N4008523B2507 – USS Constitution Maintenance Dredging RFI 01 Responses

1. In the Solicitation package, bid items 0001-0005 are single lump sum amounts, however in specification section 00 22 13.00 20 “Supplementary instructions to offerors” the Contractor is instructed to provide a “lump sum price” for dredging, which is then shown in a unit price format.

Bid pricing cannot be both unit price and lump sum price at the same time for the same item.

Please revise the bid items to reflect which items are to be paid as lump sum (i.e.

mobilization/demobilization) and which are to be paid at unit price (i.e. dredging & disposal per

CY).

Bid the following in accordance with the contract documents:

a. 0001AA Mobilization/Demoblization 1 LS

b. 0001AB Dredging 2570 CY

c. 0001AC Dredge Disposal Tipping Fees 2570 CY

d. 0002A OPTION: Stand Down Demoblization/Remobilization 1 LS

e. 0002B OPTION: Off-site/Downtime Day Rate 1 LS

f. 0002C OPTION: Additional Survey – Dredge Site 1 LS

g. 0002D OPTION: Additional Survey – Disposal Site 1 LS

2. According to the plans and permits, a significant amount of work relating to the installation and maintenance of a turbidity barrier is required as part of this contract. However, there is no dedicated bid item for its installation, maintenance, and removal. How should the associated costs for the turbidity barrier be carried in the bid?

Refer to Specification Section 00 22 13.00 20, under CLIN 0001AA. This line item is intended to include “providing, installing, and maintaining all environmental controls, complete in accordance with the drawings, specifications, permits, and regulations.”

3. When the CONSTITUTION is relocated to the “phase 1” location, contractor suggests the vessel remain oriented with its port side to the pier to maximize the room for contractor equipment to maneuver without risk of damaging the CONSTITUTION’s bowsprit.

The Government needs an understanding of the construction schedule to fully respond to this comment. The USS Constitution is docked in both directions depending on its maintenance needs.

4. Would the Contractor be allowed to utilize both sides of the stationary concrete pier that now berths the USSC?

The Government needs an understanding of the intended use needed by the Contractor for the finger pier. If the Contractor could provide details, the Government could review for approval of use.

5. Is the Contractor only dredging inside the rectangle boxes as it is shown in the plans?

Drawing C-102 provides the coordinate and control points for the “rectangular box” which is designated the DREDGE FOOTPRINT. The Contractor must achieve the target dredge depth (-30 ft, MLLW) within this footprint. This drawing also depicts the approximate dredge side slopes, shown at an assumed 2.5:1 slope.

6. On the bid form SF1442, Box 10 states the bid date is on April 7, however in Box 13 it states bids are due on April 14. Please clarify.

The bid due date is April 7, 2023.

7. Section 35 20 23 1.6 states that the contractor “…shall rake the dredge areas and remove debris encountered” however only debris exceeding 10’ in any dimension is not suitable for disposal in the CAD cell. Raking would produce large amounts of small debris that is otherwise suitable for CAD disposal. Please specify what “raking” is defined as in the context of this contract.

The intent of this language is to identify and remove debris and artificial obstructions that are not suitable for disposal. Contractor may elect to utilize their own means and methods to meet the intent of this specification.

8. Maintenance material typical of this area naturally settles into a 3/1 slope, not 2.5/1 as specified in the drawings. Please clarify if slope material is to be paid on 2.5/1 or as it settles naturally.

2.5/1 slope has already been included in the design for approved permits. Proceed with targeting 2.5/1 slope in accordance with the design.

9. Pre and post-dredge surveys for the dredge areas in phase 1 and 2 cannot be performed at the same time due to the presence of the USS CONSTITUTION. Please confirm that Phase 1 will require its own pre-dredge survey and acceptance of a post-dredge survey prior to the relocating of the USS CONSTITUTION, and that a pre-dredge survey of the phase 2 dredge area will not be required until the USS CONSTITUTION has been relocated to allow for survey vessel access.

This is accurate.

10. Contractor suggests that the Government be responsible for tipping fees at the MASSPORT CAD cell. Tipping fees are due for all material placed in the CAD cell regardless of whether it is payable volume or not. Due to the nature of dredging it is inevitable that some amount of non-payable material will be removed and subject to tipping fees. Due to this uncertainty the price per CY under CLIN 0001AC would be significantly higher than the assigned tipping fee to account for any non-payable material subject to these fees. It is far more cost-effective for the Government to pay the actual sum of the tipping fees directly.

Overdredge volume was provided to mitigate non-payable volume. Volume provided for bidding includes a design volume of 1000 CY and overdredge volume of 1570 CY. Refer to the Dredge Volume table on sheet C-102 in the contract drawings. It’s unlikely that a Contractor aiming for a design volume of 1000 CY will surpass an overdredge volume of 1570 CY. Disposal of a volume more than the permitted amount of 2750 CY would violate Federal and State permits.

11. If the Government does not pay the tipping fees directly, contractor requests the unit item CLIN 0001AC to include all material subject to the fees, not just material contained in the payable volume prism.

See response to RFI Question 10. Disposal of a volume more than the permitted amount would violate Federal and State permits.

3. Work During Underway

a. Work during an underway is allowed, however, it is limited to an approximate 2 hour window.

b. The pier and berthing areas need to be cleared well before USSC’s return.

c. Anticipated window of opportunity is 1000-1200, subject to the USSC schedule.

d. Underways area subject to cancellation.

e. The Contractor shall notify the Contracting Officer’s Representative (COR) of their intention to work during an underway a minimum of seven calendar days prior to the target underway and provide a work plan and schedule including preparation and staging.

f. Contractors and their equipment shall remain well clear of the USSC during preparation to depart, departure, return, and mooring.

g. Contractor will appoint a POC with the ability to receive instant communication form the USSC Crew. This POC must be able to provide immediate direction to cease work and clear the area in the event the USSC requires a return to port sooner than anticipated.
