SUMMARY OF CHANGES

SECTION SF 30 - BLOCK 14 CONTINUATION PAGE

The following have been added by full text:

AMEND. 0004

INQUIRIES 5-23

5) QUESTION: Due to the extensive preliminary design work and estimating efforts to be developed before being able to consult subcontractors, fabricators, component suppliers, mechanical and electrical contractors that must be involved in such of a project, we ask the bid closing date to be postponed to July30th in order to build a solid proposal. Also, limiting the questions to June 2nd is too restrictive to allow enough time for questions generated during the estimating period.

RESPONSE: Amendment 0003 extended the proposal due date to 7/31/19. The deadline for submitting pre-proposal inquiries is 10 days prior to proposal due date.

6) QUESTION: Will the Government provide a tax exemption certificate for the design, supply and installation of the portal cranes in each of the states where work is to be performed?

RESPONSE: In accordance with FAR 52.229-3(b), The contract price shall nclude all applicable Federal, State, and local taxes and duties.

7) QUESTION: Does the Government has minimum goal requirements for Small Business participation in this contract ? The Government sometimes require minimum percentages for WOSB, VOSV, SDVOSB, HubZone and Minority Small Businesses 8(a). We have not found any requirement in the documents. Please clarify.

RESPONSE: NAVFAC’s command-wide small business subcontracting targets are provided in Amendment 0004.

8) QUESTION: Can you add a note that states that Option Item 6 may be purchased at the same time or after Option Item 5 – but not before. A sequence for the crane award will assist in providing the most favorable pricing.

RESPONSE: See new schedule for options provided in Amendment 0004.

9) QUESTION: Through the governments pre-solicitation process and other means, we have stated that the minimum delivery required is 3 years. Please ensure that delivery dates are at least 3 years in accordance with industry input of qualified bidders.

Also, the delivery schedule does not make sense. The times stated could result in delivery of the 6 optional cranes prior to the delivery of crane 1. Worst yet, all cranes could be delivered on the same day. To account for this worst-case delivery scenario bidders will increase their prices on all cranes to accommodate the need for large increases in facility and labor costs. Please provide a realistic sequence for each crane award.

We recommend that “Options exercised up to 365 days from the base award will have a completion date of” 1,440 “calendar days from the time the option is exercised.”

{and} We recommend that “Options exercised after 365 days from the base award will have a contract completion date of” 1,080 “calendar days from the time the option is exercised” or 180 calendar days after the delivery date of the most recent purchased option (or base Item 1) - whichever is greater, in order to stagger the delivery day for each crane (and ensure that the options are delivered after the base award delivery date). Earlier delivery dates may be mutually agreed to by both parties at time of award of each option.

RESPONSE: See new delivery schedule provided in Amendment 0004.

10) QUESTION: An escalation clause needs to be added to the solicitation based on the delivery date of the cranes Pro Rata with respect to the date of the base bid crane award date.

RESPONSE: The government has decided not to use an economic price adjustment clause.

11) QUESTION: Will you consider a travel speed of 150 FPM (at rated load)?

RESPONSE: 150 FT/MIN is acceptable and will provided in Amendment 0004.

12) QUESTION: Is it acceptable for external cable trays to use hot dipped galvanized cable trays?

RESPONSE: Yes. The spec will be amended to allow hot dipped galvanized cable trays.

13) QUESTION: Is it the intention of the government to receive funding and purchase all Optional Items throughout the contract period (up to 2,555 calendar days)?

RESPONSE: See option schedule in Amendment 0004.

14) QUESTION: In accordance with DFAR 225.1101 (2)(i) Acquisition of Supplies, DFAR 252.225-7001 shall be used instead of FAR 52.225-1 and instead of other clauses. Please remove any references to FAR 52.225-1, 52.225-11(pg. 24) and 252.7021 (pg. 23) and 252.7036 (pg. 23)? These other clauses cannot apply when 252.225- 7001 is stated in accordance with 225.1101(2)(i). Multiple references create a situation where all conditions cannot be satisfied at the same time.

RESPONSE: FAR 52.225-1 is not included in the solicitation. The following clauses have been deleted in Amendment 0004: 52.225-11, 252.225-7021, and 252.225-7036.

15) QUESTION: Shall we expect significant technical changes? When will these changes be available?

RESPONSE: See Amendment 0004.

16) QUESTION: Has the Navy procured these precise requirements in the past? If so, were these cranes acquired on a firm fixed-price basis with multiple option years?

RESPONSE: The Navy has procured similar portal cranes in the past. Previous procurements have been firm-fixed price contracts. Some have included options and others have been Indefinite Delivery Requirements contracts.

17) QUESTION: Pursuant to FAR 17.204(e), the Government is precluded from extending the total of the basic and option quantities in excess of five (5) years. However, the total option period for this procurement, standing alone, is seven (7) years. Will the Navy consider shortening the seven (7)-year option period to comply with this requirement?

RESPONSE: In accordance with agency procedures, the Navy Crane Center has received approval for the term of the contract to exceed five years. The seven year duration will not be shortened.

18) QUESTION: Will the Navy reconsider its bundled approach to this procurement? In its current form, this acquisition restricts competition by limiting the procurement to those offerors that can support the simultaneous design, fabrication, transportation, and installation of cranes in locations across and outside the continental United States.

RESPONSE: Due to configuration control requirements, the Government has determined that all seven cranes shall be procured through a single supplier.

