NOTICE TO CONTRACTORS

Before submitting a quote, contractors should be aware of the following general conditions:

1. If a portable trailer testing unit is used, the trailer nearest the building will be located approximately 175 ft. horizontally from the exhaust stacks. Furthermore, the stacks are an additional 50-60 ft. above grade.

2. If electricity is required, it shall be provided by the contractor in the form of a generator or battery, the price of which shall be included in the quote. The Government will NOT furnish an electrician to connect electricity.

3. This contract does not require SO2 emissions testing. SO2 and/or SOx emission rate my be calculated using the sulfur content in the fuel, as necessary to satisfy the requirements of the permit.

4. This equipment does not have a Continuous Emission Monitoring System (CEMS).

5. The testing herein is not a RATA test for a CEMS system.

6. The testing herein is a start-up test for new equipment.

7. The equipment being tested is a simple cycle gas turbine generator with no steam production data, as this equipment does not produce steam.

8. The test ports on each stack will be 3” inner diameter.

9. If all variables and test parameters can be obtained without fuel analysis, fuel analysis is

NOT required.

10. This contract only requires Nitrogen Oxide Emissions Testing. However, further data may be required in order to calculate the NOx emissions.

QUESTIONS AND ANSWERS

Q1. PWS Section 1.2.5 states, “Fuel samples will be collected and provided by NSWCPD to the contractor, and the

Contractor shall transport samples and have them analyzed by a laboratory that complies with the requirements of

ISO/IEC 17025:2017. What will the fuel samples be analyzed for?

A1. The fuel analysis is used to determine the fuel factor (Fd), which is used in calculating the exhaust gas flow rate

(EPA Method 19) and subsequent NOx emission calculations. Typically, the fuel needs to be tested for anything necessary for the preparation of the stack test report. For example, fuel testing is done to determine fuel characteristics, including fixed gases and hydrocarbons, sulfur, density, and heating value.

CDRL A002 of the Performance Work Statement (PWS) specifies, “In addition to DI-NDTI-80603A, the Stack Test

Report shall be developed and submitted in accordance with the Pennsylvania Department of Environmental

Protection (PADEP) Source Test Manual requirements (address below) and shall also conform to requirements in

40 Code of Federal Regulations (CFR) 50 through 98, 25 Pennsylvania Code (PA Code) 121 through 141, and as dictated by Philadelphia Air Management Services (AMS).”

1. INTRODUCTION

1.0.1 The Naval Surface Warfare Center Philadelphia Division (NSWCPD) is a Department of

Defense entity responsible for research and development, testing and evaluation, engineering

(RDT&E) and fleet support for the U.S. Navy’s ships, submarines, military watercraft and unmanned vehicles. This requirement is a Facilities Service Contract (FSC) for NSWCPD Code

102 Infrastructure Division, which provides Infrastructure, Facilities, Environmental and Safety services to NSWCPD.

1.0.2 This contract is for non-personal services located in the Philadelphia Navy Yard in

Pennsylvania. It does not create employment rights with the U.S. Government whether actual, inherent, or implied. In general, this contract provides source testing of two oil-fired Gas

Turbine Generators (GTGs) located in Bldg 77H to demonstrate compliance with NSWCPD’s

Plant-wide Applicability Limit (PAL) and to demonstrate compliance with the Title V permit.

Work will involve accessing sampling ports located on 48-inch-diameter vertical exhaust stacks accessible by standing on Bldg 77H’s roof following applicable or relevant and appropriate health-and-safety rules. This contract also requires submittals prior to and following performance testing to comply with stationary source testing requirements. Performance Work Statement

(PWS) Sections 1.2 and 6 below provide more detail regarding the work and location(s) specific to this requirement.

1.0.3 Government / Contractor Relationship

a) The services to be delivered under this Contract are non-personal services and the parties recognize and agree that no employer-employee relationship exists or will exist under the

Contract between the Government and the Contractor's personnel. Therefore, it is in the best interest of the Government to provide both parties a full understanding of their respective obligations.

b) The Contractor employees shall identify themselves as Contractor personnel by introducing themselves or being introduced as Contractor personnel and displaying distinguishable badges or other visible identification for meetings with Government personnel. In addition, Contractor personnel shall appropriately identify themselves as Contractor employees in telephone conversations and in formal and informal written correspondence.

c) Contractor personnel under this Contract shall not engage in any of the inherently governmental functions listed at FAR Subpart 7.5 or DFARS Subpart 207.5.

d) Employee Relationship:

1) The services to be performed under this Contract do not require the Contractor or its personnel to exercise personal judgment and discretion on behalf of the Government. Rather the

Contractor's personnel will act and exercise personal judgment and discretion on behalf of the

Contractor.

2) Rules, regulations, directives, and requirements that are issued by the U.S. Navy and

NSWCPD under its responsibility for good order, administration, and security are applicable to all personnel who enter a Government installation or who travel on Government transportation.

This is not to be construed or interpreted to establish any degree of Government control that is inconsistent with a non-personal services contract.

e) Inapplicability of Employee Benefits: This Contract does not create an employer-employee relationship. Accordingly, entitlements and benefits applicable to such relationships do not apply.

f) Notice. It is the Contractor's, as well as the Government's, responsibility to monitor Contract activities and notify the Contracting Officer if the Contractor believes that the intent of this

Section has been or may be violated.

1) The Contractor shall notify the Contracting Officer (KO) in writing via letter or email within three (3) calendar days from the date of any incident that the Contractor considers to constitute a violation of this Section. The notice should include the date, nature, and circumstances of the conduct; the name, function, and activity of each Government employee or Contractor official or employee involved or knowledgeable about such conduct; identify any documents or substance of any oral communication involved in the conduct; and the Contractor's estimated date when, absent a response, cost, schedule or performance will be impacted.

2) The Contracting Officer will, within five (5) calendar days after receipt of notice, respond to the notice in writing. In responding, the Contracting Officer will either:
