ADDENDUM to 52.212-2 Commercial Products and Commercial Services. (Deviation)
(a) The Government intends to award a Firm Fixed Price, Single Award
Contract to a qualified offeror whose proposal represents the best value to the government. For this solicitation, evaluation factors are listed in descending order of importance: Technical Capability is more important than Past Performance, and when combined, non-price factors are significantly more important than price. Noncompliance with the solicitation requirements will raise serious concern regarding an offeror’s technical ability to fulfill this requirement and may be grounds to eliminate the quote from further consideration for contract award. Evaluation will be conducted as follows:
Factor 1 - Technical Capability
Offerors must provide an adequate technical capability statement that their quote is in compliance with the Equipment Specifications and Contractor Responsibilities outlined within the SOW and all associated Attachments and/or Exhibits of the solicitation. The statement should be sufficient to enable the government to make a meaningful evaluation and arrive at a sound determination as to whether the quote will satisfy the requirements of the Government as stated in this request for quote.
The Government will evaluate the offeror's technical capability Factor Submission to http://www.sam.gov/ determine if it demonstrates a clear understanding of the requirements outlined in the SOW and submission requirements in 52.212-1 above based on the following rating definitions.
Technical Capability Ratings Rating Definition
Acceptable Proposal clearly meets the minimum requirements of the solicitation
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
A quote that is determined to be not technically acceptable will not be evaluated further.
Factor 2 – Past Performance
The Government will assess the offeror’s probability of meeting the minimum past performance solicitation requirements. The Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources, including sources outside of the Government. The quoter shall submit, as part of its quote, information on previously performed contracts or on-going contracts that are similar to the statement of work/item description in the solicitation performed for Federal, State or local Governments, and for commercial firms. Information shall be provided on either 1) all such contracts within the past three years, or 2) the last three such contracts performed, whichever is fewer, and shall be limited to the name and address of the organization for which the product was supplied and services were performed and the number (phone, fax or Internet) of a contact for each contract listed.
The quoter should not describe past performance history in the quote. The information should include, however, discussion of any major problems encountered on the contracts listed and the corrective actions taken to resolve them. The information may also include a description of any quality awards earned by the quoter.
Past performance will be initially evaluated to determine if it is recent and relevant.
The Government will consider recent past performance as having been performed within the last three (3) years preceding the date of issuance of this solicitation. The Government will consider the past performance relevant if it involves rental of emergency diesel generators and Automatic Transfer Switch (ATS) panels. Recent and relevant past performance will then be evaluated to determine how well the offeror performed on prior contracts and given a rating according to the Past Performance Confidence Rating table, below.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.202 (c)(1)). Therefore, the offeror will be determined to have unknown (or “neutral”) past performance.
1. The Government will evaluate the recency of the offeror’s past performance and assign a rating in accordance with the “Past Performance Evaluation Ratings Table
– Recency,” below. Recent past performance is considered to have been performed within the last three (3) years preceding the date of issuance of this solicitation.
Past Performance Ratings Table - Recency
Recent Past performance is within the last three (3) years preceding the date of issuance of this solicitation.
Not Recent Past performance is not within the last three (3) years preceding the date of issuance of this solicitation.
2. The Government will evaluate the offeror’s past performance relevancy and assign a rating in accordance with the “Past Performance Relevance Ratings Table – Relevancy,” below:
Past Performance Relevancy Ratings Table - Relevancy
Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexity this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexity this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope or magnitude of effort and complexities this solicitation requires.
An offeror without a record of recent or relevant past performance or for whom information on past performance is not available will not be evaluated favorably or unfavorably but will receive a confidence rating of neutral.
3. Recent and relevant past performance will then be evaluated to determine how well the offeror performed on prior contracts. The offeror will be given a rating according to the Past Performance Confidence Rating table, below:
Past Performance Confidence Ratings Rating Definition
Substantial Confidence Confidence based on the offeror’s recent/relevant performance record, the Government has a high expectation that the offeror will successfully perform the required effort.
Satisfactory Confidence Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort.
Neutral Confidence
No recent/relevant performance record is available, or the offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
The offeror may not be evaluated favorably or unfavorably for the factor of past performance.
Limited Confidence
Based on the offeror’s recent/relevant performance record, the Government has a low expectation that the offeror will successfully perform the required effort.
No Confidence
Based on the offeror’s recent/relevant performance record, the Government has no expectation that the offeror will be able to successfully perform the required effort.
Factor 3 - Price
Exchanges with offerors after receipt of proposals does not constitute a rejection or counteroffer by the Government. The Government will evaluate the offeror’s proposed price in accordance with FAR 15.404-1.
The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
The Government will evaluate each offeror’s total proposed price for award purposes by adding the price of the 6-month potential option period to the total price for the basic requirement. Evaluation of options does not obligate the Government to exercise the option.
Award Information Award will be made to the responsible offeror whose proposal, in conforming with this solicitation, is determined to represent the best value to the Government. Offerors are urged to ensure that their proposals are submitted on the most favorable terms
A written notice of award, or acceptance of a quote, e-mailed or otherwise furnished to the successful offeror, within the time for acceptance specified in the offer, will result in a binding contract without further action by either party. Before the specified expiration of the offer, the Government may accept an offer (or part of an offer), whether or not there are negotiations, after its receipt unless a written notice of withdrawal is received before award.
Contractor Responsibility To be eligible for award of a contract hereunder, an offeror must be determined by the Contracting Officer to be a responsible prospective contractor. To be determined responsible, a contractor must:
1. Have adequate financial resources to perform the contract, or the ability to obtain them.
2. Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments.
3. Have a satisfactory performance record.
4. Have a satisfactory record of integrity and business ethics.
5. Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor or subcontractors).
6. Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them. Be otherwise qualified and eligible to receive an award under applicable laws and regulations
