AMENDMENT 0001

Amendment 0001

1. The Proposal Due Date is hereby extended to 10:00 AM on 28 October 2021. All proposal due dates have been updated to reflect this change.

2. Responses to the RFI’s are attached.

3. DFARS Clause 252.223-7999, Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors (Deviation 2021-O0009) (OCT 2021) is added to the contract. The full text of the contractual clause is included below.

252.223-7999 ENSURING ADEQUATE COVID-19 SAFETY PROTOCOLS FOR FEDERAL CONTRACTORS

(DEVIATION 2021-O0009) (OCT 2021)

(a) Definition. As used in this clause –

United States or its outlying areas means—

(1) The fifty States;

(2) The District of Columbia;

(3) The commonwealths of Puerto Rico and the Northern Mariana Islands;

(4) The territories of American Samoa, Guam, and the United States Virgin Islands; and

(5) The minor outlying islands of Baker Island, Howland Island, Jarvis Island, Johnston Atoll, Kingman Reef, Midway Islands, Navassa Island, Palmyra Atoll, and Wake Atoll.

(b) Authority. This clause implements Executive Order 14042, Ensuring Adequate COVID Safety Protocols for Federal Contractors, dated September 9, 2021 (published in the Federal Register on September 14, 2021, 86 FR 50985).

(c) Compliance. The Contractor shall comply with all guidance, including guidance conveyed through Frequently Asked Questions, as amended during the performance of this contract, for contractor or subcontractor workplace locations published by the Safer Federal Workforce Task Force (Task Force Guidance) at https:/www.saferfederalworkforce.gov/contractors/.

(d) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (d), in subcontracts at any tier that exceed the simplified acquisition threshold, as defined in Federal Acquisition Regulation 2.101 on the date of subcontract award, and are for services, including construction, performed in whole or in part within the United States or its outlying areas.

(End of clause)

4. All other terms and conditions remain the same.

Responses to Requests for Information

1. Please confirm direct supervision per task order which may include Project Superintendent, QC Manager, and SSHO will be charged against the project in proportion to the contract requirements per task order magnitude and all overhead costs (PM and CA Staff) should be included in the coefficient only.

Response: The coefficient should include all necessary supervision per the magnitude of a task order between the amounts of $2K - $2M. If the local ordering office deems additional oversight is necessary then the task order will specify.

2. Please confirm a construction experience / past performance presented by a key subcontractor with an unequivocal letter of commitment can be utilized for compliance in Volume 2, Part E and Volume 5.

Response: The Offeror may utilize experience of a similar-suited subcontractor to demonstrate construction experience under this evaluation factor, but will be expected to meet the limitation on subcontracting thresholds outlined in FAR Part 19 for 8(a) firms. Contractual arrangements bound by an SBA Mentor/Protégé Agreement, a Joint Venture Agreement, or a Partnership Agreement are not considered Prime-Subcontractor arrangements; but are viewed as a single business entity.

3. Please provide a base amount to be utilized as in Exhibit K to show relative coefficient data. Example $25M.

Response: The Government used the below numbers. It is noted that the contractor is free to use another methodology in calculating the coefficient, as long as that information is provided to the Government to allow for review.

PRE-PRICED

COSTS

MATERIALS LABOR EQUIPMENT AMOUNT

RS MEANS BARE

COST (PRESUMED

ANNUAL

AMOUNT)

$15,750,000.00 $8,750,000.00 $500,000.00 $25,000,000.00

4. Please confirm only BARE COST is allowed as pre-priced RS means line items and the coefficient shall contain all other costs associated with subcontractor pricing as appropriate.

Response: Bare cost is to be used and O&P included in the coefficient.

5. Please provide definition of “Contingency allowances” that are to be contained within the coefficient.

Response: These are the risks that may result in any unexpected costs that can arise throughout a construction project.

6. Please provide definition of “Production of AutoCAD requirements” that are to be contained within the coefficient.

Response: This is minimal design (i.e. shop drawings) for new construction, repairs, rehabilitation, renovation and alterations of facilities.