19) QUESTION: Will the Navy consider reforming the contract type to an IDIQ vehicle? The economic infeasibility of offerors estimating their fixed-price costs up to seven (7) years in the future can be alleviated by issuing task orders under an IDIQ on an as-needed basis to meet the Navy’s needs during the contract’s option-year periods.

RESPONSE: See new schedule for fixed options provided in Amendment 0004.

20) QUESTION: Has the Agency considered revising the Solicitation’s pricing structure to a cost-type structure? Requiring offerors to estimate their material, labor, and other costs up to seven (7) years in the future on a firm fixed-price basis creates an unreasonable commercial risk for offerors.

RESPONSE: Contract will remain firm-fixed price. See new schedule for options provided in Amendment 0004.

21) QUESTION: In the likely event that the cost of materials, labor, or transpiration increase significantly over the option periods due to changes in the marketplace or governmental action (e.g., tariffs), will the Navy compensate offerors for such price increases?

RESPONSE: The solicitation will not be amended to include an economic price adjustment clause.

22) QUESTION: Time of Delivery Under the current structure of the seven (7)-year option period, it’s possible that option-year CLINs could be exercised simultaneously during this period, thus requiring the awardee to execute simultaneous installation of cranes in geographically diverse areas of the United States. Will the Navy reconsider how its option-year CLINs are issued?

RESPONSE: See new delivery schedule provided in Amendment 0004.

23) QUESTION: The Navy unilaterally changed the language in FAR 52.217-7, Options for Increased Quantity—Separately Priced Line Item, which is incorporated into the Solicitation in full text. Specifically, the Agency deleted the standard language from FAR 52.217-7 stating that “Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.” In place of this deleted language, the clause now states that “Options exercised up to 365 days from the base award will have a contract completion date of 1,080 calendar days from the time the option is exercised. Options exercised after 365 days from the base award will have a contract completion date of 720 calendar days from the time the option is exercised.” Under FAR 52.104(a), a Contracting Officer may not modify FAR provisions and clauses unless the FAR authorizes such modifications. Upon what authority is the Navy basing its unilateral revisions to FAR 52.217- 7?

RESPONSE: See revised clause in Amendment 0004.

SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS

INSTRUCTIONS

L1 INQUIRIES OR QUESTIONS

All inquiries or questions must state the solicitation number and clearly state the question and solicitation/spec reference.

The deadline for submitting pre-proposal inquiries is 10 days prior to proposal due date.

L2 PROPOSAL SUBMISSION INSTRUCTIONS

1. Time and Date for Receipt of Proposals A. Technical and price proposals shall be submitted no later than the date and time provided in Block 9 of the Standard Form 33 “Solicitation, Offer, and Award.” Proposals not received on or before the hour and date set forth will be handled in accordance with FAR provision 52.215-1 “Instructions to Offerors – Competitive Acquisition.”

B. Proposals shall be submitted to the following address (NO ELECTRONIC COPIES WILL BE ACCEPTED):

If sent by mail or private courier:

Director, Navy Crane Center Attention: Luke Clay or Lisa Sumpter Naval Facilities Engineering Command Building 491 Portsmouth, Virginia 23709-1044

2. Proposal Format Offerors must submit required information for non-price (technical and past performance) and price proposals as follows:

The Non-Price (technical and past performance) and Price Proposals shall be submitted in separate binders, tabbed appropriately, and must include a cover page with the name of the prime contractor, addresses, phone and fax numbers, e-mail addresses, solicitation number, DUNS number, and point of contact. Should there be a discrepancy between paper and electronic information provided, the paper copies shall govern. Offerors are requested to number the pages consecutively for each factor.

Each volume of the proposal shall be submitted in accordance with the solicitation submittal requirements presented under Price and Non-Price Factors. Proposals are to be neat, legible and orderly. Content is more important than quantity. A concise and comprehensive proposal is desired. Organization, clarity, accuracy of information, relevance, and completeness are of prime importance. Statements such as “will comply”, or “noted and understood”, without supporting narrative to define compliance are not acceptable. Cursory responses or responses which merely reiterate or reformulate solicitation language will not be considered as satisfying the requirement of the RFP or as demonstrating the ability to perform. Elaborate brochures or other presentations beyond that sufficient to present a complete and effective proposal are not desired. Elaborate artwork and expensive visual or other presentation aids are not necessary.

Do not include exceptions or conditions to the terms and conditions of the solicitation in either the non-price or price proposal. Should the offeror include any standard commercial or company terms and conditions that conflict with the terms and conditions of the solicitation the offeror may be determined “unacceptable” and thus ineligible for award. Should the offeror have any questions related to specific terms and conditions of the solicitation, these should be resolved prior to submission of offers, via the pre-proposal inquiry process.

Details concerning how the proposal will be evaluated are covered in Section M of the RFP.

3. Joint Venture and Team Arrangements—FAR Subpart 9.6 defines contractor team arrangements. Contractor team arrangements mean (1) two or more companies form a partnership or joint venture to act as a potential prime contractor; or (2) a potential prime contractor agrees with one or more other companies to have them act as its subcontractor under a specified Government contract or acquisition program.

All offerors proposing team members, a joint venture, key “team” subcontractor(s) (a key “team” subcontractor is defined as a subcontractor who in a “team” approach will perform significant/critical aspects of work under the proposed contract on a consistent basis, or on a consistent overflow basis), other subcontractors, and/or other entities (subsidiary/affiliate/parent/LLC/LTD member companies whose names are not exactly as stated on the SF33) upon whose resources the offeror relies on in response to a factor or subfactor requirement of this proposal, e.g. experience provided under Factor 1 (Corporate Experience), shall submit the following information in the front of both the technical and price proposals:
