This letter will be for notification purposes only, for the Government to conduct any research, and no determination will be made by the Government at that time. If no OCI issues are present or anticipated, no action is required of the Offeror within this window.

Step 2: Offerors shall submit a statement in affirmation or negation whether they have an OCI conflict regarding this solicitation. If OCI issues are present or anticipated, Offerors shall provide details and submit an OCI mitigation plan and its corporate policy for resolving as part of their proposal submission. The submission of an offer constitutes unconditional acceptance to perform all of the tasks described in the SOW; therefore, the Offeror’s proposal need not address every single aspect of the SOW, but shall clearly demonstrate its ability to meet the requirements, provide explanatory details, assuming that the Government has no prior knowledge of its facilities, capabilities, or experience, and shall identify technical uncertainties and assumptions within the requirements and provide specific courses of action for their resolution.

Offerors are encouraged to address any innovative approaches to meeting the requirements. The Offeror shall not simply rephrase or restate the Government’s requirements in the proposal. Proposals that merely reiterate the Government’s own requirements shall be deemed unacceptable and thus ineligible for award.

- Select from that page: Cost Analysis Spreadsheet

Offerors may alter the format and formulas of this spreadsheet for the sole purpose of accommodating their own accounting systems. Spreadsheets, either in the format above or contractor format, shall contain intact formulas used to calculate any aspect of the proposal (i.e., burdened labor rates, fee, etc.). Spreadsheets provided without intact formulas are unacceptable and may render an Offeror’s proposal ineligible for award. However, Prime Offerors and subcontractors shall provide a single spreadsheet supporting the total amount of all CLINs listed in Section B of the solicitation.

If the Offeror intends to subcontract 70% of the total cost of all work to be performed, the Offeror shall provide information required by FAR 52.215-22(c).

(g) Offerors may propose the estimated labor mix shown in the table above or deviate; however, Offerors must propose the full level of effort (LOE) of 16,500 hours. If an Offeror’s proposed labor mix differs from the Government’s estimate by twenty percent (20%) or greater, in terms of labor hour distribution, the offeror shall provide rationale to explain why the proposed deviation is appropriate. The rationale shall not exceed four (4) pages. In order for the labor mix rationale to demonstrate the proposed deviating labor mix is appropriate, it shall address:

(i) How the proposed labor mix deviation in terms of level and area of expertise (e.g., proposed labor categories) is suitable for performance of the SOW tasking as it relates to the estimated level of effort per SOW task, and associated complexity identified in the SOW;

(ii) How relationships between labor categories will be structured and operate at the task level to accomplish the tasking efficiently and effectively (e.g., peer review process, senior to junior level oversight and interaction, etc.).

(2) For the purposes of defining how a deviation will be calculated, the Government will sum together the absolute value of all labor hour increases and decreases. This total will then be divided by the total estimated hours specified in the solicitation.

For example: the Government’s solicitation is for 10,000 total estimated hours and specifies a labor mix deviation percentage of 20%. An offeror decreases Labor Category A by 500 hours, decreases Labor Category B by 1,000 hours, and increases Labor Category C by 1,500 hours. The sum of the deviation is 3,000 hours total. Therefore, a rationale shall be provided by the offeror since its proposed deviation percentage is 30% (3,000/10,000).

Labor Categories cited must be titles listed at the NUWC Division Newport Contracts Website https://www.navsea.navy.mil/Home/WarfareCenters/NUWCNewport/Partnerships/CommercialContracts/LaborC ategories.aspx

Or Service Contract Act (SCA) labor categories cited in the SCA Directory of Occupations (see https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/SCADirectVers5.pdf)

(h) The Offeror shall propose $533,580 in performance of CLIN 5000, Hardware Repair Services. The individual unit pricing under this CLIN will be established at the Task Order level for performance of SOW task 4.3. The Government will issue a Request for Quote for the required services when needs are identified and the Contractor will provide a quote for the Government’s evaluation.

(i) Other Direct Costs (ODCs) and Travel (CLINs 6000 and 7000): Offerors shall propose an ODCs estimate of $500,000 and a Travel estimate of $78,260 (figures do not include burdens).

These totals are estimates for the five (5) year Ordering Period:

CLIN Totals

6000 – Other Direct Costs (ODCs)

Year 1 $100,000

Year 2 $100,000

Year 3 $100,000

Year 4 $100,000

Year 5 $100,000

7000 - Travel

Year 1 $15,652

Year 2 $15,652

Year 3 $15,652

Year 4 $15,652

Year 5 $15,652

Offerors may fully burden such costs and these costs shall be added to the estimate(s). Offerors are required to distribute these sums among subcontractors consistent with the narrative included in the technical proposal.

Whenever a subcontractor proposes material costs, the subcontractor may fully burden such costs and these costs shall be added to the material estimate. Offerors shall not add fee to ODCs/Travel costs.

