AMENDMENT 0001

AMENDMENT 0001

I. CORRECTIONS TO THE SOLICITATION

Please make the following corrections to the solicitation documents, as posted.

1. Section 00 00 00, paragraph 11 states the NAICS as being 238220 – Construction by Specialty Trade Contractors. Please correct to read: 236220 – Commercial and Institutional Building Construction.

2. References to Women-Owned Businesses in the RFP should be deleted in its entirety. It is not applicable to this procurement.

3. The Bonding requirement for the solicitation is reduced from $20M to $10M, but bonds are required for the value of each Task Order issued.

4. Correct the Information for Offerors, #7. CONTENT OF PROPOSALS, c. 2) as follows:

a. Volume III-Safety, there is a 2-page limit for the Technical Approach narrative.

b. Project Information Forms are submitted once in Volume II, Part B using the form at Attachment I.

Delete all references to Volume II, Part E.

c. Bid Bonds are only required for Volume VI, Part B. Delete references to submit with Volume VII.

d. Delete all references to TABs.

e. Delete all references to 2-sided pages.

5. The City Cost Indexes (CCI) to be used for installations under this requirement are as follows:

• Naval Air Station Patuxent River will use Waldorf, MD

• Naval Support Facility Dahlgren will use Fredericksburg, VA

• Naval Support Facility Indian Head will use Waldorf, MD

• Naval Support Activity U.S. Naval Academy will use Annapolis, MD

6. Delete FAR Clause 52.215-1 Alt I Instructions to Offerors-Competitive Acquisition (Jan 2017) Alternative

I.

7. Section 00 70 00 CONTRACT ADMINISTRATION DATA, Paragraph 21. Delete paragraph and replace with the following:

FAR 52.252-2 CLAUSES INCORPORATED BY REFERENCE (FEB 1998)

This contract incorporates clauses by reference in the same force and effect as if they were given in full text. Full text of a clause may be accessed electronically at this address: http://www.acquisition.gov .

II. REQUEST FOR INFORMATION (RFI) 1

1. Since this JOC serves multiple geographically dispersed locations, would the Government please provide a breakdown for the amount of work anticipated at each site?

GOVERNMENT RESPONSE: At this time, we do not have a list of anticipated work at each site, since this is a NEW requirement. However, we anticipate the preponderance of work will be in the following order:

NAS Patuxent River NSF Indian Head NSA Annapolis NSF Dahlgren

2. The NAICS stated on the SF 1442 is 236220 – Commercial and Institutional Building Construction. Later in paragraph 11 of Section 00 00 00, it states the NAICS as being 238220 – Construction by Special Trade Contractors. The limitations of subcontracting requirements for these two NAICS are different. Please confirm if this contract will be awarded under the 236220 NAICS with a 15% self-performance requirement.

GOVERNMENT RESPONSE: The reference to 238220 was an error in the solicitation. This contract will be awarded under NAICS 236220 with a 15% self-performance requirement.

3. The solicitation submittal requirements for Subfactor 1b state that Offerors are to demonstrate they self-performed at least 50% or more of the work on each of the 3-5 projects submitted (not just oversight). We feel this will unduly limit competition as JOC contracting by nature typically involves a GC supported by a multitude of specialty trade subcontractors to provide rapid response for a wide-range of project types and construction trades in a cost effective manner. Further, the limitations on subcontracting for NAICS 236220 requires only 15% self-performance. Please consider changing this requirement to demonstrate 15% self-performance for each of the submitted projects.

GOVERNMENT RESPONSE: The FAR requires that the Government insert FAR Clause 52.219-14 Limitations on Subcontracting (Deviation O0008) for all 8(a) awards. The procuring Agency (NAVFAC Washington) determines whatever experience requirement is necessary to perform the requirement. This agency has determined that the experience needs to be a General Contractor that can self-perform to cut down on overhead costs, to add flexibility when scope changes or corrections are required, and to better meet the overall requirement. The two requirements do not have to match.

