CLAUSES INCORPORATED BY FULL TEXT
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
TECHNICAL ACCEPTABILITY (FACTOR 1). The quote must consist of written documentation to provide sufficient narrative and supporting data to address how the quote meets the minimum qualifications/requirements identified in the Performance Work Statement.
1.a. Corporate & Personnel Experience: Submit a summary of 3 recent projects that required the performance of similar requirements and deliverables. Recency is defined as projects completed within the past five (5) years of the date of issuance of this RFP. Relevancy is defined as projects performed for museums and/or other non-profit agencies; and that required deliverables similar to those required in this RFP.
1.b. Past Performance: This evaluation factor will consider how well the Offeror performed on relevant projects submitted under Factor 2 – Experience; and may also consider past performance on other projects currently documented in known Government sources (i.e. CPARS, FAPIIS, etc.) This evaluation may also be used for the Contracting Officer’s responsibility determination.
The following ratings will be used in evaluating each quote:
ADJECTIVE DEFINITION
Acceptable Quote clearly meets the minimum qualifications/requirements of the solicitation.
Unacceptable Quote does not clearly meet the minimum qualifications/requirements of the solicitation.
NOTE: To receive consideration of award, a rating of “Acceptable” must be achieved for all technical requirements.
PRICE (FACTOR 2) is not rated. Price and/or cost will be used to evaluate a Quoter’s price and the extent to which it is fair and reasonable. The relative order of importance of the non-cost/price evaluation factors when combined, are approximately equal to price. Award will be made to the lowest priced Responsible Offeror possessing all of the following characteristics:
1) Meets the acceptability standards for non-price factors,
2) Conforms to the solicitation,
3) Is from a prospective contractor who is responsible (as defined in Federal Acquisition Regulation Part 9), and;
4) Has a price that is determined to be fair and reasonable.
Technical and past performance, when combined, are equal when compared to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
