Naval Oceanographic Office (NA VOCEANO) proposes to award a sole source contract to Walls Machine Shop for the required supplies. The contract will be executed by the NAVOCEANO) Contracts Department.

2. Description of the Action Being Approved.

The Government anticipates awarding a firm fixed price contract on a sole source basis to Walls Machine Shop of Huntsville, AL. The proposed period of performance is twenty weeks after receipt of order to deliver all parts required under this contract. The anticipated award date is Dec 30, 2015.

3. Description of Supplies/Services.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(2), Only one responsible source and no other supplies or services will satisfy agency requirements, as implemented by FAR 6.302-1.

5. Rationale Justifying Use of Cited Statutory Authority.

Walls Machine Shop is the only ISO 9001 :2008 certified company with experience in fabricating EARS parts that can meet the required schedule. The EARS survey schedule has a requirement for 90 systems to be ready for shipment by June 2016. To fulfill the EARS missions a contract for these parts must be placed no later than Dec 31, 2015. The pressure vessel parts used in the EARS system are designed to last for up to three years in a deep water environment subject to high pressure and salinity. These parts must be made to very tight dimensional and metallurgical tolerances to preventcatastrophic failure during deployment. Because of the stringent requirements listed above, IS0-900 I :2008 certification in the quality management system for the manufacture of customized machined, fabricated, and assembled parts for commercial, defense, and aerospace applications is required to ensure that all parts conform to the specifications.

The ability to deliver the parts on time is critical because after award the vendor will begin delivering parts 8 weeks ARO and complete deliveries 20 weeks ARO. Once the pressure vessels are delivered it takes an additional two months for N9 to build, test, and QA EARS

FOR OFFICIAL USE ONLY

systems. After the test, the systems are shipped to the port. If they are surface shipped it takes 8-10 weeks. If they are air shipped it takes 2-3 weeks at an added cost of$75,000 or more per mission.

If the parts are not received in a timely manner, the EARS systems will not be available for three missions and will result in lost ship time and lost data. There are 88 mission days aboard TAGS ships and vessels of opportunity that will be impacted should the EARS systems not be fabricated on time. At an average cost o per day the estimated cost to the government is~ dollars and loss of valuable ambient sound collection worldwide.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

This sole source procurement is to fulfill the immediate EARS mission requirement. Market research was conducted and only one IS0-9001 :2008 certified source was found capable of providing the required supplies within the required timeline.

7. Determination of Fair and Reasonable Cost.

Before making award, the Contracting Officer will determine that the proposed price is fair and reasonable based on one of the techniques identified in Federal Acquisition Regulation (FAR) Subpart 13.106-3 -Award and Documentation.

8. Actions to Remove Barriers to Future Competition.

The Government is conducting additional market research to identify potential sources-capable of providing the supplies on a long-term basis. The goal is to identify multiple potential sources so that the requirement can be competed.