4. Item 4) states, “The current edition of the MEANS Cost Data software shall be used in each year of the contract, including the most current quarterly updates for all costs.” Item 5) states, “As each new MEANS Cost Data software is released, it will be used for all pricing within that year, including quarterly updates.

For example, if the base year occurs in 2018, the 2018 edition shall be used with the most up to date quarterly update; upon release of the 2019 edition, all subsequent work shall be priced using the 2019 edition (and current quarterly update), until the next edition is released.” Are these references to “quarterly updates” in regards to the CCI?

GOVERNMENT RESPONSE: Yes, the quarterly updates are a reference to the RS Means City Cost Index (CCI).

5. The requirements for Superintendent, SSHO, and QCM are followed by an asterisk stating, “Consult with the local construction office to determine the ability for the [Superintendent/ SSHO/QCM] to perform multiple roles on the specific TO based on the hazards of the project, job complexity, size, and any other pertinent factors.” Offerors are instructed to include the costs for these positions in our coefficient.

However, in paragraph 9 it states that these costs are to be included in our proposal and negotiated for each TO. In order for Offerors to correctly capture labor costs in their coefficients, please provide clarification regarding the circumstances allowing a position to be dual or triple hatted.

GOVERNMENT RESPONSE: Refer to the Solicitation SECTION 00 70 00 CONTRACT REQUIREMENTS, Part 2.B.9. The "Enhanced Oversight Requirement" table on Pg. 82 clarifies the conditions under which enhanced requirements for Superintendents, SSHO, and QCM will be in effect.

The Enhanced Oversight option was requested to be added by the NAS Patuxent River office.

6. This section of the RFP states, “In accordance with the provisions of FAR 52.219-14 Limitations on Subcontracting, in the case of a contract for general construction, the concern will perform at least 15 percent of the cost of the contract with its own employees (not including the cost of materials).”

It then goes on to state, “In accordance with the provision at FAR 52.219-30 Notice of Set-Aside for, or Sole Source Award to, Women-Owned Small Business Concerns Eligible Under the Women-Owned Small Business Program (MAR 2020), means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.” This provision is not applicable to this RFP which is set aside for 8(a) Small Disadvantaged Businesses.

It also states, “Since the contract is for a specialty trade, the concern will perform at least 25% of the cost of the contract with its own employees (not including cost of materials).” This is a contradiction to the first paragraph citing at least 15% self-performance. Please provide clarification on the self-performance requirement and the NAICS code for this contract.

GOVERNMENT RESPONSE: This is not a specialty trade contract. This Contract will be awarded under NAICS 236220 with a 15% self-performance requirement.

7. The RFP states, “Contract task orders may be issued on the date the contract becomes effective. The contractor is required to be fully staffed and operational 15 days after the effective date of the contract. The contractor shall provide a balanced work force as needed to accomplish work required under contract task orders issued.” Does the Government provide any on-base office space for the awardee? Does the Government expect the awardee to be fully staffed at all service locations of the contract?

GOVERNMENT RESPONSE: The Government does not provide any on-base office space for the Awardee. The Government expects the Awardee to have a flexible and adequate work staff to complete projects simultaneously at multiple bases. There may not be work ongoing at all sites at one time. When there are multiple Task Orders issued, it is the Government’s expectation that the Contractor will be able to commence them within 15 days of award, and have adequate staff to complete the work within the prescribed time limits.

8. The RFP states, “The City Cost Index (CCI) is a multiplier used to adjust construction costs to a particular geographic location. Bare costs in the UPB represent the U.S national average. To adjust costs to a particular geographic location, the Weighted Average CCI is applied to the bare cost. The CCI for Patuxent River, MD shall apply to all work under this contract. CCI rates are found in the Reference Section of the R.S. Means Cost Data Book.” Patuxent River, MD does not have a CCI listed in the Reference Section of the RS Means Cost Data book. Can you please advise which CCI should be utilized for this contract?

