FOR

RFP NO. NO. N62478-19-R-4038

8(A) DESIGN-BUILD/DESIGN-BID-BUILD MULTIPLE AWARD CONSTRUCTION CONTRACT (MACC),

VARIOUS LOCATIONS, STATE OF HAWAII

Q1. Since we didn’t see the other electrical panel at the site visit, would you be able to provide pictures?

A1. See Amendment No. 0002.

Q2. Is the entire Factor 2 section (inclusive of the EMR rates, DART rates, TRC rates, and the safety narrative) limited to two single-sided pages? It appears as though the 2-page limit only applies to the “Technical Approach for Safety” narrative and that there is no page limitation for the safety metrics.

A2. The two page limitation for Factor 2 – Safety is referring to the Technical Approach for Safety. Please comply with Document 00110, Paragraph 2.2.b.2., Factor 2 – Safety.

Q3. With regard to the Seed Project, the documents indicate that the government will relocate the containers in the northwest corner of the site. Will the containers be taken completely off-site or will we be required to work in phases around the site to accommodate container moves?

A3. Containers will be removed completely out of the limits of work.

Q4. The Geotech Report in Section 7.3.4 recommends “A subdrain system should be installed to collect surface water that accumulates in the UPB below the AC and concrete pavement sections…” Drawing C-103 appears to show drainage by sheet flow east to west. The south entrance drains to the sidewalk culvert. The center of the asphaltic concrete parking drains again to east to west but doesn’t appear to have anywhere to

go. The remainder of the area is concrete pavement with sheet flow to the east corner of the site draining 39,000 SF. According to the Geo-tech Report percolation is almost non-existent and would flow to the Kamehameha Highway. The plans and specs so not include any sub-drainage. Please confirm that no sub-drainage is required.

A4. The center of the ac parking lot is intended to drain to the curb along the sidewalk fronting the building and be directed to the grassed area and the concrete pavement area where it will flow toward Kamehameha highway, consistent with the direction of the flow in existing conditions. We will not be including subdrains.

Q5. Non-Price Evaluation Factors Section 00110 Construction Experience:

Submit a maximum of five (5) relevant construction projects in which the Offeror was the Prime Contractor that best demonstrates the Offeror’s experience on relevant projects that are similar in size, scope, and complexity to the Request for Proposal (RFP). Out of the maximum of five (5) construction projects, at least two (2) projects shall be new construction and one (1) project shall be repair/alteration or related demolition of existing infrastructure. For purposes of this evaluation, a relevant project is defined as new construction and/or repair, alteration and related demolition of existing infrastructure completed within the past five years of the issue date for this RFP. Infrastructure is defined as: 1) residential building construction; 2) construction for industrial buildings and warehouses; 3) nonresidential buildings, other than industrial buildings and warehouses; or 4) improvements such as utilities, landscaping, airfields and roadways. “New Construction” is defined as construction that provides for new or expanded facilities or infrastructure. New construction does not include repair and/or modernization of an existing facility nor does it include replacement or upgrade to an existing infrastructure. The Offeror must have been a Prime Contractor for the relevant projects and each relevant project shall be $1,000,000 or more in dollar value and be completed within the past five (5) years of the date of issuance of this RFP.

Proposals that do not contain any projects that demonstrate experience for the Offeror or its DOR will not be considered.

Non-Price Evaluation Factors Section 00110 Past Performance:

Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably in past performance and will receive a NEUTRAL Confidence rating.

Question: The Corporate Experience evaluation factor does not contain the same statement regarding offerors who lack relevant past performance, which states that they will not be evaluated favorably or unfavorably. Does this statement apply to both evaluation factors, i.e. will a new 8(a) who has managers with relevant construction experience but no contracts to reference be considered eligible for selection?

A5. Document 00110, Evaluation Factors for Award, Part II – Evaluation Criteria, Paragraph 2.2.b.3.(b)(3), “Offerors lacking relevant past performance history will not be evaluated favorably or unfavorably in past performance and will receive a NEUTRAL Confidence rating” applies to past performance only.

Q6. We are requesting the addition to your Solicitation for Design Build Construction Services Number:

N6247819R4038 FAR clause 52.208-9 which adds the Mandatory purchase requirements for AbilityOne products.

A6. FAR clause 52.208-9 will not be added to Request for Proposal N62478-19-R-4038.

Q7. Will a teaming agreement that does not involve a Mentor-Protégé arrangement or the formation of a separate legal entity, be recognized and qualify under the provisions of Section 00100, 1.5.a of the solicitation?

A7. Yes. See Document 00100, Paragraph 1.5.

Q8. Please indicate whether the past performance of each participant in a teaming agreement will be considered and evaluated equally?

A8. Yes.

Q9. G-002, Utility Notes: 1. states, ”…Existing utilities whether shown or not, which have been damaged as a result of the construction work, shall be restored immediately to its original or better condition at the contractors expense.” Will the Government please provide estimated quantity for bidding purposes of the existing utilities not shown to standardize all bidders’ proposals, or will any unforeseen utilities damaged be governed by FAR 52.236-2?

A9. The plans show all known existing utilities in the project site based on our available records. It is not anticipated that any other utilities exist within the limits of work.

Q10. Has existing soil been tested for characterization report for the reuse/removal from federal property to

PVT? If so, will the government please provide? If not, is any contamination of soil to be governed by

FAR 52.236-2?

