AMENDMENT 0002
AMENDMENT 0002 DATED 16 JUNE 2020
Contract: N62473-20-R-0022 CS/Phone/Email: Raymond Gloria / 619-532-2564 / Raymond.P.Gloria@navy.mil RFP Issue Date: 21 May 2020 Subject : P-1231 DESIGN-BUILD WASTEWATER TREATMENT PLANT AT
MARINE CORPS AIR GROUND COMBAT CENTER (MCAGCC)
TWENTYNINE PALMS, CALIFORNIA
The purpose of this Amendment is for the following.
1. Provide the following responses to Request For Information (RFIs)
RFI 7: Page 28 of the RFP, Factor 2 – Experience, (1) and (2) demonstration of specific construction/ design experience.
The specific experience for “Plant producing California Title 22 disinfected tertiary recycled water” is overly restrictive, as projects built/designed in other states that have equally stringent requirements will not receive the “more favorable” rating by this requirement. Can “or equal” be added as to not negatively affect otherwise qualified projects.
Answer 7: No, “”or equal” will not be added to the language. The Government is seeking specific experience with “Plant producing California Title 22 disinfected tertiary recycled water”. Therefore, Factor 2
– Experience, (1) and (2) demonstration of specific construction/ design experience remains unchanged.
RFI 8: Page 28 of the RFP, Factor 2 – Experience: For purposes of this evaluation, a relevant project is further defined as a wastewater treatment plant producing disinfected tertiary recycled water with a net recycled water capacity equal to or greater than 1.5 million gallons per day (MGD) that has been in successful operation for at least 2 years.
For a project to be relevant, it must be completed no later than 10 years from the initial RFP issuance date, how is the 2-year operational period calculated into this formula? Is it eight years plus 2 years operation or is it simply 10 years from the initial RFP issuance date?
Answer 8: For a project to be relevant, it must be completed no later than 10 years from the initial RFP issuance date (i.e. on or after May 21, 2010). If the project was completed 10 years from the initial RFP issuance date, then 2 years of successful operation must necessarily be included within that 10-year period.
RFI 9: As we consider our team for this solicitation, we need information regarding the plant operation requirements. Will certified plant operators be required to operate the plant during the base bid and CLIN 0005? If so, what certifications and from what state will be required? Understanding this requirement prior to the Phase One submission is important as we build teams to provide the Federal Government with the best value.
Answer 9: Certified Operators will be required to operate the plant during base bid and CLIN 0005. Any operator shall be at a minimum a California Certified Grade 3 Wastewater Treatment Operator, with at least one California Certified Grade 4 Wastewater Treatment Operator on the operational team as the lead. The Chief Plant Operator must be this grade level for the facility. Operation of the facility by a contractor should replicate what the Government is required to have on staff.
RFI 10: On page 79 of 110 in the RFP, the reference to plant operation in the base bid is in Option Item
0005: Operate Plant 3 Months. To assess the likelihood of successful completion within the amount of time proposed for performance of this contract, what activity will trigger the milestone start of the 3-month plant operation period?
Answer 10: The RFP defines the operational period as starting following successful completion of a 30-day performance verification period.
RFI 11: The Federal Government’s proposed Period of Performance seems unrealistic. The Government has also noted that the Period of Performance starts after award. Given time for bonds, preliminary submittal approvals, permitting, and design to take approximately one year, 30 months of construction and 3 months of operation, the minimum amount of time necessary to construct this facility from date of award is 1,350 calendar days, nearly twice as long as what is allowed. Would the Federal Government consider increasing the Period of Performance to 1,350 calendar days? At $6,472 per calendar day liquidated damages, the potential for late delivery and liquidated damage amounts exceed 5% of the potential contract value.
Answer 11: The period of performance is revised to 1200 calendar days after award.
RFI 12: On page 78 of 110 in the RFP, Paragraph 6, CONTRACT DURATION, OPTIONS, AND
PLANNED MODIFICATIONS, the Period of Performance is increased by 56 Calendar Days if one of the Options CLIN 1, 2, 3 or 4 is chosen. It is also noted that the Period of Performance is increased by 100 Calendar Days if Option CLIN 0005 is chosen. If one of Options CLIN 1, 2, 3, or 4 is chosen, AND Option CLIN 0005 is chosen, will the Period of Performance be increased by 156 calendar days?
Answer 12: Yes. If either Option CLIN 1, 2, 3, or 4 is exercised, AND Option ClIN 0005 is also exercised, the Period of Performance will be increased by 156 calendar days.
RFI 13: What is the significance of including CCL’s on the Option CLIN items? If the base bid is less than the corresponding CCL, and the Option CLIN items are over their corresponding CLIN values, are the options not awardable?
Answer 13: See DFARS 252.236-7006 (d).
CCLs are included to advise that offers may be rejected which—
(1) Are materially unbalanced for the purpose of bringing items within cost limitations; or
(2) Exceed the cost limitations, unless the limitations have been waived by the Government prior to award.
RFI 14: Would the Federal Government please consider postponing the submittal date for Phase One to give Offerors time to re-evaluate and potentially change teaming partners to best comply with the new standards of this RFP and allow time to create new teaming partnerships to provide the best value to the Government? In November, when the Federal Government sought Small Business participation for this procurement, the relevant project thresholds were a minimum of $30,000,000, with at least one relevant project of $55,000,000. Not only has the Federal Government lowered the size standard to $20,000,000 (arguably opening the solicitation up to additional competition, which could have allowed more Small Businesses to reply favorably to the Sources Sought leading this procurement to have been set-aside), but the detail scopes regarding more “favorable” construction/design experience impacted our choice of designers based on this new criteria. To provide the Federal Government with the best Design-Build team for this solicitation, more time is desirable to re-vet design partners. Had this solicitation matched more closely to the Sources Sought, the potential partners were significantly reduced due to the relevant project size standards.
Answer 14: Proposal due date remains unchanged.
RFI 15: Who is currently operating the existing treatment plant? Is it being contract-operated?
Answer 15: Government personnel are currently operating the existing treatment plant.
RFI 16: Page 6 states the following "No Assumptions: This is a firm fixed price contract, and any assumptions made by the offeror in its proposal will not be binding on the Government. The offeror will not be entitled to any equitable adjustments based on assumptions made by the offeror in its proposal." As a DB contractor working with NAVFAC, we have never seen this clause in an RFP. Can the Government please elaborate on the basis for this statement and what FAR clause justifies it?
Answer 16: DELETE “No Assumptions” paragraph and REPLACE with the following:
“ASSUMPTIONS/QUALIFIERS/CONDITIONS: The Government acknowledges that assumptions may be necessary in Design-Build projects. However, qualifiers/conditions made by the offeror in its proposal that deviate from the RFP requirements will not be binding on the Government. The offeror will not be entitled to any equitable adjustments based on qualifiers/conditions made by the offeror in its proposal, that deviate from the RFP requirements, and such proposal may be ineligible for award.
Any request for deviations from the RFP must be submitted in writing before the proposal due date as an RFI. Allowed deviations from the RFP will be made by the Government in the form of an official amendment. FAR 52.243-71 Equitable Adjustments with respect to the “Changes” clause prescribed by FAR 52.243-4, the “Changes and Changed Conditions” clause prescribed by FAR 52.243-5, the “Differing Site Conditions” clause prescribed by FAR 52.236-2, and any other provision of this contract allowing entitlement to an equitable adjustment, are not changed by the foregoing.”
RFI 17: Page 6 states the following "No Assumptions: This is a firm fixed price contract, and any assumptions made by the offeror in its proposal will not be binding on the Government. The offeror will not be entitled to any equitable adjustments based on assumptions made by the offeror in its proposal." Because this is design-build (DB) delivery (and not DBB) Offerors invited to Phase 2 will be provided a bridging document set of designs and specifications that are conceptual in nature and not 100% complete. Offerors are required to make assumptions based on the conceptual bridging documents provided by the Government to arrive at a FFP proposal. Offerors will make every effort to submit a responsible proposal, including asking RFIs to clarify any scope of work items, however, stating that Offerors will not be entitled to any equitable adjustments puts unduly risk on the DB Contractor. Is this the Government's intent?
Answer 17: The intent of the Government is to minimize the risk of receiving technical proposals that deviate from the minimum requirements of the RFP. While assumptions may be necessary in Design- Build projects, proposals that explicitly deviate from the RFP requirements will be deemed unacceptable.
For example, if a contractor makes assumptions as part of its proposal like: "We assume that no soil contamination is present on site since the project is CATEXed" or "We assume that we can work uninterrupted for the entire period of performance", those are fair and acceptable assumptions since the proposal does not deviate from the RFP requirements. However, if a contractor qualifies its proposal in such a way that deviates from the minimum requirements of the RFP like: " As part of our bid we will provide tilt-up concrete walls instead of the RFP required CMU construction in order to provide the best value to the government and stay in budget", that will be unacceptable since the proposal will not meet the RFP requirements.
Accordingly, any qualifiers/conditions made by the offeror in its proposal that deviate from the RFP requirements will not be binding on the Government. The offeror will not be entitled to any equitable adjustments based on qualifiers/conditions made by the offeror in its proposal, that deviate from the RFP requirements, and such proposal may be ineligible for award.
RFI 18: Page 6 states the following "No Assumptions: This is a firm fixed price contract, and any assumptions made by the offeror in its proposal will not be binding on the Government. The offeror will not be entitled to any equitable adjustments based on assumptions made by the offeror in its proposal." This statement seems to be in direct conflict with FAR 52.243-71 Equitable Adjustments with respect to “Changes” clause prescribed by FAR 52.243-4, the “Changes and Changed Conditions” clause prescribed by FAR 52.243-5, the “Differing Site Conditions” clause prescribed by FAR 52.236-2, and any other provision of this contract allowing entitlement to an equitable adjustment. Please clarify the Government's intent of this statement.
Answer 18: See response to RFI 17 above. In addition, please be advised that any request for deviations from the RFP must be submitted in writing before the proposal due date as an RFI. Allowed deviations from the RFP will be made by the Government in the form of an official amendment. FAR 52.243-71 Equitable Adjustments with respect to the “Changes” clause prescribed by FAR 52.243-4, the “Changes and Changed Conditions” clause prescribed by FAR 52.243-5, the “Differing Site Conditions” clause prescribed by FAR 52.236-2, and any other provision of this contract allowing entitlement to an equitable adjustment, are not changed by the foregoing.
RFI 19: On page 28 of 110 of the RFP in Factor 2 Construction Experience it states:
Submit a minimum of two (2) and a maximum of five (5) relevant construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the RFP.
For purposes of this evaluation, a relevant project is further defined as a wastewater treatment plant producing disinfected tertiary recycled water with a net recycled water capacity equal to or greater than 1.5 million gallons per day (MGD) that has been in successful operation for at least 2 years, with a construction cost of at least $20,000,000.
Would you consider reducing the $20,000,000 value? We have designed and built several wastewater facilities with capacity of 1.5 MGD with a capital cost of less than $20,000,000. Being able to utilize these project in our response will enable us to better provide a cross section of our experience. Please advise.
Answer 19: The requirement for a construction cost of at least $20,000,000 remains unchanged.
