SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
PROPOSAL REQUIREMENTS
PART A - GENERAL INSTRUCTIONS
1.0 GENERAL
Award will be made to the Lowest Priced Technically Acceptable (LPTA) offeror. A partial/incomplete proposal will be considered unacceptable and will not be evaluated.
Offerors are required to submit sufficient information concerning the following areas to enable Government personnel to fully ascertain capabilities of the offeror to perform the requirements. The proposal must be sufficient in detail and scope to permit evaluation and provide the evaluators a clear understanding of the offeror’s approach, expertise, experience and capability as required by the solicitation.
All proposals must clearly and convincingly demonstrate that the offeror has a thorough understanding of the requirements, associated risks and is able, willing and competent to devote the resources necessary to meet the requirements and has valid and practical solutions for all requirements and potential risk areas.
With the exception of the Price volume, no pricing information should appear in any other volume. Alternate proposals are not acceptable.
In presenting material in the proposal, the offeror is advised that quality of information is more important than quantity. Clarity, brevity, and logical organization should be emphasized during proposal preparation. It is the responsibility of the offeror to present enough information to allow the proposal as well as price, to be meaningfully evaluated without discussions.
For the purpose of this acquisition, relevance is defined as something that has a logical connection with the matter under consideration. Such aspects or relevance include the type of effort (e.g. development, production, repair), the type of requirements (e.g. weapon systems, information systems, engineering services, scheduled depot maintenance), service similarity, service complexity, contract type, contract dollar value, the division of the company that will perform the work, and participation of Principal Subcontractors, Team Members, or Critical Team Members.
The offeror must include any data necessary to illustrate the adequacy of the various assumptions, approaches, and solutions to problems. Failure to clearly and positively address specific information within the volumes below may be considered a deficiency. There is no need to repeat information in more than one volume if an overlap exists; the detailed information must be included in the most logical place and summarized and referenced in other areas.
Unnecessarily elaborate brochures or other presentation materials beyond that sufficient to present a complete and effective proposal is neither necessary nor desired.
Offerors are expected to comply with all requirements of the RFP. The Government advises offerors that taking exception or deviating from any term or condition of the RFP may make an offer unacceptable, and the offeror ineligible for award, unless the RFP expressly authorizes such an exception or deviation with regard to that specific term or condition. The Government may consider any exception or deviation to any term or condition of the RFP that is not expressly authorized by the RFP to be a deficiency, as defined in FAR 15.001.
Throughout these instructions, Principal Subcontractors are defined as a subcontractor who provides at least 10% of the proposed total price (excluding the offeror’s profit/fee), for the contract. Team Members are the entities that make up a joint venture or any other partnership or teaming arrangement that is formed for the purpose of responding to this solicitation. Critical team members are entities of the offeror that perform a critical function in the performance of the resulting contract, whether it is technical or financial, and/or have important roles in any high or medium risk areas identified in the offeror’s proposal.
All items must be TAA compliant (Trade Agreement Act).
2.0 PROPOSAL FORMAT
Written proposals must be formatted using a Times New Roman 12 pt normal font (no reduction permitted), single-spaced with 1-inch margins all around, and formatted for standard 8.5 x 11 inch paper. All pages should be numbered with section and page numbers. When foldout pages are used they must not exceed 11 x 17 inches and will be counted as 1 page. Drawings may be provided separately and may be any size but should be folded to approximately 8.5 x 11 inch standard size and will count as 1 page. Graphs shall be presented in no smaller than a 10 pt font and should contain a grid, which allows values to be read directly from the graph to the same accuracy that a 10 x 10 to the ½ inch grid provides. Graphic resolution should be consistent with the purpose of the data presented.
The offeror will provide one complete copy of the written proposal to the PCO as electronic files fully compatible with Microsoft Office.
3.0 PROPOSAL CONTENT AND VOLUMES
Each volume of the proposal shall be submitted as one original and additional copies as specified in the table below.
Submission of all volumes of the Original proposal to the address provided in section 4.0 will determines timeliness of receipt. Page limitations for each volume if any, are also specified in the table below as follows (title and table of contents pages do not count towards page limit). Proposal pages beyond a specified maximum limit, if any, will not be reviewed as part of the evaluation.
Volume Number Volume Title Written Page Limit Copies Required 1 Technical 75 (not including sample manuals) 1 Original 2 Past Performance 15 1 Original 3 Price ** 1 Original
** The contractor shall ensure that all certifications and representations required within Section K of the solicitation have been accurately completed.
Each volume must contain the following information: Cover and title page; Title of proposal and proposal number as applicable; Offeror’s name, address, POC, and Cage Code; RFP number; Proposal volume/book number; Table of Contents (The table of contents must provide sufficient detail to enable easy location of important elements).
4.0 PROPOSAL SUBMISSION
Clearly mark all packages with the solicitation number. The submission date for all Volumes shall be no later than the date and time specified in Block 9 of Standard Form (SF) 33 of the RFP.
Proposals shall be submitted via email to Kimhoang Chu at kim.t.chu@navy.mil and Desiree DeRuyter at desiree.deruyter@navy.mil no later than the date and time specified in Block 9 of the SF 33.

PART B - SPECIFIC INSTRUCTIONS
1.0 VOLUME 1 - TECHNICAL
Note: This volume shall not contain any reference to price aspects of the offer.
The offeror shall provide all information and data required to conduct a thorough and complete technical evaluation.
The offeror shall address the following in the proposal:
Technical description should include overall dimensions, weight, power required, power usage, salient characteristics, major component identification, material used in construction, and a sample of the proposed equipment technical manual/data sheets. NAVSEA and NAVAIR require Ruggedized Portable Low and High Temperature Calibrators (PLTC and PHTC) that are capable of generating and controlling stable and accurate temperatures at the accuracy and ranges specified in Section B, Section C and the attachments. Additional details required:
a. Indicate the equipment to be provided on this solicitation (instruments, sensors, cables, kits, software, manuals, warranties, adapters, etc.). Describe the capability of the proposed equipment (e.g., range, accuracy, resolution, integration, etc.) and its current ability to meet each of the technical specifications listed in Section B, Section C and attachments.
b. Provide a cross reference matrix (CRM) which details each individual specification listed within Section B, Section C and the attachments. A sample copy of a CRM is provided as Attachment 5.
c. For any specification that is not met by a current commercial item provide support detail for needed changes (hardware, software, type of changes required, time required to implement changes) for full compliance with each specification as listed in Section B, Section C and attachments. Indicate specifically what changes/enhancements will be required to bring that item into compliance. Provide enough detail to allow a complexity assessment as to the type of change that might be required (e.g. hardware, software, firmware, addition of components).
d. If a commercial item is not available, describe how the offeror will develop a unit that meets the specifications listed in Sections B, C, and attachments.
e. Manufacturing/Assembly. Provide technical literature, data sheets, drawings and system component and kit component diagrams. Elaborate on and discuss manufacturing processes, technical certifications, product lead-time, calibration/certificate of conformance and specialized equipment used to assemble, test and calibrate.
2.0 VOLUME 2: PAST PERFORMANCE
Offerors shall submit the following information as part of their proposal for both the offeror and proposed subcontractors.
Offerors shall provide at least three (3) Past Performance References with their proposal. Offeror shall identify three
(3) most recently completed or current contracts (not to have exceeded 5 years since completion) for similar equipment. The contracts identified should be of similar scope and complexity to this solicitation. The identified contracts can be with Federal, State, local, or commercial contracts. For each contract, the Offeror shall identify the customer Points of Contact (POC). The Offeror shall provide the current address, phone number, FAX number, and email address for each POC. Offerors that are newly formed without prior contracts should list contracts and subcontracts as required above for all personnel with significant roles in contract performance.
The Government reserves the right to limit or expand the number of references it decides to contact and to contact other references than those provided by the Offeror.
Failure to submit the past performance data, with the proposal, shall be considered certification (by signature on the proposal) that the contractor has no past performance for similar items. In conducting this assessment, the Government reserves the right to use both data provided by the offeror, including contacting any Points of Contact listed, and data obtained from other sources from sources other than those identified by the offeror, such as the Navy’s Contractor Performance Assessment Reporting systems (CPARS). Since the Government may not necessarily interview all sources provided by the offeror, it is incumbent upon the offeror to explain the relevance of the data provided. The burden of providing thorough and complete pas performance information remains with the offeror. If the offer is aware of any situation that may negatively impact the offeror’s past performance ratings, please discuss the situation and how it was remedied.
3.0 VOLUME 3 - PRICE PROPOSAL
NOTE: If a proposal has been determined acceptable under each of the non-price factors listed above, the Government will evaluate each proposal on a lowest price basis. The Government may award a contract on the basis of initial offers received, without discussions. Therefore, each initial offer should contain the offeror’s best terms from a price and technical standpoint. However, if considered necessary by the Contracting Officer, discussions will be conducted with only those offerors determined necessary to ensure efficient competition.
The offeror shall provide separate price information containing total pricing for each priced line item as designated in the CLIN of the solicitation. Offerors shall also provide a basis of pricing within this volume. The offeror shall also provide a price breakdown which includes the price for each Contract Data Requirements List (CDRLs) associated with this solicitation.
In accordance with FAR19.704 and as part of Volume 3, Large Business Concern offerors must submit a Subcontracting Plan demonstrating that at least twenty percent (20%) of the proposed total potential price is to represent contract awards to Small Business Concerns.
The subcontracting plans shall describe the extent to which the Offeror's company has identified and committed to provide for participation and provide sufficient information to demonstrate that the tasks assigned the selected by Small Business Concerns, Small Disadvantaged Business Concerns, Women-Owned Small Business Concerns, HubZone Small Business Concerns, Veteran-Owned Small Business Concerns, and Service-Disabled Veteran- Owned Small Business Concerns in the performance of the requirements. Offerors shall provide sufficient information to demonstrate that the tasks assigned the selected Small Business subcontractors are meaningful in the overall success of the program and also broaden the subcontractor's technical capability. Of special interest is the amount and type of work to be performed by the subcontractor(s). The Offeror shall explain the reasons for and advantages of selecting particular subcontractors.
Please be advised that the North American Industry Classification (NAICS) code applicable to the requirements contained within this solicitation is 334515. Therefore, companies proposing as a subcontractor under this solicitation as a small business concern must have a size standard of less than 500 employees.
As a consideration for award, the small business subcontracting plan proposed by prime offerors will be reviewed by the Government to ensure it satisfactorily addresses the above stated requirements. Offerors who are unable to reach the specific subcontracting goal may provide a rationale explaining why said goal cannot be met.
(End of Summary of Changes)
The following items are applicable to this modification:
QUESTIONS AND ANSWERS
Q1: Please clarify the RFP’s provisions concerning rights in technical data and computer software as they appear to be inconsistent. The RFP includes both FAR 52.227-14, Rights in Data—General, which is normally reserved for use in civilian agency contracts, and DFARS 252.227-7013, Rights in Technical Data—Noncommercial Items, a DoD clause. These clauses are inconsistent in that they apply different data rights allocation schemes. Please clarify whether both of these clauses were intended to be included in the RFP. If not, please explain why both clauses are included and which data will be subject to FAR 52.227-14 and which data will be subject to DFARS 52.227-7013.
A1: The clause intended to be included in the RFP is DFARS 252.227-7013. FAR 52.227-14 is removed.
Q2: Given that the Statement of Work acknowledges that the delivered calibrators will “be modified COTS units,” will the agency consider allowing vendors to propose, where appropriate, commercial items and commercial license terms or other license terms permitted by the FAR and DFARS (e.g., FAR 52.227-19, DFARS 252.227-7015)?
A2: Yes, as long as they meet the requirements in this solicitation.
Q3: Attachment 3 paragraph 3.77 and Attachment 4 paragraph 3.76 both require “computer based training material” as a deliverable. Can you please identify the CLIN or CDRL which specifically has the requirements including delivery information for this subject matter.
A3: In reference to attachment 3 paragraph 3.77 and attachment 4 paragraph 3.76, please refer to CDRL A006.
Q4: CDRL A006 is Titled “Course Conduct Information Package”, Subtitled “Failure/Repair Action Status Report”. This CDRL authority document in Block 4 is DI-ALSS-8522A is titled Course Conduct Information Package. Block 16 defines remarks that are consistent with the SubTitle but not the Authority document. Note that CDRL A008 Subtitle is Failure Repair Corrective Action Report. Please advise the deliverable for A006.
A4: CDRL A006, Block 3 has been updated to reflect the correct sub title "Interactive Training CD". Block 16 has been revised to reflect remarks consistent with the new sub title and authority document.