7. Please provide definition of “Costs associated with utility scopes” that are to be contained within the coefficient.

Response: The coefficient is meant to include those costs not directly related to the project. This includes the costs not directly associated with the work and the associated overhead elements. This would be referring to power and water on the sites, if not provided by the Government.

8. Specifically which RSMeans cost data will the coefficient be based upon, i.e. Commercial New

Construction, Facilities and Commercial Renovation, etc.

Response: The coefficient will be applicable to all items awarded under the contract. It is the Offeror’s responsibility to research the available pre-priced line items in Means for use on individual orders.

9. On Page 40 of the solicitation, section Volume VI: Pricing lists “Bid Bond for contract minimum guarantee of $2,000.” On the same page, section Volume VII: Contract Documentation also lists “Bid Guarantee in the amount of $2,000 (contract minimum guarantee).” Please confirm which volume(s) we should include our bid guarantee in.

Response: Please include the bid guarantee under both sections. The bid guarantee is an evaluation factor within the price proposal, however, this section will be close hold and cannot be distributed to other parties. As such, a copy of the bid guarantee is requested in both sections.

10. On page 40 of the solicitation per section Volume VII: Contract Documentation, it lists that the Offeror shall provide the following information:

• Company Information Specific to the resultant contract

• Signed Standard Form (SF) 1442 with all amendments.

• Proof of registration in System for Award Management (SAM) and Online Representation and Certifications

• Other Relative Information

• Completed Forms

• VETS-4212 and/or VETS-4212A Report Submission Confirmation (or Statement of Non- Applicability) Bid Guarantee in the amount of $2,000 (contract minimum guarantee)

Please clarify what “Company Information Specific to the Resultant Contract” should be included within our Volume VII submittal

Response: This will be SAM Registration data showing the company’s or JV’s official name, the firm’s address, the associated DUNS and CAGE Codes.

Please clarify what you would like us to include for “Online Representation and Certifications and proof of registration in System for Award Management (SAM)”. In addition to completing the Section 00 45 00 Representations and Certifications section starting on page 70 of the solicitation, what would you like us to include as proof of registration in SAM?

Response: That is correct. Please provide a copy of your firm’s SAM Registration. The Government will verify the Representation and Certifications within the online system.

Please clarify what is meant by “Other Relative Information.” What other relative information should we include?

Response: This section is referring to any other pertinent information that the offeror feels may be necessary to meet the requirements of the section, such as possible pending items or the similar. Typically, though, the registration within SAM will suffice and no additional information will need to be provided.

Should a firm provide a proposal as a joint venture, SAM registrations from both component firms should be provided, if availably.

Please clarify “Completed Forms”. What additional completed forms are needed?

Response: This is referring to a fully completed representation and certifications section and a completed VETS-4212. Similarly to the above, a joint venture will required completed forms by the partner firms. No other information is required.

11. The Page limit for Volume VII- Contract Documentation section is listed as twenty (20) on page 41 of the solicitation.

We are concerned that the 20-page limit could easily be exceeded, depending upon the support documentation required. Section 00 45 00 Representations and Certifications section starting on page 70 itself is thirteen (13) pages.

Response: The page limitation is a guide to keep the section within a manageable length. The SAM Representations and Certifications is not required to be submitted if it is completed within SAM and will be pulled by the Government. This will not impact the page limits.

12. Where should we include Section 00 10 00 – Solicitation (CLINS pages 30 through 32 of the solicitation) in our proposal?

Response: The CLINS can be included under Volume VI, however, it is noted that the CLINS are for capacity purposes only and are fixed. The coefficients proposed will be the binding pricing used throughout the contract’s period of performance.

13. IDIQ/JOC solicitations often include a bonding level capability statement from their surety. Bidders must verify the bonding level capability as a condition of bidding the contract. Such capability statements often appear as “$15 million for single project and $30 million aggregate” or something similar. Is there a dollar-amount bonding capability level that bidders need to verify with the Government to assure the Government that they are able to provide sufficient bonding for the current, cumulative task orders?

Response: It is requested that firms show a cumulative bonding capability of the estimated annual amount of $10 million.
