EVALUATION OF PROPOSALS
M-215-H004 BASIS OF AWARD (NAVSEA) (DEC 2018)
M.1. BASIS FOR AWARD
It is the intention of the Navy to award Multiple Award Contract (MAC), Indefinite-Delivery, Indefinite-Quantity (IDIQ) type contract(s) under the 8(a) program with Cost-Plus-Fixed-Fee (CPFF) & Firm Fixed Price (FFP) ordering provisions to all qualifying Offerors who are deemed technically acceptable. Per FAR 15.304(c)(1)(ii)(A), Evaluation Factors and Significant Subfactors, Contracting Officers may choose not to include price or cost as an evaluation factor for award when a solicitation (a) has an estimated value above the simplified acquisition threshold;
(b) will result in multiple-award contracts that are for the same or similar services; and (c) states that the Government intends to make an award to each and all qualifying offerors. In accordance with FAR 15.304(c)(1)(ii)(B), the Contracting Officer shall consider price or cost as one of the factors in the selection decision for each task order delivery order under the multiple-award contract. The Government will utilize the Acceptable/Unacceptable Selection Process to determine if each company is considered technically acceptable for award.
The Government intends to make an award to each and all qualifying Offerors. For the purposes of this solicitation, a qualifying offer is a technically acceptable proposal conforming to the requirements of the solicitation submitted by a responsible source, where the Contracting Officer has no reason to believe would be likely to offer other than fair and reasonable pricing. Offerors shall provide the following information. The Government intends to evaluate proposals and award one or more contracts based on the initial proposals. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a technical standpoint. However, the Government reserves the right to enter into discussions with Offerors as it is determined by the Contracting Officer to be in the Government’s best interest.
M.2 EVALUATION FACTORS
FACTOR 1: TECHNICAL
Element: 1A - Personnel
The Government will evaluate each Offeror's proposed personnel for their technical capability to perform the requirements in the solicitation.
Key Personnel will be evaluated in terms of experience, education and training as stated in the minimum qualifications in the labor categories listed in Section C. The Government will evaluate the resumes submitted by each Offeror by comparing the education and experience of proposed personnel against the qualifications indicated.
Minimums are and must be met.
Non-key Personnel will be evaluated based on an affirmative statement as indicated in Section L.
Element 1B - Management Approach
The Government will evaluate the effectiveness of each Offeror's management approach to perform the requirements in the solicitation.
1. Resources - Offerors will be evaluated on staffing resources, the ability to respond to workload fluctuations and overlapping tasks in a timely manner, and the ability to engage in full performance of the Contract once the firm receives notice of award.
2. Organizational Structure, Responsibilities, and Relationships - The firm’s organizational structure and management processes will be evaluated with respect to their effectiveness in facilitation of the SOW tasks, executing and monitoring of performance, promoting open and effective communication with the Contracting Officer and COR, meeting reporting requirements of the solicitation.
3. Subcontractor Management - Offerors will be evaluated on whether there is a sound basis for subcontracting the work, selecting and determining the involvement of their proposed subcontractor(s), and whether their Management Plan demonstrates a clear process in the management and use of subcontractors in accomplishing the required tasks. Offerors are advised that technical proposals may be evaluated without consideration of any proposed subcontractor which is deemed to have an organizational conflict of interest.
Element 1C - Technical Capability The Contractor will be evaluated on the information, detailed, that demonstrates their technical capability to perform work as per the SOW with respect to installation of Navy Shipboard Fleet Modernization. Contractors who demonstrate mature and effective technical capabilities will receive an acceptable rating.
Element 1D - Corporate Experience
Proposals will be evaluated based upon a comparison of the Offeror’s demonstrated experience to the work to be performed in the SOW. Consideration will be given to the magnitude, complexity, and time of performance of the demonstrated experience relative to the services to be furnished under the present solicitation.
Element: 1E - Quality Assurance
The Offeror’s QMS Level 1 and Level 2 Procedures relevant to the requirements of the solicitation, including the SOW, will be evaluated based on whether their content meets the requirements of ASQ/ANSI/ISO 9001:2015.
Factor 1 – Technical (Elements 1A, 1B, 1C, 1D, 1E)
Rating Description Acceptable Proposal meets the minimum requirements of the solicitation.
Unacceptable Proposal does not meet the minimum requirements of the solicitation.
FACTOR 2 – PAST PERFORMANCE
The Past Performance Evaluation is an assessment of the Offeror’s probability of meeting the solicitation requirements. This assessment is based on the Offeror's record of relevant and recent past performance information that pertain to the products and/or services outlined in the solicitation requirements.
Past performance will be initially evaluated to determine whether the Offeror’s present/past performance is recent and relevant to the effort to be acquired. In establishing what is relevant for the acquisition, consideration should be given to what aspects of an Offeror’s contract performance history would give the most confidence that the Offeror will satisfy the requirements of the contract that is contemplated to be awarded as a result of the evaluation of proposals in the current procurement.
Second, the past performance evaluation is to determine how well the Offeror performed on relevant prior contracts.
The past performance evaluation performed in support of a current source selection does not establish, create, or change the existing record and history of the Offeror’s past performance on past contracts; rather, the past performance evaluation process gathers information from customers on how well the Offeror performed those past contracts.
NOTE: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv).
Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered “Acceptable”.
Factor 2 - Past Performance Rating Description
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the Offeror’s performance record, the Government does not have a reasonable expectation that the Offeror will be able to successfully perform the required effort.
M.4 COMPETITIVE ACQUISITION INSTRUCTIONS
The Government intends to evaluate proposals and award a contract(s) without discussions with Offerors. Therefore, the Offeror's initial proposal should contain the Offeror's best terms from a technical standpoint. However, the Government reserves the right to enter into discussions with Offerors as it is determined by the Contracting Officer to be in the Government’s best interest.
M.5 DISCUSSION/FINAL PROPOSAL REVISIONS
If the Contracting Officer determines that discussions are to be held, they shall indicate to, or discuss with, each Offeror still being considered for award; significant weaknesses, deficiencies, and other aspects of its proposal (such as technical approach and terms and conditions) that could, in the opinion of the Contracting Officer, be altered or explained to enhance materially the proposal’s potential for award. The scope and extend of discussions is a matter of the Contracting Officer’s judgment. At the conclusion of discussions, each Offeror shall be given an opportunity to submit a final proposal revision. A final cut-off date for receipt of final proposal revisions will be established by the Contracting Officer.
