JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN
COMPETITION
FOR ONLY ONE RESPONSIBLE SOURCE
SOLICITATION WORK ORDER NUMBER (WON) 1581218,
FY 18 PAF 160600
APR Bulk Fuel Storage Tanks
RAAF Base Darwin, Australia
1. Contracting Activity.
Department of the Navy, Naval Facilities Engineering Command, Pacific, Architect-Engineer
Contracts Branch, Joint Base Pearl Harbor Hickam, Hawaii.
2. Nature/description of action.
Request approval to include proprietary specifications for a brand name item from only one responsible source, in Solicitation Work Order Number 1581218, Fiscal Year 2018 military construction project PAF 160600, APR Bulk Fuel Storage Tanks, RAAF Base Darwin, Australia:
Two (2) ENRAF Servo Gauge Model 854 Automatic Tank Gauge
3. Description of supplies/services.
a. Fiscal Year 2018 PAF 160600, Asia Pacific Resiliency (APR) Bulk Fuel Storage Tanks, Royal Australian Air Force (RAAF) Base Darwin, Australia will construct Petroleum, Oil, and Lubricant (POL) infrastructure needed to support bilateral military exercises at
RAAF Base Darwin. Supporting infrastructure includes a petroleum operations facility with a fuels laboratory, a filter building required for aviation fuel, two pump houses, and fill stands for loading and unloading fuel.
b. As part of the project, two (2) ENRAF Model 854 ATGs will be installed to monitor the usable liquid level storage capacity of new fuel tanks being constructed at fuel farm 8.
The estimated cost of construction is of which will be for the procurement of the ATGs at a cost of approximately per ATG.
c. Fiscal year 2018 military construction funds will be used to fund the aforementioned supplies. The period of performance is approximately 1,095 days.
4. Statutory Authority Permitting Other Than Full and Open Competition:
10 U.S.C. 2304(c}(1). FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Utilizing the ENRAF ATG meets the agency’s minimum needs by satisfying UFGS Section
33 52 43.11, Aviation Fuel Mechanical Equipment, requirements. The UFGS section states, “ATG shall be the mechanically or electronically actuated type that can continuously monitor a tank's usable liquid level storage capacity. The system shall provide a digital readout of a tank's liquid level in terms of mm and liters. The system shall be accurate to plus or minus 2
mm. The system shall measure water accumulation in mm from 20 to 125 mm off the bottom of a storage tank. The ENRAF ATG meets the aforementioned specifications and is also the standard system required by the Defense Logistics Agency (DLA) Centrally
Managed Program for automatic tank gauging.
In August 2015, DLA issued a memorandum establishing Department of Defense ATG system criteria for large fuel tanks which are defined as tanks with a capacity greater than
30,000 gallons. DLA’s ATG installation policy requires that tanks meeting the criterion of large fuel tanks be fitted with ENRAF servo gauges. Each new tank installed at fuel farm 8 will be constructed to a storage capacity of 8 million liters, or approximately 2.11 million gallons. The two new tanks at fuel farm 8 will significantly exceed DLA’s established criterion for large fuel tanks; therefore, the new tanks at fuel farm 8 must be fitted with
ENRAF ATGs to meet the agency’s minimum needs.
Based on recent market research, no information was obtained indicating that there is a reasonable basis to conclude that other responsible sources meet the agency’s minimum needs.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
In accordance with DFARS 206.302-1, an announcement was published on March 7, 2019, to the Federal Business Opportunities (FBO) website seeking any and all sources that can provide for tank gauges that have the same requirements as the ENRAF ATGs. No responses were received in relation to these announcements, therefore, there are no other known manufacturers of ATGs that can meet the Government’s requirements. The announcement did not include a statement indicating that the proposed contract action is for supplies or services for which the Government intends to solicit and negotiate with only one source under the authority of FAR 6.302 because the contract action is for construction services for which the Government intends to provide for full and open competition.
7. Determination of fair and reasonable cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable.
8. Actions taken to remove barriers to competition.
This is a one-time procurement. Although the utilization of a brand name is indicated by this
J&A, each future project that includes a ENRAF Servo Gauge will be evaluated to ensure no other manufacturer’s product meets the same performance characteristics and project requirements. Should any other offers for gauges be submitted during the source selection process, the Government will consider each as applicable.
