AMENDMENT 0003
The purpose of this amendment is to incorporate the following:
1. Responses to PPIs
2. Specification revisions
3. ELIN Schedule revisions (ELINS provided as an attachment)
4. Updated Wage Determination; General Decision Number: VA190195 01/04/2019 VA195
5. Revision to clause 52.228-1
1. Responses to PPIs
PPI # Question Response
Instructions to bidders - Regarding bonding requirements: The second item indicates that no bonding is required for task orders under $35,000. However, the third item indicates that the cost is to be included in the unit prices. Without a defined task order, how is it possible to determine if bonding will be applicable? For the purpose of an appropriate response, should all unit prices include the bond premium?
Bid per RFP
Exhibit A - The unit price schedule does not appear to consider mobilization costs associated with tasks. Please explain how mobilization costs are to be applied on a unit price basis without a defined Task Order/Scope of work. As an example, It may cost $1,500 to deliver & return a piece of equipment to accomplish pavement demo. Obviously, if the area to be removed is only 10sy, the $/sy will be much more than if the total is 100sy. Please clarify.
Bid per RFP
Exhibit A - Although the unit pricing is for an IDIQ, it appears that the quantities stated are intended to represent the total quantity for the first year.
To establish an appropriate unit price, please establish as a baseline what the minimum quantity would be. Typically, the smaller the quantity per Task Order, the higher the unit price may be. To establish appropriate unit pricing, if possible, the pricing should be based on a minimum quantity per task order. Bid per RFP
Exhibit A - The unit price schedule does not address the potential effects on production that may result from difficult access, obstructions, security restrictions, etc. For pricing purposes, should we assume all the work in a task order will be open and easily accessible without restrictions? Will adjustments be made if un-anticipated conditions are experienced? Bid per RFP
Exhibit A, General comment - In several cases, the unit price description provides a quantity range for pricing. Of course, a zero quantity would result in a unit price of $0. Please revise to include a minimum quantity. Bid per RFP
Exhibit A, A28029 - Will disposal be to a private/municipal dump or government dump? Will disposal fees be involved ($/tn). Is the mileage rate to be based on a full load? Are we to assume disposal is with a dump truck or dumpster? What size load?
Bid per RFP
Exhibit A, A01003 thru A010009 Concrete removal - Is the pricing strictly related to pavement removal? For pricing purposes what would be the maximum concrete thickness? Minimum quantity? Heavy pavement (10" thick +) may require a different method & equipment for removal. Bid per RFP
8 Exhibit A, A01026 wheelstop removal - Min. Quantity per task order? Bid per RFP
Exhibit A, A01027 - The description includes various different items to be removed on a linear foot basis. Please provide a better description of these items. Each of these different items mentioned (parking control poles, tracks, logs), will require different labor and equipment needs. Pricing will be affected by extent/quantities and conditions.
Bid per RFP
Exhibit A, A01033 - How does this item relate to A01027? Is the concrete removal (with tracks) paid for in the concrete removal (A010030-0A01009)?
Minimum quantity per task order?
Bid per RFP
Exhibit A, A01029 - Are these concrete filled steel bollards? What size? Are the in open areas or next to a building?
Minimum quantity per task order?
Bid per RFP
Exhibit A, A01034 - Clarify size and depth. Is backfill included?
Bid per RFP
Exhibit A, A02004 thru A02006 (sand, select fill, topsoil) - What would be the minimum quantity per task order? The cost of delivery is typically on a per load basis (about 14 cy). Bid per RFP
Exhibit A, A04001 thru A04005 aggregate base - Min. area per task order?
What would be the minimum thickness? Bid per RFP
Exhibit A, A05001 Scalp & Reinstall - Min. per task order?
Bid per RFP
Exhibit A, A05006 Fine grade base course - Min. per task order?
Bid per RFP
Exhibit A, A05010 Rip rap - Min. per task order? Delivery of stone for small quantities would require a minimum delivery fee. Bid per RFP
Exhibit A, A05011 #57 stone - Min. per task order? Delivery of stone for small quantities would require a minimum delivery fee. Minimum thickness? Bid per RFP
Exhibit A, A07001, A08001, A09001 - Min. per task order?
Bid per RFP
Exhibit A, A1001 Stamped asphalt - Pricing varies based on pattern and color chosen. Please provide a standard for pricing purposes. Min. per task order? Bid per RFP
Exhibit A, A11001 thru A11005 - Description includes both round and elliptical pipe. Those are two different pricings. What is the depth? Min. per task order?
Bid per RFP
Exhibit A, A11006, A11007 - For this item are we re-installing an existing frame and cover/grate? Bid per RFP
Exhibit A, A11009 manholes - What is the type of manhole (sanitary or storm)?
Number/size of pipes entering?
Description specifies 8ft depth and unit price is for VLF. Should this be $/ea?
Are these built-up masonry manholes?
Bid per RFP
Exhibit A, A11010 - What is the size of the catch basin? Description specifies 8ft depth and unit price is for VLF. Should this be $/ea? Specify the type/size of frame & grate (price varies depending on load rating).
Bid per RFP
25 Exhibit A, A11011, A11012, A11013 - Specify size and type for pricing. Bid per RFP
Exhibit A, A11014 - Typically, we would utilize precast structures. Masonry structures would be utilized if conditions are not appropriate for precast. What is pricing to be based on (manhole, catch basin or curb inlet)? Each has a different pricing? Specify size and depth. Bid per RFP

Exhibit A, A28020 - The description mentions different items to be priced on a LF basis. Each have a different pricing structure. Please provide a separate description for each item to define the scope/extent of labor/materials/equipment needed. Min quantity per task order? Bid per RFP
Exhibit A, A28022, A28023 - Min. per task order?
Bid per RFP
Exhibit A, A28025 - The price for cleaning will be affected by conditions, degree of difficulty, etc? Without seeing the actual site, it is difficult to determine the amount of labor/equipment/disposal, etc. needed. It could be a simple task or require significant effort. Bid per RFP
Exhibit A, A28026 Traffic loop - Specification? Min. per task order? The conditions, especially related to existing in-ground utilities and access to hand-hold will affect pricing.
Bid per RFP
Exhibit A - A28027 Guard posts - Specification? Size?
Bid per RFP
Please clarify if excavation, bedding, & backfill is to be included in line item cost for items A11001 through A12004, as this contradicts what is stated in the description on the bid form in Section A11 for manholes & drainage & Section A12 for SCH40 PVC pipe
See Amendment 0003
Can a material specification be provided for the soil reinforcement fabric & pavement fabric Bid per RFP
Can the difference between Line Item A02004 & A02005 be explained, in terms of the difference between fine aggregate (sand) and select backfill See Amendment 0003
Will the Navy consider adding unit price line items for reinforcing steel (lbs), dowels (ea), & welded wire fabric (sf) in section A17 of the bid form, as having these items incidental to some of the misc. concrete items is difficult to estimate
Bid per RFP
Please clarify if backfill is to be included with the removal of existing storm structures, as it states in the paragraph that is will be ordered with other line items, which contradicts description in Section A01 of the bid form
See Amendment 0003
Will the Navy consider a bid extension of at least one week, due to many contractors & suppliers being shutdown around the holidays & new year, to allow more time for proper solicitation and bid package preparation
See Amendment 0002
Due to volatility in the liquid asphalt market, will the Navy consider putting in an escalator or price adjustment factor tied to an established liquid asphalt index price?
Bid per RFP
Can the bid quantity for line item "A29003 COMMAND INTEREST WORK' be explained? Based on the line item description in the Summary of Work in the specifications, this item is based upon the issue of a single critical task order. The quantity of 400 EA seems extreme, as there are only 365 calendar days in a year. This item adds significant cost, even with a small dollar figure per each.
See Amendment 0003
For line item "A28026 TRAFFIC LOOP," can the Navy confirm that the materials for the traffic loop will be provided to the contractor, as there is no other mention of the traffic loop in the specs other than in the Summary of Work.
Bid per RFP
Confirmation of filing of Veteran’s Employment & Training for the 2017 filing cycle. Does this have an impact on the bid acceptance if you have not had a government contract and therefore never filed for this?
Bid per RFP
On sheet 13 of 51 in the Solicitation the Bid Guarantee calls for 20%of the Bid Price of $3,000,000.00 whichever is less. This is unusually high for this kind of job.

Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.60 for calendar year 2019 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015.
If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.60 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2019. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate, if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60). Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
END OF GENERAL DECISION

The following have been modified:
52.228-1 BID GUARANTEE (SEP 1996)
(a) Failure to furnish a bid guarantee in the proper form and amount, by the time set for opening of bids, may be cause for rejection of the bid.
(b) The bidder shall furnish a bid guarantee in the form of a firm commitment, e.g., bid bond supported by good and sufficient surety or sureties acceptable to the Government, postal money order, certified check, cashier's check, irrevocable letter of credit, or, under Treasury Department regulations, certain bonds or notes of the United States.
The Contracting Officer will return bid guarantees, other than bid bonds, (1) to unsuccessful bidders as soon as practicable after the opening of bids, and (2) to the successful bidder upon execution of contractual documents and bonds (including any necessary coinsurance or reinsurance agreements), as required by the bid as accepted.-
(c) The amount of the bid guarantee shall be 20% of the bid price or $1,000.00.
