About this file

This document is a justification and approval for using other than full and open competition to procure electronic security system components for the Dry Dock No. 4 Reactor Servicing Complex project at Norfolk Naval Shipyard. The Navy requires Axis network cameras, HID badge readers, Aiphone intercoms, Cisco network switches, Lenel controllers, and Bosch motion sensors that are compatible with an existing authority to operate for the security system at the Dry Dock 2/3 complex. Using components from different manufacturers would require a new authority to operate that would not be completed before the Dry Dock 4 complex is needed. A sources sought notice yielded no responses. The total estimated value of the components is approximately $1.5 million. The contract will be awarded by January 2024 and must be completed by January 2026 to meet readiness requirements.

DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING COMMAND, MID-ATLANTIC

9324 VIRGINIA AVENUE

NORFOLK, VIRGINIA 23511-3095

J&A No. ML-23-71

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity. The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT).

2. Description of the Action Being Approved. This Justification and Approval (J&A) authorizes and approves the use of single manufacturers, Axis, HID, Aiphone, and Cisco, for Electronic Security System (ESS) components described below to be used in construction of the Dry Dock No. 4 Reactor Servicing Complex (Project # P013-19) at Norfolk Naval Shipyard (NNSY). The reactor servicing complex requires these components to meet security requirements. NNSY requires these components be on an approved Authority-To-Operate (ATO). These components will be connected to a security system at the Dry Dock 2/3 reactor servicing complex currently under contract (Project # P019-22) that will have an approved ATO and must exactly match the components listed on the ATO.

3. Description of Supplies/Services.

The intent of solicitation N4008523R2603, Dry Dock No. 4 Reactor Servicing Complex (Project # P013-19) at Norfolk Naval Shipyard (NNSY), Virginia, is to construct a new refueling complex with accompanying railcar enclosure complexes.

This acquisition was solicited as full and open competition, as authorized by the approved DD2579 on 08 April 2023. The estimated value of the work included in the construction solicitation is and the estimated value of the brand name materials subject to this J&A is approximately . The project will be funded by FY23 Other Procurement, Navy (OPN) funds for construction. The work under the contract is required to be completed within 787 days after award.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

NNSY requires a replacement Dry Dock No. 4 Reactor Servicing Complex that meets the training and operational requirements for defueling/refueling nuclear submarines including the ability to meet security requirements. The security requirements for the Reactor Servicing Complex include the need for cameras, badge readers, and intercom systems. These components are Internet Protocol (IP) based and therefore require an ATO approved by the NNSY Information Technology (IT) division. The listed security components are required to be used to since they will be attached to an existing ATO previously approved by NNSY IT for the Dry Dock No. 2/3 Reactor Servicing Complex. The use of components from different manufacturers would require a new ATO that would not be completed before the complex is needed to be ready for use.

The project will fill an identified capability gap in accomplishing reactor servicing training and operational requirements with replacement of enclosures (typical 20 year useful life) that are in excess of 35 years old. NAVSEA instructions include security requirements that must be met for reactor servicing complexes. Specific security components must be used so they can be included on an existing ATO. The Axis cameras are used for continuous monitoring of the reactor servicing complex when security controls are in place. The HID badge readers are used for access control into and out of the reactor servicing complex when security controls are in place.

The Aiphone intercoms are used for communication with security personnel to monitor entry into specific areas of the reactor servicing complex when security controls are in place. The Cisco POE network switches are used to transmit data from the reactor servicing complex security components to the security office. The Lenel controllers provide signal control for the badge readers, cameras, etc. to the switches. The Milestone license provides the ability to use the cameras on the existing base station software. The motion sensors provide movement detection ability to the security system/personnel when the complex is unoccupied. The products listed below are required to meet the readiness requirements for the Customer by meeting the NAVSEA security requirements for reactor servicing.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. The Contracting Officer will determine if the price for this acquisition is fair and reasonable in accordance with FAR Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques:

(1) Comparison of proposed prices received in response to the RFP and (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE).

8. Actions to Remove Barriers to Future Competition

For the reason set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid-Atlantic will assess whether competition for future requirements is feasible.
