About this file

This document is an addendum to FAR clause 52.212-2 establishing evaluation criteria and award procedures for a commercial products and services procurement.

The Government will award a single firm-fixed-price contract to the responsible quoter offering the best value using a tradeoff source selection process. Award will be made without discussions unless the Contracting Officer determines discussions necessary; therefore, quoters must submit their most favorable terms in their initial submission. Technical capability and past performance combined are weighted equal to price in the evaluation. Technical Capability (Factor 1) will be evaluated on an "acceptable" or "unacceptable" basis, with acceptability requiring clear demonstration of ability to meet all Statement of Work requirements; any failure to meet SOW requirements results in an unacceptable rating. Price (Factor 2) will be evaluated for fairness and reasonableness through price analysis comparing proposed prices across responses, but proposals will not be ranked by price and no adjectival rating will be assigned. A written notice of award mailed to the successful offeror within the specified acceptance time creates a binding contract without further action required from either party. The Government may accept an offer before its expiration time unless a written notice of withdrawal is received prior to award.

Addendum to 52.212-2 Evaluation—Commercial Products and Commercial Services (NOV 2021)

(a) General Instructions: The Government intends to award a single firm-fixed-price contract to the responsible quoter whose quote represents the best value after evaluation in accordance with the factors in the solicitation by utilizing the tradeoff source selection process.

The Government intends to award a contract without discussions with quoters. Accordingly, each quoter should submit its most favorable terms from a price and non-price standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary.

Technical and past performance, when combined, are equal to price.

(b) Evaluation Factors: The evaluation factors are (1) Technical Capability and (2) Price

Factor 1: Technical Capability

The Government will evaluate each offeror's technical proposal on an "acceptable" or "unacceptable" basis. To be rated "acceptable," the proposal must demonstrate a clear ability to meet all requirements specified in the Statement of Work. An offer will be rated "unacceptable" if it fails to meet any of the SOW requirements.

Factor 2: Price

The Government will evaluate the proposed total price for fairness and reasonableness. The price evaluation will not be assigned an adjectival rating. Reasonableness may be determined by comparing the proposed prices received in response to the solicitation and other methods. A price analysis will be performed, but proposals will not be ranked based on price.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
