About this file

This is a Sole Source Justification (SSJ) document in Simplified Acquisition Form submitted by the U.S. Navy for Procurement Group ECF: B-01, dated 1 October 2025.

The procurement involves a National Instruments LabVIEW License Agreement/Subscription with a delivery period from 1 November 2026 through 31 October 2027. The justification is based on a Brand-Name sole source restriction, which restricts competition to a single source and permits award without full and open competition. The contracting officer determined that restricting competition to one source is appropriate because the government's requirement is available directly through the developer National Instruments (NI)—the Test & Measurement business group within Emerson's Software and Control group—and two authorized resellers through Emerson's partner program. The RDT&E lab's audio testing infrastructure is natively built within the proprietary National Instruments LabVIEW environment, and no other software alternative is fully compatible or interoperable with existing LabVIEW-based testing profiles and source code. The justification explains that migrating to an alternative software platform would require complete redesign of legacy test configurations, creating unacceptable operational delays and directly degrading the Fleet Readiness Center East (FRCE) support mission. The government commits to continuing market research to determine if future competitive actions become feasible, such as if similar products emerge in the marketplace, the OEM releases ownership rights, or economical alternatives become available.

signed letter from OEM to licensee or Government which outlines the agreement.

☒ Brand-Name Choose if only a brand-name product, or feature of a brand-name product can properly fulfill the requirement. Brand-name items are available from more than one source including authorized distributors, authorized technical representatives for the Original Equipment Manufacturers (OEM), or commercial suppliers. This basis is appropriate when the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

Describe how the brand-name product or feature is essential to the Government’s requirement and explain why a brand-name or equal basis cannot meet the need (see FAR 11.104). Summarize how market research shows similar products could not meet the need as is or be modified to do so.

Where a single source is identified to provide a portion of a purchase because that portion of the purchase specifies a particular brand-name item, the rationale must state that it only applies to the portion of the purchase requiring the brand-name item.

☐ Brand-Name or Equal

Choose if there are additional sources besides the brand-name item that could provide the most relevant physical, functional or performance characteristic(s). Consider any firm requirement for the product to be a relevant characteristic.

Describe how the brand-name item meets the Government’s requirement. Give a general description of the relevant characteristic(s) that an “equal to” item must meet to be acceptable for award.

☐ 8(a) Sole Source Direct Award

Choose if the requirement has been identified for a sole source to an 8(a) company following the alternative procedures for direct award made under the Partnership Agreement (PA) between the SBA and DoD in accordance with 10 U.S.C.

3204(a)(5).

Address the competition requirements for the 8(a) program (see FAR 19.805 & DFARS 219.805) and summarize the decision for selecting the 8(a) company for this requirement.

☐ Other Choose if none of the other options apply to the requirement (e.g. Industrial Mobilization, International Agreement).

Provide a thorough explanation why competition is not in the Government’s best interest.

Rationale for Selected Basis:

The National Instruments (NI) software must perform quick ad-hoc testing, audio distortion measurements, audio frequency analysis, and automated testing. The required software licenses and support must meet Research, Development, Test, and Evaluation (RDT&E) lab testing requirements and remain compatible with the Navy’s current systems. The RDT&E lab already operates with existing licenses of NI software lab testing applications. No other brand-name product can seamlessly integrate with this existing infrastructure without causing significant changes to the baseline equipment.

The RDT&E lab's audio testing infrastructure is natively built within the proprietary National Instruments (NI) LabVIEW environment. Currently, no other software alternative is fully compatible or interoperable with these existing LabVIEW-based testing profiles and source code. Migrating to an alternative software platform would require a complete redesign of legacy test configurations, creating unacceptable operational delays. If the government is unable to purchase the required NI LabVIEW software licenses and support, the RDT&E lab will be unable to execute critical audio testing and analysis, directly degrading the Fleet Readiness Center East (FRCE) support mission.

The Government’s requirement is available directly through the developer National Instruments (NI) - the Test & Measurement business group within Emerson's Software and Control group - and two authorized resellers through Emerson's partner program.

The Government will continue to conduct market research to determine if there are changes in the marketplace that would enable future competitive actions, e.g., there are similar products and/or product support in the marketplace that provides the same functionality, the original equipment manufacturer releases ownership rights of product, or it is economically feasible to procure a new system.

If you are preparing this for an official procurement document, I can help you refine it further. Would you like me to format this into a standard Justification and Approval (J&A) template, or do you need to add specific part numbers and quantities?