A10. Soil has not been tested for reuse/removal requirements and shall be tested by the Contractor as required by

PVT prior to disposal.

Q11. Will the government please indicate if a “Partnership Agreement” referred to in Section 00100, 1.5.a is the same thing as a Teaming Agreement if the team members are partners?

A11. Yes.

Q12. Must the original binder contain manual signatures on forms, or may offerors use electronic signatures?

A12. Offerors may use electronic signatures.

Q13. For narrative sections, 11-point font is extremely space limiting in allowing Offerors to highlight their best value experience and approaches to the Government. Would the Government kindly consider allowing Offerors to use 10-point font for the narratives as allowed in previous NAVFAC MACC proposals?

A13. Please follow the requirements in the solicitation.

Q14. May offerors use a smaller font for graphics and tables as long as the text is clear and legible?

A14. See answer to Question 13.

Q15. We strive to reduce the onus on our Government clients who need to complete the same PPQs repeatedly for proposals. Also, contracting representatives are reluctant to (or even discouraged from) completing PPQ forms if formal performance CPARS evaluations have been completed. Will Huntsville please consider allowing offerors to submit completed CPARS evaluations or previously completed/signed PPQs in lieu of new PPQ forms?

A15. Document 00110, Evaluation Factors for Award, Paragraph 2.2.b.3.(a)(1) states in part, “If a completed

Construction Contractor Appraisal Support System (CCASS)/Contractor Performance Assessment Report (CPAR) evaluation is available, it shall be submitted with the proposal for each relevant project included in Factor 1 for construction experience.” If you have PPQs utilizing the exact same form from other procurements, you may submit it.

Q16. Document 00110, Page 25 of 121, Paragraph (iv) Design Experience states, “there shall only be on designer of record”. Given that Hawaii has a small construction market with a finite number of A-E firms capable of performing designs commensurate with the level of complexity expected on the 8(a) MACC, there is the possibility that a Designer of Record (DOR) could be conflicted from performing design on a given task order. It would be preferable that Offerors may propose their Primary DOR, but also alternate DORs in case of a conflict. This is in the best interest of NAVFAC and taxpayers, so all awarded offerors can bid on ever task order. Additionally, this has been a NAVFAC precedent on previous Hawaii MACC solicitations.

a. Please confirm that Offerors may propose other A-E firms as Alternate DORs only in the event of a conflict, in addition to their Primary DOR.

b. Otherwise, can the Primary DOR have a teaming agreement/subcontract to another A/E firm and provide an organizational conflict of interest plan to get around the issue?

c. Or once an offeror is awarded a contract, would it be up to the KO’s discretion to allow us to use an A-E partner not included in our original proposal in the case of a conflict?

A16. Please comply with Document 00110, Paragraph 2.2.b.1. – Factor 1, Corporate Experience.

Q17. Factor 2 Safety states that safety narratives may be up to one (1) double-sided 8.5” x 11” pages or two (2) single-sided 8.5” x 11” pages in length. Please confirm our understanding that the two-page limit only applies to the Technical Approach for Safety narrative and that the EMR, DART, and TRC rates are excluded from that page count.

A17. See answer to Question 2.

Q18. Are there other pricing documents the Government requires beyond those listed in the Solicitation and Seed

Project Specifications (Pricing appears to be 1 LSUM)? Is this correct?

A18. See Document 00110, Evaluation Factors for Award, Paragraph 2.2.a.1.(a) for Solicitation Submittal Requirements for Price.

Q19. Would it benefit the Government to evaluate a completely itemized proposal with Labor, Materials, Subcontractors, etc. broken out by CSI Divisions?

A19. No.

Q43. In the RFP for the seed project it says our period of performance for the project is 115 calendar days from the NTP. In Section 01 57 19, 3.1.2.2 Notice of Intent for Construction Activities, it says the contractor shall submit the NOI Package for NPDES coverage (project over 1 acre) a minimum of 90 calendar days prior to the start of the permitted activity. In doing the math, it doesn’t look like its possible to get on the project before liquidated damages

A43. The Government is completing the NPDES and it will be in hand prior to the start of construction.

Section 01 57 19, paragraph 3.1.2.2 Notice of Intent for Construction Activities shall be amended to read, “The Government will obtain a Notice of Intent (NOI) for NPDES coverage under the State of Hawaii's NPDES general permit authorizing discharges of storm water associated with construction activity (HAR 11-55, Appendix C) in accordance with HAR 11-55 and State of Hawaii guidelines.

The permit will be obtained prior to the commencement of construction.” The Government, not the Contractor, shall prepare the submittal on the State's e-Permitting Portal.

Q44. Per specification testing requirements Section 01 57 19 Page 5, please clarify that the soil testing quantity requirements are correct. We estimate over 7,000 cubic yards of material will be removed from this site, which would require 112 days of sampling from our sub-contractor to complete. The total project duration is listed at 115 days.

A44. Section 01 57 19, paragraph 1.2.9.6, third paragraph is revised to read, “The following JBPHH excess soil testing requirements area applicable for material to be disposed of at a permitted landfill: TCLP 8 Metals at 1 sample per 400 cubic yards of surplus soil and PCBs (Total Aroclor) at 1 sample per 400 cubic yards of surplus soil.”

File details come from the government source that posted it. Updated .
