Questions & Answers

March 11, 2014

Question 1: If a contractor is able to show experience working with one Lead design firm for multiple projects but lists a second lead design firm and does not have any experience working together, would the second lead firm be considered a weakness or would it simply not gain a higher rating?

Answer: As stated in the RFP: “Relevant projects where the Offeror and the proposed design firm(s) have previously worked together may be considered more favorably than those that have not worked together.”

In this instance, an Offeror may not receive a weakness for not having experience working together with one of multiple design firms. However, it cannot be determined how you would be evaluated without seeing the Offeror’s actual proposal submission for that factor.

Question 2: It is stated in this solicitation that “this procurement is set-aside for 8(a) firms with a bona fide place of business with the respective jurisdictions of the SBA District Offices in California, Arizona, Nevada, Utah, Colorado and New Mexico.”

Does that mean one bona fide office in any of the states or bona fide offices in each of the states mentioned above?

Answer: There is no requirement to have a bona fide office in each state only one bona fide office is required, in one of the following states: California, Arizona, Nevada, Utah, Colorado or New Mexico. Please contact your SBA District Office for further information.

Question 3: If the Offeror does not have the construction experience as described but employees of the Offerors firm do have the experience, can the Offeror use employees of the firm’s past experience?

Answer: No.

Question 4: We wanted to clarify that a Construction Prime/Sub Team was able to submit past performance projects from both team partners (as long as they do not go over the limit of 5 projects).

We will have our Teaming Arrangement included in TAB 1.

Answer: No, construction subcontractor experience will not be considered. Projects must be submitted for the Offeror (see definition) in accordance with the RFP. Projects must be submitted for the Designer in accordance with the RFP.

Question 5: Will NAVFAC allow an electronic signature that is through the government-issued CAC card?

Answer: No. Signature must be an original on the copy designated as original.

To further clarify, as stated in the RFP: name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent’s authority, unless that evidence has been previously furnished to the issuing office.

Question 6: Section 00210 defines Relevant Experience as work that is same or similar in terms of size, scope and complexity. According to the Government’s response for Question 8 in the FAQs, projects that fall below the construction cost minimum will not be considered relevant.

With the task order size ranging from $500,000 to $4 million, please confirm that projects exceeding $4 million will not receive a weakness for size/construction cost.

Answer: Please see FACTOR 2: EXPERIENCE the requirement is to submit projects $500,000 or greater. Projects above $4,000,000 will be considered if they meet all of the RFP requirements for what will be considered a relevant project.

Question 7: From Exhibit "A": "If the experience of an entity is being claimed in Factor 2, that entity must be identified and described on this Exhibit."

This sentence seems to allow for a critical subcontractors performance to be considered relevant for consideration. We are a prime /sub team we strongly believe this approach will offer the best value for the Navy to identify a team with the best experience for successfully completing the work under the MACC Will that be allowed?

Answer: The project experience of an entity that is intended to function in a contractual relationship as a subcontractor to the prime contractor is not valid for this procurement and will not be considered. Project experience of a partnering entity in a valid joint venture arrangement will be considered, provided that all other requirements for valid project experience are met.

Question 8: Is it acceptable for the team to obtain professional licenses in states under the IDIQ, specifically California, following award but prior to tasks? Also, will NCARB be evaluated as the same as having professional licenses in hand?

Answer: Architects and engineers must be licensed in at least one of the U.S. states or its territories in order to perform as Designer of Record under this contract. Licensure in any specific state is not required except in cases where a particular state requires "specialized knowledge of local permitting or regulatory agency requirements", as described in the RFP, or when specifically required by the basic or task order contract (for example, the geotechnical engineer may be required to be locally licensed). Task order projects may occur in any state in the NAVFAC Southwest area of responsibility, as described in the RFP; however, the majority of the work will be performed in California. NCARB certification is not considered to be a state license. The Designer of Record shall be appropriately licensed in order to sign design documents that may be required by a task order under this contract, which will not occur until after the basic contract is awarded and a task order requiring design documents is issued.

Question 9: If more than one (1) design firm will be used for design is the number of Exhibit Bs

(Design Firm) limited to five (5)? Or can up to five (5) Exhibit Bs be submitted for each design firm?

Answer: Submit a maximum of five (5) projects to demonstrate design experience. For example, if you use one, two, three, or more designers, the maximum number of projects is still five (5), not five (5) for each design firm.

Question 10: For design build projects, the government agencies usually do not prepare ACASS evaluations. On our design build projects, is it acceptable to provide the project evaluation (CCASS) and then have the prime contractor provide a completed Past Performance Questionnaire for the A/E??

Answer: As stated in the RFP in Factor 3 Past Performance (a): If a completed Construction Contractor Appraisal Support System (CCASS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for construction experience. If a completed AE Contractor Appraisal Support System (ACASS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 2 for design experience. If one is not available, submit a Past Performance Questionnaire (PPQ) from a client for each project included in Factor 2 for both Construction Experience and Design Experience.

Question 11: FACTOR 3: PAST PERFORMANCE states: “Submit any other past performance information under Tab “3”. “

However, in the same section, it states, “Performance award or additional information submitted will not be considered.”

Are offerors permitted to include commendation letters and safety awards under Tab “3”?

Answer: No. However, as stated in the RFP in Factor 3 Past Performance (a): Offerors may provide any information on problems encountered and the corrective action taken on projects submitted under Factor 2 – Experience. Offerors may also address any adverse past performance issues. Explanations shall not exceed one (1) double-sided page (or two (2) single-sided pages) in total.
