PERFORMANCE WORK STATEMENT
Performance Work Statement (PWS) for
Flight III Gas Turbine Generators (GTG) Emission Testing
1. INTRODUCTION
1.0.1 The Naval Surface Warfare Center Philadelphia Division (NSWCPD) is a Department of
Defense entity responsible for research and development, testing and evaluation, engineering
(RDT&E) and fleet support for the U.S. Navy’s ships, submarines, military watercraft and unmanned vehicles. This requirement is a Facilities Service Contract (FSC) for NSWCPD Code
102 Infrastructure Division, which provides Infrastructure, Facilities, Environmental and Safety services to NSWCPD.
1.0.2 This contract is for non-personal services located in the Philadelphia Navy Yard in
Pennsylvania. It does not create employment rights with the U.S. Government whether actual, inherent, or implied. In general, this contract provides source testing of two oil-fired Gas
Turbine Generators (GTGs) located in Bldg 77H to demonstrate compliance with NSWCPD’s
Plant-wide Applicability Limit (PAL) for Nitrogen Oxides (NOx) and Sulfur Dioxide (SO2) and also to demonstrate compliance with the Title V permit. Work will involve accessing sampling ports located on 48-inch-diameter vertical exhaust stacks accessible by standing on Bldg 77H’s roof following applicable or relevant and appropriate health-and-safety rules. This contract also requires submittals prior to and following performance testing to comply with stationary source testing requirements. Performance Work Statement (PWS) Sections 1.2 and 6 below provide more detail regarding the work and location(s) specific to this requirement.
1.0.3 Government / Contractor Relationship
a) The services to be delivered under this Contract are non-personal services and the parties recognize and agree that no employer-employee relationship exists or will exist under the
Contract between the Government and the Contractor's personnel. Therefore, it is in the best interest of the Government to provide both parties a full understanding of their respective obligations.
b) The Contractor employees shall identify themselves as Contractor personnel by introducing themselves or being introduced as Contractor personnel and displaying distinguishable badges or other visible identification for meetings with Government personnel. In addition, Contractor personnel shall appropriately identify themselves as Contractor employees in telephone conversations and in formal and informal written correspondence.
c) Contractor personnel under this Contract shall not engage in any of the inherently governmental functions listed at FAR Subpart 7.5 or DFARS Subpart 207.5.
d) Employee Relationship:
1) The services to be performed under this Contract do not require the Contractor or its personnel to exercise personal judgment and discretion on behalf of the Government. Rather the
Contractor's personnel will act and exercise personal judgment and discretion on behalf of the
Contractor.
2) Rules, regulations, directives, and requirements that are issued by the U.S. Navy and
NSWCPD under its responsibility for good order, administration, and security are applicable to all personnel who enter a Government installation or who travel on Government transportation.
This is not to be construed or interpreted to establish any degree of Government control that is inconsistent with a non-personal services contract.
e) Inapplicability of Employee Benefits: This Contract does not create an employer-employee relationship. Accordingly, entitlements and benefits applicable to such relationships do not apply.
f) Notice. It is the Contractor's, as well as the Government's, responsibility to monitor Contract activities and notify the Contracting Officer if the Contractor believes that the intent of this
Section has been or may be violated.
1) The Contractor shall notify the Contracting Officer (KO) in writing via letter or email within three (3) calendar days from the date of any incident that the Contractor considers to constitute a violation of this Section. The notice should include the date, nature, and circumstances of the conduct; the name, function, and activity of each Government employee or Contractor official or employee involved or knowledgeable about such conduct; identify any documents or substance of any oral communication involved in the conduct; and the Contractor's estimated date when, absent a response, cost, schedule or performance will be impacted.
2) The Contracting Officer will, within five (5) calendar days after receipt of notice, respond to the notice in writing. In responding, the Contracting Officer will either:
(i) Confirm the conduct is in violation and when necessary direct the mode of further performance,
(ii) Countermand any communication regarded as a violation,
(iii) Deny that the conduct constitutes a violation and when necessary direct the mode of further performance, or
(iv) In the event the notice is inadequate to make a decision, advise the Contractor what additional information is required, and establish the date by which it should be furnished by the
1.1 BACKGROUND
The Infrastructure Division (Code 102) of NSWCPD provides Infrastructure Management
Services for all NSWCPD facilities and infrastructure ranging from office and light-laboratory space to industrial and high-bay space, and including facility-related low-to-medium voltage utilities. Services include design and engineering, facility planning, space management, sustainment, repair, maintenance, and construction project management and associated
Environmental and Safety and Health Services for all NSWCPD RDT&E facilities.
