About this file

This amendment provides answers to pre-bid inquiries for a solicitation seeking architect-engineer services. The indefinite delivery/indefinite quantity contract will be for architectural projects at various locations in Japan. Firms must demonstrate the ability to conduct legitimate business in Japan by possessing required licenses, registration, and documentation. While joint ventures with U.S. firms are permitted, the joint venture or at least one prime partner must show the capacity to work in Japan. The SF 330 submission deadline is March 17, 2022 at 1430 Japan Standard Time. The amendment clarifies that DFARS 236.602-70 restricting overseas architect-engineer contracts to foreign firms does not apply to this synopsis as it is not for a military construction project exceeding $500,000.

Text version

The purpose of this amendment is to provide answers to submitted pre-bid inquiries as follows:

Is the "FAR 236.602-70 Restrictions on award of overseas architect-engineer contracts to foreign firms" applicable to this contract?

If so, forming Joint Ventures with U.S. firms must be required to be eligible for award?

Please be advised that the synopsis is not intended to support an architect-engineer contract funded with military construction appropriated funds that exceed $500,000. Accordingly, DFARS Provision 236.602-70 does not apply to this synopsis.

If Joint Ventures with U.S. firms is required, must the U.S. firm be required to be licensed, registered and physically located in Japan?

Joint Ventures with U.S. firms is not required. Per the synopsis:

"AE firms are also reminded that only local sources will be considered for this requirement and that firms must demonstrate the ability to legitimately conduct business in Japan in order to be considered for contract award. Accordingly, AE firms must possess all required licenses, etc., be registered to conduct business in Japan, and possess all necessary documentation to perform work required under this synopsis. AE firms are required to submit documentation demonstrating its ability to legitimately conduct business in Japan as an addendum to the SF330 submittal. In the case of a joint venture, the joint venture entity or at least one prime joint venture partner must demonstrate its ability to legitimately conduct business in Japan. This information shall not be counted as part of the fifty (50) page limitation."