GOVERNMENT RESPONSE: The CCI will be used for each geographic location of the installation. In the case that one is not available in the Reference Section of RS Means, the CCI that will be used will be one that the installation uses. For example, for NAS Patuxent River and NSF Indian head the CCI used will be that of Waldorf, MD. The CCI to use for each installation under this contract has been added to the Solicitation via this Amendment.

9. This solicitation includes “52.219-14 LIMITATIONS ON SUBCONTRACTING,” which appears on page

117. Subcontracting limitations for purposes of general construction are: “General construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities.” (52.219-14(e)(3)) This is a 15% self-performance requirement for this contract.

Additionally, page 42 states, “Offerors are still expected to meet the limitation on subcontracting thresholds for 8(a) firms in a construction environment.” This threshold is also 15%.

However, on page 39 the solicitation states the following under ii Subfactor 1b, Corporate Experience:

“Work must also demonstrate self-performance on at least 50% or more of each project submitted” and “The Offeror must demonstrate it self-performed at least 50% or more of each project submitted (not just oversight).”

Because this is heavy construction and under 8(a) regulations, the 50% self-performance requirement on page 39 appears to be incorrect. Please clarify that the self-performance requirement for Corporate Experience should be 15% to be consistent with the SBA 8(a) regulations and 52.219-14(e)(3)) which are included in this solicitation.

GOVERNMENT RESPONSE: See the response to Question #3. This is not a heavy construction project.

10. City Cost Index (CCI) is identified as Patuxent River, MD. RS Means does not have a CCI for Patuxent River, MD in their data. Previously, on other similar IDIQ JOCs the Patuxent River CCI was noted as

1.09. Is 1.09 the CCI the contractor is to use for Patuxent River, MD, or will another CCI be used for the contract?

GOVERNMENT RESPONSE: The CCI will be used for each geographic location of the installation. In the case that one is not available in the Reference Section of RS Means, the CCI that will be used will be one that the installation uses. For NAS Patuxent River will be that of Waldorf, MD. Also, see the response to Question #8.

11. Basis for Award, on page 15, states, “The Lowest Price Technically Acceptable process is appropriate for this acquisition.” However, effective October 1, 2019, the U.S. Department of Defense (DOD) issued a final version of a rule that restricts DOD agencies’ use of lowest-price technically acceptable (LPTA) procurements. See DFARS 215.101-2-70.

This final rule implemented sections of the National Defense Authorization Acts (NDAAs) for FY 2017 and 2018. The 2017 NDAA established the original policy requiring that DOD avoid using LPTA evaluations when doing so would deny DoD the benefits of cost and technical tradeoffs. The 2018 NDAA reiterated DOD's preference for best value source selection and added two conditions to the original six set forth in the 2017 NDAA.

The governing regulations are found in DFARS 215.101-2-70(a)(1), and they require that these eight conditions must be met before LPTA source selection procedures can be used in any DOD procurement, including this one:

1. Minimum requirements can be described clearly and comprehensively, and expressed in terms of performance objectives, measures, and standards that will be used to determine the acceptability of offers;

2. No, or minimal, value will be realized from a proposal that exceeds the minimum technical or performance requirements;

3. The proposed technical approaches will require no, or minimal, subjective judgment by the source selection authority as to the desirability of one offeror's proposal versus a competing proposal;

4. The source selection authority has a high degree of confidence that reviewing the technical proposals of all Offerors would not result in the identification of characteristics that could provide value or benefit;

5. No, or minimal, additional innovation or future technological advantage will be realized by using a different source selection process;

6. Goods to be procured are predominantly expendable in nature, are nontechnical, or have a short life expectancy or short shelf life;

7. The contract file contains a determination that the lowest price reflects full life-cycle costs of the product(s) or service(s) being acquired (see FAR 7.101); and

8. The contracting officer documents the contract file describing the circumstances justifying the use of the lowest-price technically acceptable source selection process.

