About this file

This is an RFQ Amendment Clarification and Guidance document that serves as a step-by-step compliance guide for the Buy American Act (BAA) requirements under DFARS 252.225-7000 for RFQ Amendment 0004.

The procurement is a 100% Small Business Set-Aside for the fabrication of custom Modular KVM Mount Brackets, issued by NIWC Pacific under RFQ Number N66001-26-Q-6264. All custom bracket fabrication (cutting, bending, machining, and manufacturing) must occur in the United States. Raw metal sourcing determines product classification: brackets using raw metal melted in the United States or any of 28 qualifying countries (including Australia, Canada, France, Germany, Japan, United Kingdom, and others) are classified as domestic end products and evaluated at the quoted price without penalty. Conversely, brackets using raw metal melted in non-qualifying countries are classified as foreign end products and subject to a 50% price evaluation factor when competing against domestic offers. Quoters must complete DFARS 252.225-7000 provision paragraph (c) by either leaving tables blank (for domestic products with written acknowledgment) or listing brackets in Table (c)(3) for foreign products. All quoters have the opportunity to review and update their supply chains by the September 24, 2026 deadline. Updated submissions must include technical documentation confirming material meets engineering requirements, revised delivery schedules reflecting any lead time changes from domestic or qualifying country sourcing, and updated pricing reflecting verified material costs (or written confirmation that existing pricing remains unchanged). Failure to update required factors—Technical Capability/Material Sourcing, Delivery Schedule/Lead Time, and Price Quote—along with the completed DFARS provision will result in incomplete submissions.

RFQ Amendment 000X | BAA Compliance Guide

ATTACHMENT 06 TO RFQ AMENDMENT 0004

This Amendment incorporates the pre-award certification provision DFARS 252.225-7000 in full text which was erroneously incorporated by reference via the initial RFQ.

To prevent any confusion or incorrect fill-ins, please use this step-by-step guide to complete the provision.

PLAIN-ENGLISH GUIDE FOR BUY AMERICAN ACT (BAA) COMPLIANCE & QUOTATION UPDATES

1. Fabrication (Manufacturing) & Sourcing Ground Rules for this Small Business Set-Aside Because this procurement is a 100% Small Business Set-Aside under the Buy American Act (DFARS 252.225-7001):

Fabrication (manufacture) Must Be in the USA: All custom brackets must be cut, bent, machined, and fabricated (manufactured) in the United States. Per DFARS 225.872-3(a) exception, for a small business set-aside situation only, any end products manufactured outside the U.S. (including end products manufactured in foreign qualifying countries) are ineligible for award. NOTE: The rationale behind the small business set-aside exception per DFARS 225.872-3(a) is to prevent small businesses from having to compete with the qualifying countries that can fabricate (manufacture) the same end product. In a full and open competition situation the exception would not apply (meaning a quote from a qualifying country that fabricated (manufactured) the end item would also be eligible in a competition that was NOT set-aside for small business).

The Raw Metal (primary component of end product) Dictates Your Domestic or Foreign component status: Because raw aluminum/metal represents the vast majority of the bracket's material cost (exceeding 65%), where your raw metal is melted determines how your quote is evaluated:

· DOMESTIC components - U.S. or Qualifying Country Metal (per paragraph (2) Scenario A below) : Raw metal melted in the United States or any of the Qualifying Countries identified under clause DFARS 252.225-7001 ➔ Evaluated at base price without the need to apply a 50% evaluation factor.

The Qualifying Countries are: Australia, Austria, Belgium, Canada, Czech Republic, Denmark, Egypt, Estonia, Finland, France, Germany, Greece, Israel, Italy, Japan, Latvia, Lithuania, Luxembourg, Netherlands, Norway, Poland, Portugal, Slovenia, Spain, Sweden, Switzerland, Turkey, and the United Kingdom.

· FOREIGN components - Non-Qualifying Country / Foreign Metal (per paragraph (2) Scenario B below): Raw metal melted in any country other than the United States or a Qualifying Country identified under DFARS clause 252.225-7001 ➔ Subject to a 50% price evaluation factor when competing against domestic offers.

2. Completing the DFARS 252.225-7000 Provision Please locate paragraph (c) of the attached DFARS 252.225-7000 provision and complete it according to the matching scenario below:

🟢 SCENARIO A: Your Raw Metal (components) is from the United States or a Qualifying Country – DOMESTIC components If you verify with your material supplier/distributor that your raw metal/aluminum sheet is melted in the United States or any Qualifying Country identified under DFARS clause 252.225-7001:

• Your Bracket is Legally: A Domestic End Product (meets the 65% domestic content requirement as the metal is the primary component of the end product).

• How to Fill Out the Provision: Leave the tables in paragraph (c) completely BLANK. (Under DFARS 252.225-7000(c)(1), leaving the tables blank legally certifies that your bracket meets the 65% domestic standard).

• How Price Would Be Evaluated: Evaluated at your actual quoted price without the need to apply the 50% evaluation factor.

• Post-Award Obligation: Pursuant to DFARS 252.225-7001(c), the contractor is legally obligated to deliver domestic end products.

🔴 SCENARIO B: Your Raw Metal (components) is from a Non-Qualifying Country – FOREIGN/NOT DOMESTIC components If your supplier quotes raw metal/aluminum sheet that is melted in any country other than the United States or a Qualifying Country (meaning other than the qualifying countries listed under DFARS clause 252.225-7001):

• Your Bracket is Legally: A Foreign End Product (for a small business set-aside situation if the end product is fabricated (manufactured) in the US it is still an eligible quote, but it legally falls under a “foreign end product” solely because raw metal fails the 65% domestic threshold as the raw metal is melted in a country other than the US or qualifying country).

• How Price Would Be Evaluated: Pursuant to DFARS 225.502(c) and PGI 225.5 the Department of Defense applies a 50% price evaluation factor to foreign offers when competing against domestic offers.

(Note: In accordance with PGI 225.570 Example 1, if no domestic quotes are received across the competition, the 50% factor is not applied to any of the quotes).

• How to Fill Out the Provision: You must list the brackets in Table (c)(3) (Other Foreign End Products) as shown below:

3. Mandatory Instructions for Updating Evaluation Factor Submissions or of confirming status of existing quote All quoters are granted the opportunity to review their supply chains and update their quotes. If sourcing domestic or qualifying country metal causes you to change your material, supplier, or fabrication (manufacturing) approach, you MUST update all corresponding evaluation factor submissions:

Factor 1: Technical Capability / Material Sourcing:

If you are proposing a substitute or alternate aluminum alloy (e.g., switching between 6061-T6 and 5052-H32) or changing manufacturing processes to accommodate domestic/qualifying material, submit updated Technical Documentation demonstrating that the proposed metal meets all engineering and drawing requirements (or re-confirm your existing submitted information).

Factor 2: Delivery Schedule & Lead Time:

Sourcing domestic or qualifying metal may affect material availability. Verify raw material lead times with your distributor and submit an updated Delivery Schedule / Lead Time confirmation (or re-confirm your ability to meet the existing quoted delivery schedule).

Factor 3: Price Quote:

Submit an updated Price Quote reflecting your verified material costs (or provide a written statement confirming that your previously submitted price remains firm and unchanged).

4. Submittal Checklist for Quoters Please submit by 24SEP2026:
