Section H - Special Contract Requirements
H1 PORTSMOUTH NAVAL SHIPYARD
l. Facility Information N/A.
2. Operations Affecting Existing Work Operations affecting existing facilities at the construction sites shall be conducted with care not to damage facilities that are to remain in place. All existing facilities damaged by such operations shall be rectified promptly without additional cost to the Government. Where existing facilities must be changed, or where new facilities adjoin, connect to, or abut existing facilities, the existing facilities shall be altered only as necessary and approved, in a substantial, neat and workmanlike manner.
3. Work Outside Regular Hours If the Contractor decides that it will be necessary to conduct work outside regular hours or on Saturdays, Sundays, or holidays, at any of the Government sites identified in the delivery orders issued, the contractor shall submit a written request to the naval activity authorities, as well as a copy to the Contracting Officer. Such requests, if authorized, shall allow ample time to enable satisfactory arrangements to be made by the Government to authorize such work and for inspecting the work in progress. At night, the contractor shall light the different parts of the work in an approved manner. All utility cut-overs shall be made after normal working hours or on weekends. No additional costs shall be authorized for such work. Normal work hours are considered to be 0700 to 1530, Monday through Friday, with no work on government holidays, and no work between Christmas and New Year’s Day.
4. Security Requirements
4.1 Foreign nationals: Approval of access by foreign nationals requires a significant amount of time. The following information may need to be provided to the delivery site representative a minimum of thirty (30) calendar days before a visit:
1. Name
2. Country of Origin
3. Firm/Contract Number
4. Area to be visited
5. Reason for visit

7. Passport
8. Birth Certificate

"Defense Biometric Identification System (DBIDS) increases installation security and communications by receiving frequent database updates on changes to personnel/credential status, law enforcement warrants, lost/stolen cards, and force protection conditions. The system provides a continuous vetting anytime the DBIDS card is scanned at an installation entry point.” If you (contractors, et al)* currently have a Navy Commercial Access Control System (NCACS) card, the following is required to get a DBIDS credential: Present your NCACS Card and a completed copy of the SECNAV FORM 5512/1 to the base Visitor Control Center (VCC) representative.
The VCC will pull up your information in the computer, ensuring all information is current and correct. Once your information is validated, a temporary DBIDS credential is provided. Your temporary credential will have an expiration date, prior to which you will need to obtain your permanent DBIDS credential (~ 180 days).
For each additional U.S. Navy installation to which you need access, the first time you visit you only need to bring your DBIDS credential and statement of purpose for base access when arriving at the VCC. The representative will enter base access authorization and then you may proceed to work.
Additional information is available at https://www.cnic.navy.mil/om/dbids.html.
Failure to obtain entry approval will not affect the contract price or time of completion.
4.2.1 Badge Requirements: NAVSEA Standard Access Control Badges (SACB’s) are required for access to naval activities, NAVSEA Controlled areas, Security Islands (SI), Controlled Nuclear Information Areas (CNIA) Nuclear Work Areas (NWA), and Controlled Industrial Area (CIA). 4.3 Vehicle Permits: All vehicles entering any naval activity are required to obtain a permit in accordance with facility regulations. The vehicle permits can be obtained from the VCC. Vehicles will be required to have a company logo or identification visible on both sides. All contractor vehicles and equipment, when not in use, shall be locked or removed from the facility or otherwise disabled so that operation by unauthorized personnel will be prohibited.
4.4 Cameras: No cameras, including cell phone cameras, are allowed inside NAVSEA Controlled Areas.
Photography by the Contractor is prohibited. Construction progress photos, and all other necessary photo documentation, will be provided by authorized Government personnel.
4.5 Portable Computer Equipment: Authority to operate computer systems on Portsmouth Naval Shipyard (PNS) must be granted by Code 109 ISSM. 5. Naval Activity Regulations The contractor, employees and subcontractors shall become familiar with and obey all facility regulations including fire, traffic and security regulations. All personnel employed on the work site shall keep within the limits of the work (and avenues of ingress and egress), and shall not enter any restricted areas unless required to do so and are cleared for such entry. The contractor’s equipment shall be conspicuously marked for identification.
6. Work Schedule The Contractor shall submit a work schedule as required by the contract for each delivery order issued to the Contracting Officer and the appropriate naval activity personnel prior to commencing work since circumstances at any particular site may dictate the need to modify the contractor’s work schedule. Attention is invited to the fact that other Contractors may be engaged in work at each site and there may be the need for close cooperation in order to avoid conflicts. The Contractor shall cooperate and schedule work to avoid conflicts with and interruption of the work of others insofar as practicable. In the case of conflicts with other Contractors that cannot be resolved satisfactorily, the matter shall be referred to the Contracting Officer for resolution. The Contractor shall provide written notice to the Contracting Officer of at least thirty days prior to intended mobilization date.
7. Government Activities The Government will continue its normal activities during the contractor’s work at each site, and the contractor shall carry on work with the least possible interference to Government activities. The contractor shall schedule work as to cause the least amount of interference with naval facility operations. Work schedules shall be discussed with naval activity personnel as required. Permission to connect or interrupt any roads, railroads and/or utility service shall be requested in writing a minimum of fifteen (15) calendar days prior to the desired date of interruption. The contractor shall make reasonable efforts to provide secure boundaries and sign postings around the designated work site to prevent entry of unauthorized personnel and vehicles.
8. Government Work and Material The Contractor will perform the final acceptance tests of the crane as described in the contract. The Government will provide the test weights, rigging gear, and power, to perform the tests.
9. Safety Requirements See Appendix H (Safety) contained in this contract. Also, see safety related CDRLs provided in Exhibit A.
10. Crane Mobilization, Assembly, Installation and Testing Plan The contractor shall submit a plan to the Contracting Officer detailing the logistics involved in crane mobilization to the assembly site, installation and testing of the crane. The plan shall include the type of equipment necessary for crane mobilization to the assembly site, required storage and protection of crane components, coordination of crane installation and testing. The plan shall contain enough detail so that all topics are covered including maximum loading and maximum wheel loading for mobilization equipment.
11. Storm Protection Should warnings of wind of gale force or stronger be issued, the Contractor shall take every practicable precaution to minimize danger to persons, the crane and to adjacent property. These precautions shall include closing all openings as appropriate, removing all loose materials, tools and equipment from exposed locations and removing or securing scaffolding and other temporary work.
12. Sanitation If adequate sanitary conveniences are not available at the site, the contractor shall be responsible for such conveniences of any approved type for the use of persons employed on the work and properly secluded from public observation and shall be constructed and maintained by the contractor in such a manner and at such points as shall be required or approved by the appropriate authority at the Government facility. These conveniences shall be maintained at all times without nuisance and their use shall be strictly enforced. Upon completion of the work, they shall be removed from the premises, leaving the premises clean and free from nuisance.
13. Environmental Protection The contractor shall comply with all applicable federal, state and local environmental protection laws regulations and standards. The Contractor shall coordinate all environmental protection and hazardous waste disposal matters with the Contracting Officer. The Activity Environmental Protection Coordinator or authorized officials may inspect any of the facilities operated or maintained by the Contractor at any time and without prior notice. In the event that a regulatory agency assesses a monetary fine against the Government for violations caused by the Contractor, the Contractor shall reimburse the Government for all associated costs, including the amount of the fine. The contractor shall also clean up any oil or chemical spills that result from the Contractor’s operations at his own expense. The Contractor shall comply with the instructions of the cognizant Navy Medical Department with respect to avoidance of conditions which create a nuisance or which may be hazardous to the health of military or civilian personnel.
14. Public Release of Information There shall be no public release of information or photographs concerning any aspect of the materials or services relating to this contract or other documents resulting therefore without the prior written approval of the Contracting Officer. The Contractor shall insert the substance of this paragraph in each subcontract and purchase order.

Caribbean Basin country construction material means a construction material that--
(1) Is wholly the growth, product, or manufacture of a Caribbean Basin country; or
(2) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a Caribbean Basin country into a new and different construction material distinct from the materials from which it was transformed.
Commercially available off-the-shelf (COTS) item—
(1) Means any item of supply (including construction material) that is--
(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

Materials purchased directly by the Government are supplies, not construction material.
Cost of components means--
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

(2) A Free Trade Agreement (FTA) country (Australia, Bahrain, Canada, Chile, Colombia, Costa Rica, Dominican Republic, El Salvador, Guatemala, Honduras, Korea (Republic of), Mexico, Morocco, Nicaragua, Oman, Panama, Peru, or Singapore);
