Revised December 2010
All personnel responsible for developing, reviewing and approving a single source determination shall ensure that sound business judgment is applied in researching, documenting and approving such actions.
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
SINGLE SOURCE DETERMINATION FOR ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION
THRESHOLD AS DEFINED IN FAR 2.101
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER (within its warrant authority) DETERMINES THAT ONLY ONE SOURCE IS AVAILABLE IAW FAR 13.106-1(b). THIS DETERMINATION SHALL BE SUPPORTED WITH FULL JUSTIFICATION FOR SINGLE SOURCE FROM THE CUSTOMER. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:
QUOTE/SOLICITATION NUMBER: N62473-19-Q-0805
ESTIMATED AMOUNT (Not exceeding $250,000): Estimate Cost $25,000.00
DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: Emergency Sewage Clean-up, located at IMPBEA-193, Naval Outlying Field (NOLF), Naval Base Coronado (NBC), CA. The period of performance will be ten (10) calendar days from date of award.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: Due to the unusual and compelling urgency of this sewage spill, soliciting to other sources was not a viable option and failing to immediately respond would have created unacceptable health and safety risks and negatively impacted the mission. NRC Environmental Services, Inc. (NRCESI) was able to respond immediately and arrest the emergency within the required time frame. NRCESI was determined to be capable of providing the sewage clean-up services within the required time period while conforming to all federal, state, and local regulatory requirements. The unusual and compelling nature of this requirement does not allow for a competitive procurement as NRCESI was available immediately, has relevant experience, and is familiar with Navy processes and current industry standards.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: NRCESI has the experience and qualifications required to meet this urgent need, NRCESI has had previous contracts with other NAVFAC entities (N62473-08-A- 8805 and N62473-11-A-2210) and is familiar with Navy processes and current industry standards. Soliciting for and contracting with another contractor without previous relevant experience would result in unacceptable delays and create unacceptable safety risks due to unhealthy conditions).
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR IS NOT AVAILABLE: While an adequate scope of work exists, it was determined that the use of competition would result in unacceptable delays in completing the required scope of work. Due to the unusual and compelling emergency nature of this sewage clean-up requirement, any delay caused in order to solicit to multiple sources for this requirement would have created unacceptable health and safety risks. Because of the additional time that would be required to solicit to multiple sources, NRCESI is determined to be the only available source to accomplish this work within the required time frame and meet the agency’s requirements while conforming to all federal, state, and local regulatory requirements.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED: This is a one-time procurement. NAVFAC SW will evaluate any future procurement concerning sewage clean-up on a case by case basis and will make a determination at that time on the competitive nature of the procurement.
I certify that the statements above are complete and correct to the best of my knowledge.