The ODC estimate includes purchased incidental consumable materials, computer time, reproduction, telephone, shipping and any other costs that are charged direct (with the exception of Labor and any Firm Fixed Price (FFP) CLIN items). The Travel estimate includes travel expenses. Offerors shall burden these estimates with applicable indirect rates (i.e., G&A, Material Handling). No detailed justification from Offerors for these amounts is required.

The Government's Cost Realism evaluation may alter the additional costs on the basis of more accurate rate data or as a product of the Government analysis and estimate of the appropriate added costs. Any such alteration in the evaluated contract pricing will not, however, be reflected in the contract award.

Any Offeror having an Accounting System which includes, within overhead or G&A, the cost elements of material and travel/subsistence shall specifically state so in the cost proposal. This will preclude these costs from being unduly considered in the Government's cost evaluation.

(g) Supporting Documentation Requirements:

(1) Offerors shall provide the Basis of Estimate (BOE) supporting the costs/prices provided in the Cost/Price Summary including a description of the assumptions and computations used to develop the proposed costs/prices.

For materials, Offerors shall describe their methodology for ensuring prices are fair and reasonable. The prime Offeror shall be responsible for justifying the reasonableness of each subcontractor. (Note material justification is not applicable if the Government is providing plug numbers)

(2) Direct Rate Supporting Documentation: The Offeror shall provide details as to the basis of labor rates proposed (i.e., actual rates, wage rate determinations, bid level rates). If actual direct labor rates are proposed, the Offeror shall provide the effective date(s) of the actual labor rates and provide Payroll Journals or equivalent for all labor rates. Trace proposed Direct Labor Rates to proposed individual personnel and identify the date wage rate is current. If proposed direct labor rates vary from actual wages of personnel, explain the basis for those rates. Failure to provide Payroll Journals for all personnel proposed based on actual rates may render the proposal ineligible for award.

(3) Escalation: The Minimum Escalation rate for this requirement is 3.30%. Offerors may propose escalation rate(s) that deviates from this minimum escalation rate; however the Government reserves the right to make upward cost realism adjustments using these minimum escalation rates, unless proposed escalation rates are fully supported by an approved Forward Pricing Rate Agreement (FPRA).

(4) Indirect Rate Supporting Rate Documentation: Offerors shall provide the supporting information and identify the basis of proposed rates for indirect costs (e.g., Forward Pricing Rate Agreement and date of agreement, bidding rates and the date of submission; or, actual rates used and the effective date, billing rates, and the date of approval, etc.).

(5) Uncompensated Overtime: For the prime and each subcontractor, in accordance with FAR 52.237-10, “Identification of Uncompensated Overtime”, if uncompensated time is included in the offer or any of the supporting cost data, the uncompensated time should be clearly identified with an explanation as to why it is needed. In addition, for any prime or subcontractor proposing uncompensated time, briefly summarize the company policy on uncompensated time and provide a copy of the policy. State what, if any, impact the policy may have on the efforts described in the Statement of Work/Performance Work Statement. Provide historical data to demonstrate that the proposed level of uncompensated overtime is realistic.

(6) Facility Capital Cost of Money (FCCOM): Offerors shall submit form CASB-CMF if proposing FCCOM and show the calculation of the proposed amount. Additional narrative may be submitted as a separate document, if necessary, to describe derivation of labor rates, use of uncompensated overtime pools to which indirect rates are applied, etc.

(7) Subcontracted Costs. Each subcontractor estimate shall be addressed separately, and detailed cost information shall be provided in the same format as required for the prime Offeror. Prime Offerors shall briefly state in their Cost Narrative the contract type for each subcontractor and provide rationale as to the appropriateness of the proposed subcontract type. This rationale shall include an analysis of the ability of subcontractor business systems to support the proposed subcontract type, including any supporting documentation (i.e., audits). Subcontractors may submit their information directly to the Government and provide cost or pricing data and supporting information in the same format and with the same details specified in this provision for Prime Offerors. If subcontractors elect to submit their information directly to the Government, it must arrive no later than the time and date set for Prime proposal receipt. The Government is not responsible for ensuring subcontractors submit information nor is it responsible for confirming receipt to the prime Offeror.

(h) Firm Fixed Price (FFP) CLINS (1000, 2000, 3000)

For the FFP production CLINs, the Offeror shall complete the Stepladder Pricing Table in Section B.

Additionally, Offerors shall provide a basis of estimate for all costs with its submitted pricing. Offerors shall provide the BOE supporting the costs/prices provided in the Cost/Price Summary including a description of the assumptions and computations used to develop the proposed cost/prices. For materials, Offeror shall describe its methodology for ensuring prices are fair and reasonable. The prime Contractor shall be responsible for justifying the reasonableness of each subcontractor and material costs. The BOE is required for each CLIN, each step, and each ordering period.
