About this file

This is a Limited Source Justification form for a simplified acquisition below the Simplified Acquisition Threshold (SAT) being placed against a GSA Federal Supply Schedule (FSS) contract.

The procurement (PID N68520-26-SIMACQJC00000-0331) is for a National Instruments LabView License Agreement/Subscription with a total Independent Government Estimate of $59,709.24. The period of performance runs from November 1, 2026 through October 31, 2027. The requiring activity selected "Peculiar Items/Brand-Name" as the basis for restricting competition. The justification explains that National Instruments software is essential for the Government's audio distortion measurement and audio frequency analysis requirements, and the software must be compatible with Navy current systems. No other brand-name product can seamlessly integrate with existing infrastructure without significant baseline equipment changes. The document notes that National Instruments Corporation owns the copyright and intellectual property, does not authorize third-party maintenance, and provides software downloads, upgrades, updates, and support exclusively through National Instruments or its authorized resellers. The justification indicates that market research will continue to determine if future competitive actions become feasible, such as if alternative products become available or ownership rights are released. The document requires certification by the requiring activity that the facts and representations are complete and accurate.

Limited Source Justification Procurement Group ECF: 8-01

LIMITED SOURCE JUSTIFICATION

Simplified Acquisition Form

This form is required by FAR Part 8 for all contracts below SAT whenever full and open competition is restricted and award will be made via task/delivery order placed against GSA Federal Supply Schedule (FSS) contracts. Refer to 801 Sole Source Justification when restricting competition and award will be made via standalone purchase order.

Part 1- Procurement Information (Requiring Activity Completes)

In accordance with FAR Part 8, Contracting Officers may place an order against GSA FSS contracts with a limited number of sources when one or more of the following circumstances apply and the order exceeds the micro-purchase threshold.

Note: Orders placed or 8PAs established against FSS contracts are exempt from the requirements in FAR Part 6. However, there are additional requirements when limiting competition for orders against FSS contracts exceeding the SAT. When these circumstances apply, the NAVAIR LSJ template must be used instead.

Part 11- Rationale for Limited Sources (Requiring Activity Completes}

Basis for Restricting Instructions for Use Instructions for Rationale Competition

D Urgency

D Only One Source

D Economy and efficiency

COMFRC

An urgent and compelling need exists, and following the procedures would result in an unacceptable delay. If choosing this option, an Urgency Statement must be included with the PIO package. This basis is appropriate when the Government would be seriously injured unless the agency is permitted to limit the number of sources solicited. The serious consequences resulting from the routine processing time of full competition, may include but are not limited to disruption to fleet schedule, work-stoppage, or exhaustion of on-hand, mission critical supplies or services.

Choose if only one source can provide the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.

Choose if in the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order already issued on a competitive basis.

CUI

Summarize the circumstances outlined in the Urgency Statement and explain how this vendor is the only source who can meet the Government's need in the required timeframe.

Explain what rights are restricted, why the restrictive rights make the required item or service available from only one source, and why another company could not satisfy the Government's need.

Provide a thorough explanation why this is a follow-on to a previously competed order and explain why competition is not in the Government's best interest.