Has the Source Selection Authority for this solicitation determined that these conditions have been met, including documenting the file by describing the circumstances justifying the use of LPTA approach in this source selection process?

GOVERNMENT RESPONSE: Yes, the Source Selection Authority for this solicitation determined that these conditions have been met. The LPTA Approach has been reviewed and is considered appropriate for this requirement.

12. With project sizes ranging from $2000 to $2,000,000, is $20M in aggregate bonding Required. Would NAVFAC consider revising the aggregate bonding amount to $10,000,000?

GOVERNMENT RESPONSE: Yes. The aggregate Bonding requirement for this solicitation is reduced from $20M to $10M, but bonds are required for the value of each Task Order issued.

13. Page 133 – Performance of Work by the Contractor requires that work equivalent to at least fifty (50) percent of the total amount of work to be performed under the contract shall be performed by the prime contractor. This is contradicted by the Limitations on Subcontracting requirement under NAICS 236220, requiring 15%. Please confirm that the prime contractor will be required to perform 15% of the cost of contract performance incurred by personnel.

GOVERNMENT RESPONSE: Please see the response to Question 3.

14. Page 5 – Section 11 references NAICS 238220-Construction by special trade contractors, requiring 25% of the cost of contract performance incurred for personnel will be performed by the prime contractor.

However, this contract, as noted on the SF1442, will be awarded under NAICS 236220, requiring 15%.

Please confirm that this contract will be awarded under NAICS 236220 and will require 15% of the cost of performance by personnel to be performed by the prime contractor.

GOVERNMENT RESPONSE: Yes. Please see response to Question 9.

15. Page 5 – Statement of Work lists NSA US Naval Academy as a Work Location under this contract.

However, the SF1413 and other areas of the solicitation only list NSA Patuxent River, Indian Head and Dahlgren. Please confirm if NSA US Naval Academy at Annapolis is included in this contract.

GOVERNMENT RESPONSE: This requirement was originally slated to cover NAS Patuxent River, NSF Indian Head (Maryland), and NSF Dahlgren, VA for NRDE Customers only. Due to anticipated use and changing requirements, the area of responsibility is expanded to include non-NRDE Customers at NAS Patuxent River, NSF Indian Head, NSA Annapolis, and NSF Dahlgren.

16. Page 98 – Individual Task Order Bonding Requirements stipulate the task order thresholds for payment bonds and payment and performance bonds. Since historically the JOC contracts produce a high volume of lower dollar value task orders, will the government accept a blanket bond for all work performed on the contract?

GOVERNMENT RESPONSE: No, the Government will not accept a blanket bond for work performed on individual task orders. Bonding approval and oversight remains with the Ordering offices.

17. Page 72 – Please confirm that the CCI for Patuxent River will be applied to all locations under this contract.

GOVERNMENT RESPONSE: No. The CCI will be used for each geographic location of the installation. In the case that one is not available in the Reference Section of RS Means, the CCI that will be used will be one that the installation uses. The CCIs for the installations covered by this contract are as follows:

• NAS Patuxent River will use Waldorf, MD

• NSA Indian Head will use Waldorf, MD

• NSF Dahlgren, VA will use Fredericksburg, VA

• NSA Annapolis, MD will use Annapolis, MD

18. Page 81 – Please confirm that the intent of the enhanced requirements is by request only and is not included in the submitted coefficient. This additional level of Supervision will be included in the RS Means line items on a task order basis.

GOVERNMENT RESPONSE: Yes, the intent of the enhanced requirements is by request only and is not included in the submitted coefficient.

19. Page 30 – Database Registration Requirements require that the Offeror must be a participant in the SBA-certified 8(a) Program. Upon receipt of the proposal, the Offeror must be registered in SAM and self-certified as an 8(a) concern in SAM. SAM does not allow an entity to self-certify as 8(a), but can self-certify as a Small Disadvantaged Business. SAM does not recognize an entity as 8(a) until it holds an 8(a) contract and is certified through the SBA. If the Offeror is a JV and is eligible to be an 8(a) concern being that the JV has a majority JV partner that is a certified 8(a) concern, is this acceptable?

