About this file

This document is an amendment to a solicitation for the Demolition of the Bulk Fuel Facility at Naval Support Activity Cutler in Maine. The amendment provides the Government's responses to Prospective Proposal Inquiries (PPIs) received from contractors, and incorporates additional documents related to those responses, as well as an updated Wage Determination.

Key details include: the contractor is responsible for removing and disposing of existing fuel and hazardous materials, as well as demolition and installation of new fuel storage tanks and associated piping; there is a 30-year warranty requirement on the new tanks; the project is phased to maintain facility operations; the Government will provide the fuel transfer between existing and new tanks; the apparent low bidder must provide responsibility determination documentation; and contractors should submit long lead items as soon as possible after award, as the Government will prioritize review of those items. The solicitation has a lump-sum pricing structure, and the basis of award is price only.

Contractor PPI# Section of RFP or Page Number Paragraph Reference

Drawing Number Question RESPONSE

Can you please let us know which company currently supplies and delivers the fuel oil to the base? Dennis K. Burke (Portland)

With oil price fluctuation, how will we determine its price? Will you be using the Bangor price?

This is a firm-fixed price contract. Contractors must account for potential price fluctuations.

3 What is the oil delivery frequency?

Oil is delivered on an as needed basis, typically once a month.

Is there any other hazardous or regulated materials present in this project? See attached hazardous waste reports.

Where is the location and the quantities of asbestos and is there any asbestos report that government will supply for bidding? See attached hazardous waste reports.

How do we price the disposal of hazardous materials without quantities and levels of concentration? See attached hazardous waste reports.

Is there a current contractor that repairs the underground copper grounding grid? If so, please supply the name.

Ground grid repair shall be performed by licensed electricians with training and qualifications in performing exothermic/CAD weld operations.

Names of current/past qualified parties cannot be provided.

Can we work continuously throughout the year or there is a yearly limitation of onsite work?

Work can be performed continuously throughout the year except for limitations indicated in the construction documents.

Is it expected that some of the existing tanks will be empty before start of the project? Can you please quantify the amount of existing fuel that will be needed to be pumped into the temporary holding tanks or moved away from the site?

The Government will provide a response to this question in a future Amendment

Is it known the amount of built-up sludge in the existing tanks that needs to be removed and disposed of?

KTR to assume less than 6” of water/sludge at the bottom of tanks 125 and 126. Tank 127 has already been cleaned and is completely empty. Transient tanks are drained from the bottom regularly to remove sludge and should be assumed to have less than 3 inches of sludge/water for bidding purposes.

11 SECTION 01 11 00.00 20 Bid Option 7

Bid Option #7 SECTION 01 11 00.00 20 Page 4 refers to painting bulk tank pipe supports but after continues with “Transport 650 CY of excess soil offsite to an approved licensed facility in lieu of grading excess soils around the project site.” Please clarify what is the connection between them both. If it needs to be hauled away, please confirm whether it is uncontaminated.

Scope for Bid option 7 should read, "Prepare surface, clean and paint the (2) existing steel pipe support frames located inside each existing bulk tank valve house. "

12 What is the estimated start date. Equipment has long lead times.

The Government is planning and anticipating award by 8/15/2024, however, proposals shall remain executable for 90 days following proposal receipt by the Government as that date is not guaranteed. Period of performance begins at award.

13 Sec. 2.4.2.1 Sec. 2.4.2.1 Confirm all tanks are to be UL-2085. The 50,000 gallon will have to have interstitial concrete liner pumped in on at the site due to weight. Please confirm.

The Government will provide a response to this question in a future Amendment

14 Sec. 2.4.2.1

Sec. 2.4.2.1, Would a Flameshield tank be accepted as an alternate? Flameshield tanks has also been subjected to a 2 hour fire test. Flameshield tanks are built to UL-142 specifications and tested per Southwest Research Institute SwRI 97-04 requirements. Flameshield tanks are also built in accordance with the Steel Tank Institute's F-001-01 standard. They are literally tons lighter and carry the same 30 year warranty. For example, there is between 40-50,000 lb weight difference on the 50K tanks and a substantial cost difference between all sizes of this type of construction vs Fireguard construction.

The Government will provide a response to this question in a future Amendment

15 Section 2.4 Section 2.4 refers to a 40 year warranty, I am not aware of any third party 40 year warranty on any tanks. Please clarify. 30 year warranty is acceptible.

16 Section 2.9 Section 2.9 Piping sumps. This would indicate underground piping. Please confirm there is underground piping and is it to be monitored, insulated and heat traced? There is no underground piping.

17 M502 M502 refers to hydrostatic test and monitoring. AST’s are vacuumed tested not hydrostatically tested and monitored.

Please confirm. Concur. The device must detect leaks as specified.

Foot valves are not allowed for heating oil in ME but okay for Generators Sets.

These tanks are used for generators and should be installed with foot valves as specified.

19 S103 S103 appears to show a walkway on the tank tops, I could only find in the spec reference to a ladder. Please confirm OSHA walkway is required.

Confirmed. OSHA compliant ladder and walkway are required for all new fuel tanks.

In that the site visit took place on June 27, pre-bid inquiries are due on July 3, and this is a holiday week, can NAVFAC extend the bid by two weeks?

We will not be able to provide a two week extension; however, we will provide an updated bid due date upon Government’s final responses to all PPIs.

The specifications require a separate Superintendent, Quality Control Manager, and Site Safety and Health Officer as the contractor’s field management staff. Can this requirement be reduced to “two hats?” No.

We understand the requirement for tank cleaning and related disposal prior to demolition in the Base Bid, and the scope of Bid Options 09 and 10; but is the contractor responsible for any tank or system emptying or fuel disposal in the Base Bid?

KTR is responsible for all fuel/waste removal, draining, and disposal required to perform all work in the base bid and awarded bid options.

Is the contractor responsible for providing any fuel when new tanks are put into operation in the Base Bid? If so, how many gallons of fuel is the contractor responsible for disposing and/or providing?

KTR is not responsible for providing new fuel in the base bid.

Can an as-built drawing of the existing bulk storage tanks be provided so we can see if there are any internal components and to understand the wall-to-floor interface?

See attached Existing Bulk Fuel Tank Foundation Drawings.

Have any geotechnical or environmental investigations of the subsurface ground conditions been performed, including ledge locations and elevations, groundwater locations and elevations, existing soil or groundwater contamination, etc.?

A geotechnical evaluation of the work site is attached and contains all current geotechnical data of the site.

General Note 16 on drawing G002 and Hazmat Note 1 on drawing S001 indicate the presence of lead and “elevated concentrations” of lead, chromium, and cadmium in painted surfaces. Have any of these surfaces been tested for exact concentrations? This may impact the methodology of removal/handling and the cost of disposal. See attached hazmat reports.

In that the tanks (among other painted surfaces) are assumed to contain lead and other heavy metals, should lead handling/abatement be conducted at ground areas around painted tanks, piping, supports, walkways, railings, etc.?

The Government will provide a response to this question in a future Amendment

Have any materials been tested for asbestos content? The only reference to scope we find in the drawings is Keynote 16 on MD101. Please clarify that “in pipe” is intended as “in pipe trench.” Also, please confirm that the anticipated work required there is controls, containment, and disposal if asbestos insulation is impacted, but that abatement is not definitively required.

"In pipe trench" is correct. Concur, anticipated work requires controls, containment, and disposal where asbestos containing materials are impacted, but abatement is not definitively required for this scope item.

Specifications section 02 82 00.00 22 includes paragraph, 3.2.11 Abatement of Asbestos Contaminated Soil, but we do not find any scope of work for this in the drawings. We understand this may be just a boilerplate specification, but please confirm if this activity is required.

Correct. Soil testing did not detect asbestos in the soil, but this was left for unforseen conditions.

The existing enclosures to be removed adjacent to the existing transient tanks appear to possibly include transite wall panels (possibly asbestos) and steel windows that may include asbestos glazing and caulking. Please clarify if this is accurate.

See attached hazmat reports. Contractor must assume these components contain regulated materials.

Please confirm that no exterior access to the modified enclosures adjacent to the new transient tanks is to be provided by the contractor (e.g., manhole, sidewalk door, or hatch).

Contractor must provide embedded aluminum access hatch and ladder at one of the concrete covered enclosures. Contractor to coordinate hatch and ladder size and location with existing conditions and provide submittal for Government review.

Relative to the existing grounding grid wire (as per General Sheet Note 2 on drawing CX101), we have the following questions: N/A

Is there a limit of how much grounding grid can be cut and left unconnected for a period of time before restoration is necessary to allow additional cutting?

Given the limited extent of ground disturbance work in this project that can occur at any one time, it is not anticipated this project would approach the limit of ground grid disturbance.

Is there a preferred methodology for temporary support or protection of cut ends of grounding grid before it is restored?

The Government will provide a response to this question in a future Amendment

Is there a specific period and/or duration on “down days” during which the grid can be cut, handled, or restored?

See Note 2/CS101. Duration work can be performed on a "down day" is typically 8 hours.

Is the grounding grid energized during other than down days? If so, can NAVFAC provide the voltage and amperage of the grid?

The Government will provide a response to this question in a future Amendment

We understand the existing grid is connected via exothermic welds, but are exothermic welds required to restore the grid or can other, equally-effective methods be utilized?

Exothermic welds are required and the only acceptable means to restore the grid.

Bid Form - Sub-KTR Performance Value

CLINs 0001AA thru 001AM will each have Subcontractor costs across Labor, Materials, Equipment columns unless the Prime KTR "self-performs" that CLIN. What then goes in the "Sub-KTR Performance Value (1) cell since Sub Costs are already up in the main CLINs ??

The Government will provide a response to this question in a future Amendment

39 Bid Form - Overhead vs G&A What goes in General Home Office Overhead (G&A) (%) cell. For Prime KTRs, overhead and G&A are two separate and different %'s Overhead and G&A should be combined.

Price is determined as base bid and all options added together.

70 Escalation

We understand that the Government intends to award a lump sum contract for this Task Order. The construction industry continues to experience significant cost volatility in nearly all commodities that cannot be anticipated. Subcontractors are receiving unforeseen increases in material costs from their suppliers, sometimes on a weekly basis, that can be as high as 10% or more.

How is the Government going to accommodate the current price escalation being experienced in the marketplace with regards to commodities such as wood, steel, plastics, etc? Can an Equitable Price Adjustment (EPA) per contract length as one of the Defense FAR Supplement (DFARS) 216.203-4(1)(ii) clause be added to the RFP?

question in a future Amendment.

71 Lead Times

The construction industry continues to experience significant volatility, resulting in material lead time delays, in nearly all commodities that cannot be anticipated. Subcontractors are receiving unforeseen increases in material delivery durations from their suppliers.

How is the Government going to accommodate the current extended lead times and material manufacturing and delivery delays that are occurring in the construction industry?

Government performed market research to determine the lead time required for the fuel tanks. The lead time was accounted for in the period of performance.
