Section J, Exhibits A through E – Offeror shall enter unit prices and amounts for Exhibit Line Items (ELINs) as indicated in the schedules.
Unrealistically low (or high) proposed prices or prices unbalanced between the various option periods, initially or subsequently, may be grounds for eliminating a proposal from competition either on the basis that the Offeror does not understand the requirement, or has made an unrealistic proposal.
In the event there is a different between a unit price and the extended total amount, the unit price will be held to be the intended offer and the total of the ELINs will be recomputed accordingly. OTHER REGULATED WASTE, AND SPILL RESPONSE AT JOINT REGION MARIANAS, GUAM
QUESTION 1: Will the successful bidder on this procurement be precluded from bidding on the Environmental Compliance Services opportunity at Joint Region Marianas, Solicitation Number
N4019219RP800?
Answer 1: The awardee of this solicitation may participate in, and submit a proposal in response to, any future solicitation related to Environmental Compliance Services at Joint Region Marianas. However, a potential organizational conflict of interest (OCI) may arise; and the awardee of this solicitation may be required to address the potential OCI on any such future solicitation. Significant potential OCIs are normally resolved by imposing some restraint, appropriate to the nature of the conflict, upon the contractor's eligibility for future contracts or subcontracts. Refer to FAR Subpart 9.505 for general rules.
QUESTION 2: Reference Section J Exhibits A-E. ELINs A117-A136 state “Price per pound for the proper disposal to an EPA-approved disposal facility. Includes labor, shipping container, trucking/shipment and proper documentation”. The current BOS contractor does not perform this service and issues the waste item to DRMO/DLA for disposal. Is it the Government’s intent under this contract to stop disposal through DRMO/DLA?
Answer 2: No. It is not the Government’s intent to stop disposal through DRMO/DLA. However, the Contractor must have the capability to dispose to an EPA-approved disposal facility should DRMO/DLA not be available.
QUESTION 3: Reference Section J. No quantities for asbestos and lead-based paint are provided in the workload data. Will the Government provide the workload data or a basis of estimate?
Answer 3: No. Asbestos, lead-based paint, and PCBs are not generally encountered. However, for the purpose of submitting a proposal, Offerors shall assume that asbestos and lead-based paint are included in the descriptions and quantities stated in Annex 180000 Section C Spec Items 3.1.2 and 4.3 for Collection and Transportation of Hazardous Waste (HW), Hazardous Material (HM), Non-HW, Other Regulated Waste (ORW), as well as Spec Item 4.4 for Disposal and/or Recycling of Hazardous Waste (HW), Hazardous Material (HM), Non-HW, Other Regulated Waste (ORW).
QUESTION 4: Our understanding is the current workforce is under a collective bargaining agreement with the IBEW. Will the current CBA agreement be incorporated into the contract?
Answer 4: No. FAR Subpart 22.1002-3 is inapplicable to this contract as it does not constitute a successor contract.
QUESTION 5: Reference Attachment JC-1 Performance Work Statement. Attachment J-0200000-01, Definitions and Acronyms, provides a description of NAVFAC MAXIMO. Are Offerers expected to utilize the standardized Navy Maximo system and process in opening, closing, and tracking work orders for this effort?
Answer 5: No. NAVFAC MAXIMO will not be utilized on this contract. Refer to Amendment 0001 for revisions to the PWS which includes removal of the description and definition of NAVFAC MAXIMO from Attachment J-0200000-01, Definitions and Acronyms.
QUESTION 6: Reference Attachment JC-1 Performance Work Statement, Annex 0200000, Section C.
Spec Item 2.4.4 Government Furnished Equipment (GFE) states “None”. Will GFE such as IT equipment to connect to the Government network and the HazMat response vehicle be provided in the new contract?
Answer 6: No. GFE will not be provided in the resulting contract.
QUESTION 7: Reference Section M, Factor 3 Safety. Should EMR, DART, and TRC rates be provided in Factor 3 Safety Submission for “Key” subcontractors (those who are expected to perform 25% of the work)?
Answer 7: No. EMR, DART, and TRC rates shall not be submitted key subcontractors.
QUESTION 8: Reference Section M, Factor 5 Price. The proposal submittal requirements refer to Section B as having 12 CLINs, but the RFP provides 10 CLINs. If it’s not a typo then Section B is incomplete.
Answer 8: Section B only has 10 CLINs. Refer to Amendment 0001 for revision to the proposal submittal requirements for Factor 5 – Price in Section M paragraph M.6.d(5).
QUESTION 9: Reference Section J Exhibits A-E, ELINs A024, A039-A042, A068-A071, and A088- A090. Will the successful contractor for this RFP be able to utilize the Navy laboratory for testing services? If so, what are the costs, if any, for utilizing the US Navy laboratory services by analyses type?
Answer 9: No. Offerors shall assume the U.S. Navy laboratory is not available to provide services. The Contractor must have the capability to utilize accredited laboratories per Annex 0200000 Section C Spec Item 2.10.2.1 Sampling, Testing, and Laboratory Services.
QUESTION 10: Reference Section J Exhibits A-E. ELINs A059, A060, A139, and A140 are for the collection and transportation of used oil. ELINs A141-A144 are for proper recycling/disposal of used oil.
The unit of measure for these ELINs is in POUNDS. For example, A141 is for proper recycling/disposal of used oil at NBG site. Estimated quantity is 100,000 pounds. 100,000 pounds is less than 15,000 gallons. Should the unit of measure for these ELINs be gallons, not pounds?
Answer 10: No. The unit of measure for used oil is pounds (LB).
QUESTION 11: Section J ELINs have no reference for collection, transportation, and disposal of petroleum impacted water (oily water). Is it the Government’s intent to not include collection, transportation and disposal of petroleum impacted water (oily water) from this RFP?
Answer 11: Oily water is included in the “Non-RCRA Regulated Waste” examples in Attachment J- 0200000-01 Definitions and Acronyms. For the purpose of submitting a proposal, Offerors shall utilize the “Non-Hazardous” quantities stated in Annex 1800000 Section C Spec Items 3.1.2 and 4.3 Collection and Transportation of Hazardous Material (HM), Hazardous Waste (HW), Non-HW, Other Regulated
Waste (ORW), as well as Spec Item 4.4 Disposal and/or Recycling of Hazardous Material (HM), Hazardous Waste (HW), Non-HW, Other Regulated Waste (ORW).
QUESTION 12: Reference Attachment JC-1 Performance Work Statement, Annex 0200000, Section C.
Spec Items 2.9.5 through 2.9.5.3 for Crane Operations state “Not Applicable”. Who is responsible for crane operations to lift hazardous waste products from ships when required? How are these lifts scheduled?
Answer 12: The Contractor is not responsible for crane operations in the performance of this contract.
The Government will coordinate crane operations if required when offloading hazardous waste from vessels. The Contractor shall provide “ashore” hazardous waste support.
QUESTION 13: Reference Attachment JC-1 Performance Work Statement, Annex 0200000, Section C.
Spec Item 2.9.6 Accident and Damage Reporting refers to crane operations. Who is responsible for reporting accidents, near misses, and damage from crane operations?
Answer 13: The Contractor is not responsible for crane operations in the performance of this contract, and is therefore not responsible for reporting accidents, near misses, and damage from crane operations.
Refer to Amendment 0001 for revisions to the PWS which includes revision of Annex 020000 Section C Spec Item 2.9.6.