GOVERNMENT RESPONSE: Only SBA can designate an entity, including JVs, as 8(a). SBA’s database information flows into SAM.gov. The Government (NAVFAC Washington) will defer to SBA on the JV’s 8(a) designation, which must be received before the vendor will be considered for award.

This is a newly required process that may slow the award, unless the entity is already identified as an 8(a) JV in SAM.gov.

20. The corporate experience section is requesting projects that are demonstrating 50% self-performance.

What FAR clause is requiring 50% self-performance for this NAICS code?

GOVERNMENT RESPONSE: See the response to Question #3.

21. The corporate experience section is requesting projects that are demonstrating 50% self-performance. If this self-performance is required, can the experience of a subcontract proposed with the prime be used for the experience section?

GOVERNMENT RESPONSE: Yes. In accordance with updates to 13 CFR, small business firms may utilize their similar-suited subcontractors’ experience as their own – as long as that same subcontractor is going to participate on this requirement. A commitment document from that subcontractor should accompany the proposal.

22. Solicitation N4008022R0042 has an included specification section that includes a chart of applicable specification sections. We have not found a specification section for this solicitation. Is there one available?

Under that specification section in the N4008022R0042 solicitation, there is a chart that listed specifications that would be carried under that solicitation. If that specification section listing all of the same specs is included in this solicitation, how will NAVFAC use these two contracts to determine where a task order will be placed? In essence, the general construction contract can accomplish all of the contract work anticipated under this civil contract. What are the determining factors to have the general construction contract or the civil contract perform a task order?

GOVERNMENT RESPONSE: The Government’s Contracting Offices covered by this contract will decide what task orders to issue under the requisite contract, based on the scope of work for each requirement.

23. Are there any geographical restrictions for the 8(a) contractor to have a bonafide office in the region?

GOVERNMENT RESPONSE: No.

24. Will the Government provide an onsite location for an office trailer at each site?

GOVERNMENT RESPONSE: No. See the response to Question 7.

25. On page 68 of 202, Item 6, “This contract is being awarded with estimated quantities. The government reserves the right to issue a modification to the contract if the quantity increases or decreases during the contract period of performance. Additions or deletions of quantities will be at the line item unit price.”

These quantities are not identified in the contract documents. Where are they found?

GOVERNMENT RESPONSE: This is a Job Order IDIQ contract. The exact quantities for each project will be determined at task order level.

26. ELINs are listed in this section. Where are any required ELINs?

GOVERNMENT RESPONSE: See CONTRACT REQUIREMENTS, Paragraph 2 in the solicitation provides CLINS for Pre-Priced Line Items (000101) and Non Pre-Priced Line Items (000102), which is how you will price Task Orders. As a JOC contracts, RS means line items are primarily used for pricing.

27. This section states the use of NAICS code 238220. This is a general construction contract. NAICS code

236220 is listed in the SF1442. Which code is correct? Once that code is established please alter the prime contractor’s required percent subcontract that cannot be exceeded.

GOVERNMENT RESPONSE: Please remove all references to 238220, which was included in error.

Please see the response to Question #2.

28. RFP states: Title page of the proposal must show “…Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority…” What is considered to be/acceptable as “ evidence” of that agent's authority”?

GOVERNMENT RESPONSE: Acceptable evidence would be a Certification Statement as the Agent Authority or a statement from the CEO of the company on company letterhead, giving that person decision authority for any ensuing contract.

29. RFP states: “Each volume shall contain a more detailed table of contents to delineate the subparagraphs within that volume. Tab indexing shall be used to identify sections.” Please confirm a detailed Table of Contents is to be included in Volumes I-VII. What ‘tab indexing’ is to be used to identify sections as this will be an electronic submittal?

GOVERNMENT RESPONSE: The Table of Contents should mirror the Table submitted under Proposal Submission Requirements (as corrected in this Amendment). There are no TAB requirements, since proposals are required to be electronic. Please disregard all references to TABs.

