructure at Naval Air Station (NAS) Pensacola
Complex, Pensacola, Florida.
3. Description of Supplies/Services.
The contractor shall provide maintenance and technical contract support services for all AT&T owned cable facilities at the Center for Information Dominance (CID), located at Corry Station and Saufley Field at NAS Pensacola, Florida. Specifically, AT&T shall provide maintenance support to telecommunications voice and data circuits beyond the established demarcation sites utilizing existing facilities. Additionally, contractor shall resolve trouble tickets and provide minor repairs e.g., replacing pedestals, repairing termination blocks, running jumpers, replacing patch cables, changing out splice cases, placing cable stubs, hand-pulling inner-duct and cable, and repairing damaged cables that can be hand-dug or in manholes, etc. for the base telephone cabling infrastructure.
The period of performance for these services will commence as follows:
01 MAY 18 – 30 APR 19 (base year)
01 MAY 19 – 30 APR 20 (option 1)
The estimated dollar value, based on the Independent Government Estimate (IGE), including all option year is $427,600.00. Fiscal Year 18, O&MN funds have been provided.
Estimated Dollar Value
FY 18 FY 19 Total
O&MN $211,000.00 $216,600.00 $427,600.00
Total $211,000.00 $216,600.00 $427,600.00
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 1901(e)(2) as implemented by Federal Acquisition Regulation (FAR) Subpart 13.501(a) – “Sole Source Acquisitions.”
Source Selection Information – See FAR 2.101 and 3.104 2
5. Rationale Justifying Use of Cited Statutory Authority.
Approximately 90% of all telecommunications cable for the CID, Corry Station, Saufley Field, and NAS
Pensacola, FL, has been owned by AT&T since 1920 and the remaining 10% is owned by the
Government. The cables have unlimited longevity if properly maintained.
In a letter from Ms. Carol L. Brown, Director of Contracts, for AT&T Corp. (attached), AT&T does not permit third parties, that are not under their direct control, to service their cables. As such, AT&T will not allow the Government to directly contract with a third party.
The Government cannot infringe upon AT&T’s property rights and could be held liable for any damages that occur to the infrastructure as a result of any actions taken by the Government or a third-party. In addition, AT&T is not responsible for making any repairs due to damages caused by the Government or a third party.
Any competitive solicitation and subsequent award to a Contractor other than AT&T would result in a substantial duplication of cost to the Government, that could not be recovered through competition; as that Contractor would have to either a.) remove and install cables across the installation; or b.) purchase the telecommunications infrastructure from AT&T.
a. To remove and install new cables would require the replacement of over 6,000 cable lines at the
CID, Corry Station, Saufley Field and NAS Pensacola sites. Replacing these cables would not only be time consuming, but would also create a disruption of service throughout all locations.
b. The Government previously considered purchasing the infrastructure from AT&T; however, ultimately decided against it.
Pursuant to the statutory authority and supplemented with the preceding rationale, it is recommended and in the best interest of the Government to make a sole-source award to AT&T as the sole proprietor of the
CID, Corry Station, Saufley Field, and NAS Pensacola cable infrastructure.
