About this file

This justification and approval document authorizes the use of other than full and open competition for the procurement of wireless controllers from Magnetek for a dry dock reactor servicing complex project at Norfolk Naval Shipyard. The project involves construction of a new refueling complex with railcar enclosures to replace aging facilities over 35 years old. The Naval Facilities Engineering Command, Mid-Atlantic will procure four 5-ton special purpose service bridge cranes, each requiring two Magnetek MLTX2 wireless controllers currently used in existing cranes. Using the same proven controllers across all cranes minimizes operator training needs and reduces spare parts requirements, important for safely handling nuclear submarines. Efforts to solicit other offers through a sources sought notice yielded no responses. Pricing will be determined fair and reasonable based on independent estimates and comparisons prior to award of the overall project contract valued at approximately .

DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING COMMAND, MID-ATLANTIC

9324 VIRGINIA AVENUE

NORFOLK, VIRGINIA 23511-3095

J&A No. ML-23-72

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity. The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic (NAVFAC MIDLANT).

2. Description of the Action Being Approved. This Justification and Approval (J&A) authorizes and approves the use of a single manufacturer, Magnetek, for wireless controllers with part numbers MLTX2 to be used in top running bridge cranes for the Dry Dock No. 4 Reactor Servicing Complex (Project # P013-19) at Norfolk Naval Shipyard (NNSY). NNSY currently utilizes this wireless controller in newer enclosure cranes and requires consistency on all cranes ordered continuing forward.

3. Description of Supplies/Services.

The intent of solicitation N4008523R2603, Dry Dock No. 4 Reactor Servicing Complex (Project # P013-19) at Norfolk Naval Shipyard (NNSY), Virginia, is to construct a new refueling complex with accompanying railcar enclosure complexes.

This acquisition was solicited as full and open competition, as authorized by the approved DD2579 on 08 April 2023. The estimated value of the work included in the construction solicitation is and the estimated value of the brand name materials subject to this J&A is approximately . The project will be funded by FY23 Other Procurement, Navy (OPN) funds for construction. The work under the contract is required to be completed within 787 days after award.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority permitting other than full and open competition is 10 U.S.C. 3204(a)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

NNSY requires a replacement Dry Dock No. 4 Reactor servicing complex that meets the training and operational requirements for defueling/refueling nuclear submarines including the use of special purpose service bridge cranes with wireless controllers. The wireless controller will provide the necessary consistency with existing systems to provide interchangeability and proven reliability. NNSY has many crane operators trained and qualified in the use of the Magnetek MLTX2 wireless controller. The layout of the controls on this device are familiar to these operators. Familiarity with the controller is essential for safe operation of the cranes in reactor servicing. Utilizing a mix of different controllers among NNSY SPS reactor servicing bridge cranes adds risk to these crane operations. NNSY will require additional operator training, additional written crane operation procedures, and additional preparation during reactor servicing operations.

The project will fill an identified capability gap in accomplishing reactor servicing training and operational requirements with replacement of enclosures (typical 20 year useful life) that are in excess of 35 years old. The project involves procurement of Qty. four , 5-ton special purpose service bridge (SPS) cranes in support of reactor servicing training and operations in the complex and will be procured with Qty. two. Wireless controllers per crane. NNSY currently has two existing enclosure cranes that utilize Magnetek wireless controller MLTX2 that have been modified to meet shipyard requirements. Shipyard crane operators have the potential to perform training and operations in any of the existing reactor servicing enclosures. Utilizing identical controllers with proven reliability across the program allow for a minimization in operator training, a reduction in spare parts needed to support multiple cranes, and reduces the risk of operator error. The product listed below are required to meet the readiness requirements for the Customer by meeting the requirements listed above.

If this Project does not include the required wireless controllers, the impact of using new equipment with unproven reliability would result in schedule delays to ship’s operational schedules and unnecessary risk for the defueling/refueling nuclear submarines.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A sources sought notice for the use of single manufacturers, Magnetek, for a wireless controllers with part numbers MLTX2 to be used in construction of the Dry Dock No. 4 Reactor Servicing Complex (Project # P013-19) was published on 22 May 2023, and yielded zero (0) responses.

The notice of intent closed on 05 June 2023. A pre-solicitation notice and solicitation will both be publicized on SAM.gov, in accordance with the requirements of FAR Part 5. The approved J&A will also be made publicly available as required by FAR 6.305.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the

Product currently utilized across the program per base unit + $5,500 required modification total per unit.

Total quantity of Eight units supplies/services covered by this J&A will be fair and reasonable. The Contracting Officer will determine if the price for the overall acquisition is fair and reasonable in accordance with FAR Part 15 prior to contract award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP; (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results. The fair and reasonable determination will be made based on the total price of the project. The brand name items under this J&A will not be individual line item prices in the solicitation.

8. Actions to Remove Barriers to Future Competition

For the reason set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid-Atlantic will assess whether competition for future requirements is feasible.