30. RFP states: The Offeror shall use a standard page numbering system to facilitate proposal references.

Consecutive page numbering within volume parts is preferred, e.g., page I-2-5, indicates Volume I, Part 2, page 5. Charts, graphs, and other insert materials shall be page-numbered as part of the page numbering system.

Will consecutive page numbering to include only Volume and Page Number be acceptable, i.e. I-2 (volume and page) vs including Part number as well? Including Part number would require section breaks and loss of space to respond to requirements.

GOVERNMENT RESPONSE: Please refer to The UFGS section is on page 17.

31. Since this is an IDIQ contract, we really don’t know what specific subs we need. Can you please provide a list of trades you would like to see a letter of commitment from or remove the requirement? Can you send an example of the letter of commitment you would like to see?

GOVERNMENT RESPONSE: No. The commitment letter should be from a bonafide business, and shall state (on their letterhead) exactly the work that they have agreed to provide to the Offeror for THIS requirement. The letter should be signed and dated by a person with decision-making authority for the company. The letter should be verifiable.

32. Please confirm what to provide in Volume II Part B Subfactor 2 – Corporate Experience, if Attachment 1 is required in Volume II Part E Construction Experience Project Data Sheet.

GOVERNMENT RESPONSE: Project Data Sheets should only be provided for Volume II Part B.

Delete all references to Volume II Part E.

33. Please confirm Volumes I through VII are to be submitted separately as PDFs.

GOVERNMENT RESPONSE: Yes. Please refer to the Instructions to Offerors on how proposals are to be submitted to the Government.

34. Should the technical proposal and price proposal be submitted separately?

GOVERNMENT RESPONSE: Yes. Please refer to the Instructions to Offerors on how proposals are to be submitted to the Government.

35. Please confirm that no bid bond is required with the proposal submission.

GOVERNMENT RESPONSE: No Bond is required, but confirmation from the Offeror’s Surety of their aggregate Bonding capacity is required.

36. Will a separate site trailer be required for all locations after award of JOC contract?

37. Which column of the Facilities Construction Cost Data book is to be used, Total Bare cost or Total including Overhead and Profit?

GOVERNMENT RESPONSE: See page 67 or 68 of the solicitation. The coefficient should account for Overhead and Profit.

38. The corporate experience section is requesting projects that are demonstrating 50% self-performance. This requirement seems to be from a specialty trade contract, not a general construction contract. Can you confirm the requirement for projects for self-performance under this general construction contract?

GOVERNMENT RESPONSE: The 50% self-performance This is not a specialty trade contract. This Contract will be awarded under NAICS 236220, and the 25% self-performance will be in effect.

39. Are bond premiums to be included in the coefficient or reimbursed per job order?

GOVERNMENT RESPONSE: Yes. The Offeror’s coefficient shall account for a wide variety of risks of doing business that includes Bond Premium. Page 69 of attached RFP.

40. Please provide the historical annual volume for its job order contracts.

GOVERNMENT RESPONSE: There is no historical data. This is a new requirement.

41. Please provide quantity of job orders and what value range have been issued under the current contract?

GOVERNMENT RESPONSE: This is a new requirement.

42. Please provide the coefficients for the current job order contracts.

GOVERNMENT RESPONSE: This is a new requirement.

43. Please provide the Cost City Index to be used for all task orders under this contract.

GOVERNMENT RESPONSE: CCI rates are found in the Reference Section of the R.S. Means Cost Data Book. They have been updated per this Amendment, to show the CCI rate locality to be used for each installation.

44. Have any of the projects you performed under the current contract been “design-build”, meaning the JOC contractors were responsible for doing the design component as well as construction?

GOVERNMENT RESPONSE: This is a new procurement.

45. The requirement for the aggregate bonding is $20,000,000. Will a letter from surety bond agents suffice for this requirement?

