About this file
This is a Use and Non-Disclosure Agreement (NDA) required for solicitation N6817127QN003 related to USS Oscar Austin (DDG 79). The agreement governs the handling of restricted technical data provided by the Government to potential offerors and their subcontractors for proposal development purposes.
Recipients are permitted to use, modify, reproduce, release, perform, display, or disclose the restricted technical data solely for proposal support of the specified solicitation. Data sharing with subcontractors, suppliers, or prospective subcontractors requires submission of executed NDAs to the Contracting Officer before disclosure. Recipients must implement operating procedures and physical security measures to prevent inadvertent release to unauthorized third parties and must afford the data the same degree of security as the Department of Defense. The agreement requires recipients to accept data "as is" without warranty and prohibits access by individuals who are debarred, suspended, ineligible for U.S. government contracts, or in violation of export control laws. Recipients agree to indemnify the Government against claims arising from misuse or unauthorized disclosure of the data. Non-U.S. companies must submit to U.S. laws, regulations, and jurisdiction. Successful offerors may be required to sign an additional agreement and use data only as permitted under DFARS 252.227-7025, while unsuccessful offerors must destroy all documentation within 30 days of non-selection and provide destruction statements. The agreement is effective from execution through notice of non-selection, with obligations surviving termination. Enclosure 1 lists ten restricted technical references related to piping systems, insulation requirements, steam kettle operations, and pollution control for the DDG-51 class vessel.