1.2 SCOPE OF WORK
1.2.1 NSWCPD employs various emission sources including boilers, diesel engines, and gas turbines to complete its mission. The NSWCPD facility is classified as a major source under
Title V. NSWCPD also operates under a Plant-wide Applicability Limit (PAL) for Nitrogen
Oxides (NOx) and Sulfur Dioxide (SO2). The Title V permit requires that gas turbines be stack tested during the term of the permit to establish accurate emission rates for monitoring and reporting of Nitrogen Oxides. Sources CU-M161, CU-M162 are two of three units subject to the
DDX Test Cell permit conditions. The conditions require that the three installed sources cannot exceed a combined maximum short-term emission rate for each pollutant. Individual source emissions are not permitted separately. The combined short-term emission limit to be verified during testing for the two subject units is 514.60 lbs/hr of Nitrogen Oxides.
1.2.2 The objective of this contract is to conduct performance source testing for two oil-fired combustion turbines (also described as “GTGs” herein) to develop emission factors to demonstrate compliance with the NOx emission limits of the City of Philadelphia Air
Management Services (AMS) installation permits and Naval Surface Warfare Center –
Philadelphia Division’s (NSWCPD’s) Title V permit. The Contractor shall provide all labor, material, tools, submittals, equipment, supplies, testing, and supervision to complete all work described in this Performance Work Statement for emission source testing of two oil-fired combustion turbines located in Bldg 77H at the Philadelphia Naval Business Center. The two sources to be tested are:
(1) Source ID CU-M161, Rolls Royce MT5S-HE+1H, 53.2 MMBTU/hr
(2) Source ID CU-M162, Rolls Royce MT5S-HE+3H, 53.2 MMBTU/hr
1.2.3 Testing and sampling shall be performed in accordance with applicable references in PWS
Section 2.0. The emissions testing company shall have a quality system that meets ASTM
D7036-16 OR ANSI/ASCQ E4. Submittals in preparation of performance testing and reporting results of performance testing shall conform to the requirements detailed in PWS Sections 4 and
13. Emissions testing shall be completed no later than 31 March 2021.
1.2.4 Performance tests, calibration, leak checks, and sampling shall be completed in accordance with PADEP STM. Performance test shall be performed on each of the two GTGs. Access ports are located on the stack(s) above the roof located as shown in Attachment 1. Access ports are located between 4 to 5 feet above the roof surface and are one- (1-) inch-diameter schedule 40 steel pipes with bolted flanged cover plates. Further details regarding location are provided in
PWS Section 6.
1.2.5 Fuel samples will be collected and provided by NSWCPD to the Contractor, and the
Contractor shall transport samples and have them analyzed by a laboratory that complies with the requirements of ISO/IEC 17025:2017. The Contractor shall be responsible for transportation of fuel samples to the laboratory premises.

The Contractor will be required to submit a Letter of
Badge Request on company letterhead to the TPOC including the contract name, contract number, contract duration, building/location of work, TPOC contact information, NSWCPD point-of-contact information, and the names and personal information for each contractor employee or representative (DOB, SSN, place of birth, citizenship status) to the TPOC for
Security review and approval. A Letter of Badge Request is required to be submitted whenever expiring badges are needed to be renewed for continued work on the contract, containing the same information included in the initial request.
For Contractor employees or representatives that do not have a CONFIDENTIAL or higher security clearance, the Contractor shall provide a completed SECNAV 5512/1 (DoN Local
Population ID Card/Base Access Registration Form) for each employee or representative to the
TPOC for CNRMA (Command Navy Region Mid-Atlantic) vetting, review and approval. Forms for each employee shall be provided within 14 calendar days after the contract award. Complete forms using the instructions on page 3 of the PDF. SECNAV 5512/1 forms are available for download at:
