GOODS AND SERVICES BY THE UNITED STATES ARMED FORCES IN
JAPAN [JAPANESE LAW NO. 108, 1988]
(a) The Consumption Tax Law (Law No. 108, 1988) was enacted in the Diet of Japan on 24 December 1988, and applied from April 1, 1989. The Government of Japan (GOJ) and the United States Government (USG), in accordance with paragraph 3, Article XII, of the "The Agreement Under Article VI of the Treaty of Mutual Cooperation And Security Between Japan And The United States of America Regarding Facilities And Areas And The Status of United States Armed Forces In Japan" (SOFA), have agreed upon procedures for exempting the United States from the Consumption Tax on the following transactions upon appropriate certification:
(1) Goods and services purchased in Japan for official purposes of the U. S. Armed Forces by the U.
S. Armed Forces or its authorized procurement agencies;
(2) Goods and services purchased in Japan, by persons, including corporations, who are designated by the USG in accordance with the provisions of paragraphs 1 and 2, Article XIV of the SOFA (Article XIV Contractors), solely for the purpose of performing the business of construction, maintenance or operation under the contract for construction, etc., for use by the U. S. Armed Forces, or film and gasoline purchased in Japan by Article XIV Contractors solely for the business activities described above.
(b) The underlying objective is to obtain the full amount of the exemption from the tax on U.S. Forces procurements immediately at the time of purchase, and at the same time give the Contractor a proof of purchase document, acceptable to GOJ tax authorities, which he/she can present to the tax authorities to obtain a tax credit and/or refund for tax already collected and paid by previous sellers.
(c) By the submission of their offer, the offeror certifies that Japanese consumption tax is not part of the bid price, nor will it be a part of any subsequent modification to the contract. Procedures for Contractors to obtain a consumption tax credit are described in a handbook that may be obtained from the Procuring Contracting Office.

7. EVALUATION FACTORS FOR AWARD
As stated above this is a solicitation for commercial items prepared in accordance with the format in FAR Subpart
12.6 (Streamlined evaluation of offers). This solicitation is issued as a Request for Quotation (RFQ) in accordance with FAR 13.106. The Offeror must be an authorized dealer and/or manufacturer. Written quotes are required (oral offers will not be accepted). Submission of quotes must be in accordance with FAR 52.212-1, Instructions to Offerors, Commercial Items. The Government will award a Purchase Order on the basis of the lowest priced offer. Since award of the Purchase Order will be based on initial responses, offerors are highly encouraged to quote their most advantageous pricing in their initial response. Award of the Purchase Order will be made using the Simplified Acquisition Procedures in accordance with FAR 13.106-2(a)(3)(b)(1).
Basis for Award: The Government will award a Purchase Order resulting from this solicitation to the responsive and responsible offeror whose quote conforming to the solicitation (i.e., meets all identified minimum mandatory characteristics identified for each item specified in Attachment 1: Specification - Mandatory Characteristics for each item being purchased under this solicitation) will be most advantageous to the Government at the lowest price. The following factor shall be used to evaluate quotes: price alone.
1. The Government reserves the right to eliminate from consideration from award any or all quotes at any time prior to award of the contract(s) that do not conform to the solicitation; to negotiate with offerors in the competitive range; and to award Purchase Order(s) to the offeror(s) submitting the lowest price quote(s) that conforms to the solicitation (i.e., meets all minimum mandatory requirements specified in Attachment 1:
Specification - Mandatory Characteristics for each item being purchased under this solicitation.)
2. The Government intends to evaluate the quotes and award Purchase Order(s) without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
3. The Government reserves the right to award each Line Item / Combination of Line Items as separate contracts to the offeror(s) representing the lowest priced quotation(s).
SUBMISSION REQUIREMENTS & BASIS OF EVALUATION
(i) RFQ Submittal Requirements: The Offeror shall complete and submit the following in the order shown below:
a. Completed Attachment 1: Specification - Mandatory Characteristics for each item being purchased under this solicitation
b. Completed Attachment 2: Provisions and Clauses
c. Completed Attachment 3: Representations and Certifications
d. Completed Attachment 4: Price Schedule
Note: the failure of an Offeror to complete and submit all of the aforementioned items (i.e., a, b, & c) will result in the Offeror’s quote being deemed non-responsive and ineligible for further consideration for award.
(ii) Basis of Evaluation of Price: The Government will evaluate price per Item No(s) that conform to the solicitation (i.e., meet all minimum mandatory requirements specified in Attachment 1:
Specification to determine fairness and reasonableness in accordance with FAR 13.106-3.
Deviations from the RFQ minimum/maximum requirements are NOT allowed and the offeror’s quote for that Item No that deviate from the RFQ will be determined non-responsive and not eligible for award.
In accordance with FAR 12.209 (Determination of price reasonableness) the contracting officer must establish price reasonableness in accordance with FAR 13.106-3 (Award and documentation), 14.408-2 (Responsible Bidder
– reasonableness of price), or subpart 15.4 (Contract Pricing), as applicable. In accordance with FAR 13.106(3) before making award the contracting officer must determine the proposed price is fair and reasonable. The contracting officer may, whenever possible, base price reasonableness on competitive quotations or offers.
A price that is found to be unreasonably high or unbalanced may serve as a basis for rejection of the proposal. The price evaluation will document the reasonableness and completeness of the total evaluated price. Representations and Certifications will not be rated. They will, however, be considered in assessing the offeror’s responsibility.
AWARD OF PURCHASE ORDER
In accordance with FAR 13.004 (Legal effect of quotations) the Government intends to award a Purchase Order, to the responsive and responsible offeror submitting the lowest priced quotation. The RFQ does not commit the Government to make any award. The Government may cancel this RFQ or any part of it at any time. The Contracting Officer reserves the right to reject any and all quotations and to waive any information, or minor irregularities in quotations received.
A written notice of award and/or Purchase Order, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
