FINAL RFP QUESTION/RESPONSE FORM

SPECIFIC QUESTION

Question 1: Is the Offeror required to complete the fill in portion of FAR Clause 52.225-18 with the IDIQ submission or during subsequent task order-level submissions?

Questions 2: DFARS Clause 252.234-7001 requires the offer to provide documentation the cognizant Federal Agency (CFA) has determined that the proposed Earned Value Management System (EVMS) complies with the EVMS guidelines in ANSI/EIA-748 or a comprehensive plan for compliance for proposals over $100,000,000. Please confirm this documentation is required at the time the task order proposal is due and not with the CMMARS MAC proposal. If it is required with the CMMARS proposal, please specify which volume or annex it should be provided?

Question 3: DFARS Clause 252.227-7017, Identification and Assertion of Use, Release, or Disclosure Restrictions is this clause required to be filled out with the IDIQ submission or should it be submitted at the task order level

There appears to be a contradiction between the first and second sentence of paragraph Sections L.1.3.1.b and M.1.3.1.b.

The first sentence indicates the contract reference will be accepted if it has a different physical address than the prime identified in Table T-1 if the Offeror provides an explanation IAW Section L.1.2.2. The second sentence indicates the Offeror in Table T-1 must have the same physical location as the contract reference and does not offer the opportunity to provide an explanation.

Question 1: Will the Government please amend the second sentence of Section L.1.3.1.b to mirror Section L.1.2.2.b, Instructions?

b. Contract reference at the same physical location and the same CAGE code/DUNS as the entities identified in

Table T-1 (Offeror Summary) unless the Offeror provides an acceptable explanation based on the considerations in Volume 1 (Technical), Section 1.2.2.

If the contract reference is for the prime identified in Table T-1 (Offeror Summary), the contract reference shall additionally be at the same physical location and shall have the same CAGE code identified in the award form (e.g., Block 7 on Standard Form (SF) 26 Award/Contract; Block 15A on Standard Form (SF) 33, Solicitation, Offer, and Award; Block 9 on Department of Defense (DD) 1155, Order for Supplies or Services).

Solicitation Sections L and M are revised and published in amendment 0002.

Section L, Part B, Paragraph 1.2.3 stipulates technical references will not be considered if the contractor with the CAGE code/DUNS identified on the contract reference is different than the offeror with its CAGE Code identified in Block 15A on the SF 33 and identified in Table T-1 (Offeror Summary) unless 1.2.2.b applies. Paragraph 1.2.2.b states the contract reference will only be considered if the CAGE/DUNS is the same as the Offeror with its CAGE Code on the SF 33 as a result of a corporate acquisition, reorganization, merger or other administrative reason.

Question 1: Is the explanation in response to paragraph 1.2.2.b considered a deviation that should be noted IAW paragraph L.2.4 – Terms & Deviations of the Contracts Administration Volume?

Question 2: If so, should the explanation also be included in Volume 2 under paragraph 2.4 Terms and Conditions where exceptions and deviations are addressed?
