QUESTION & ANSWER NUMBER THREE

Question 6.

Regarding “Offeror’s, Experience” which is to be documented in Exhibit-A. We have past experience on design-build construction projects that closely match the scope of work anticipated on future MACC projects but the magnitude of our past projects is outside the dollar value range set forth in the RFP. Will projects documented in Exhibit- A which do not match all of the criteria, be considered by the selection committee or will they be rejected and not considered?

Response to 6:

The projects will be evaluated according to the criteria stated in the evaluation factors.

The projects will be evaluated as to whether some or all of the criteria stated is fulfilled.

Question 7.

Regarding “Lead Design Firm Experience”, Exhibit-A. Does the construction portion of the project referenced for the Lead Design Firm have to be 80% or more complete for the designer to utilize the project as an example of their past performance or is it acceptable to submit a project that is 100% designed and less than 80% constructed?

Response to 7:

The design-build project must be substantially complete.

Question 8.

According to FAR 9.601 subcontractors can be considered a part of the contractor team arrangement; this definition is not changed or defined differently in the DFARS or NMCARS. Page 10 of the RFP includes a definition of “Offeror’s Team” that specifically excludes subcontractors from the team; this is more restrictive than the FAR definition. Will NAVFAC consider amending the RFP to conform to the definition of a team in FAR 9.601 and allow subcontractors to be part of the team? This would benefit the government by enabling offerors to provide the Government with the best combination of performance, cost, and capability for the required construction services.

Response to Question 8.

For this solicitation the "Team" we are evaluating for the experience and past performance is the Prime Contractor and A-E firm. The Prime contractor is responsible for the performance of any project under this contract as well as for all financial and bonding. A subcontractor would not be a legal and financial business partner for the contract.

Question 9.

Instruction to Offerors, Paragraph 4. Joint Venture Offerors indicates "The Joint Venture also needs to complete the online Representations and Certifications for each joint venture member as well as for the joint venture." Please clarify if the JV Reps & Certs need to be completed for Phase 1 or Phase 2 proposal. Is it acceptable for JV agreement to be included in Phase 1 with DUNS #, CCR, & ORCA completed if/when the JV moves on to Phase 2?

Response to Question 9.

For this RFP the JV agreement and all information in CCR, ORCA, etc., is required to be ready at the time of Phase 1 proposal submission. That information is evaluated as part of the criteria for being able to move on to Phase II.

Question 10.

If an Offeror is a new Joint Venture how does the JV complete Exhibit C (Small Business Past Performance), Exhibit F (Surety Form) and the Financial Questionnaire?

Response to Question 10.

If the Joint Venture firm is newly established and has not performed any projects -both firms are required to provide the information required for Exhibit C (Small Business Past Performance) and the Financial Questionnaire. The Surety Form is required to be state the newly established Joint Venture firm – not stating the individual firms that comprise the Joint Venture.

If the Joint Venture firm was previously established and has performed on projects the Small Business Past Performance and Financial Questionnaire are required to be submitted for the Joint Venture firm. The Surety Form is required to be state the established Joint Venture firm – not stating the individual firms that comprise the Joint Venture.