GOVERNMENT RESPONSE: Yes. A letter from your Surety Bond Agent showing your aggregate bonding capacity would suffice.

46. 00 70 00 Contract Requirements, 2B3 (pg. 80): Please confirm the use of BareCost over O&P for the RS

Means as required under this contract. The purpose of the confirmation is that since the intent appears for this to be a general construction (contractor) contract and not a special trade contractors NAICS code, O&P is typically used as opposed to bare cost.

GOVERNMENT RESPONSE: The coefficient should account for Overhead and Profit.

48. 00 70 00 Contract Requirements, 2B3 (pg. 80): Similar IDIQ JOC solicitations issued by NAVFAC would establish a minimum coefficient in order to ensure that a fair and reasonable competitive range can be established. Is there one for this solicitation?

49. 00 00 00 General Requirements, 11 (pg. 5): Page 5 Paragraph #11 of the solicitation reads “NAICS code

238220-Construction by special trade contractors, it will not pay more than 75 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 75 percent subcontract amount that cannot be exceeded. At least 25% of the cost of the contract performance to be incurred for personnel will be spent on the 8(a) prime contractor’s employees.” Should this read “NAICS code 236220-Commercial & Institutional Building Construction, it will not pay more than 85 percent of the amount paid by the Government for contract performance, excluding the cost of materials, to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count toward the prime contractor’s 85 percent subcontract amount that cannot be exceeded. At least 15% of the cost of the contract performance to be incurred for personnel will be spent on the 8(a) prime contractor’s employees.” This would follow FAR 52.219-14 listed on page 117, otherwise they conflict.

GOVERNMENT RESPONSE: See the response to Question 2.

50. 00 21 16 Instructions to Offerors, 8D2b1ii (pg. 39): Subfactor 1b, Corporate Experience, self-performance is listed as 50%, this would also apply to NAICS 238220 and this solicitation appears to be for NAICS 236220 which by the FAR would require 15%. Please confirm the self-performance for the corporate experience for this solicitation is 15% of the contract requirements.

GOVERNMENT RESPONSE: References to 238220 are in error and are corrected as of this Amendment. The Self-performance should match that of 236220 and 15%.

51. 00 21 16 Instructions to Offerors, 8D2b1ii (pg. 39): Page 39, Section ii. Subfactor 1b, lists relevant construction projects shall have a final construction cost of $500,000 or more, although the contract states orders may be as low as $2,000.00. Can the lower limit of $500,000 be lowered to $100,000 to show a broader range of experience that would be more relevant to the Task Orders issued on this contract?

GOVERNMENT RESPONSE: No. All General Contractors should be able to complete projects below $500,000. We are interested in how Offerors performed the projects of greater value, which require more management skills and have greater risks.

52. 00 70 00 Contract Requirements, 2B9 (pg. 82): Please provide bracketed schedule showing the estimated task order size and percentage of quantity in those ranges of anticipated task order for a yearly basis. IE- Ranges: $2,000-100,000, $100,000-500,000, $500,000-1,000,000, 1,000,000-2,000,000). This is needed in order to accurately develop a coefficient to encompass the staffing requirements listed on page 82 of the solicitation.

GOVERNMENT RESPONSE: As noted in the solicitation, this is a NEW requirement. We do not have data to provide the estimates requested.

53. 00 21 16 Instructions to Offerors, 8D Factor 3 – MANAGEMENT APPROACH: Page 42 3. Factor 3

“Offerors shall include an unequivocal Letter of Commitment signed by each of its major subcontractor(s) in its proposal submission” since this is a general construction JOC, the list of subcontractors, due to all the varying trade requirements on the task orders, can be extremely lengthy. If still required, to what extent shall be required to be provided? How will this fit into the page limitation?

GOVERNMENT RESPONSE: If the contractor is a self-performing contractor, there would be a limited amount of subcontractors associated with their ability to complete work under this NAICS. For additional Letters of Commitment, they can be provided under Volume VII, Other Relative Documentation.
