About this file

This document is a Justification and Approval (J&A) for an Exception to Posting on the Government Point of Entry (GPE) SAM.gov for 30 days for a firm fixed price contract to St. Johns Boat Company to overhaul the Navy Expeditionary Combat Command (NECC) Patrol Boat 34PB0815. The total value of the contract was $1,391,554.69. The authority to not post the solicitation for 30 days was due to unusual and compelling urgency, as delay would have resulted in serious injury to the government. The vessel was taken out of service and required modernization and upgrades to support its assigned mission. An initial plan to use an existing Indefinite Delivery/Indefinite Quantity (IDIQ) contract was not viable, so SERMC issued RFP N4002724R0012 on SAM.gov on September 25, 2024 with proposals due on September 27, 2024. Only one proposal was received. The Contracting Officer determined that the anticipated cost to the government would be fair and reasonable using the Independent Government Estimate and other than certified cost and pricing data.

JUSTIFICATION FOR AN EXCEPTION TO POSTING ON THE

GOVERNMENT POINT OF ENTRY (GPE) SAM.GOV FOR 30 DAYS

JUSTIFICATION

1. Contracting Activity.

The agency is the Naval Sea Systems Command (NAVSEA). The contracting activity is the Southeast Regional Maintenance Center (SERMC).

2. Description of the action being approved.

A firm fixed price contract to St. Johns Boat Company (STJBC), to overhaul Navy Expeditionary Combat Command (NECC) Patrol Boat

34PB0815.

3. Description of supplies/services.

A service life extension overhaul of NECC Patrol Boat 34PB0815.

This overhaul was essential to meet fleet schedules and operational readiness objectives for deployment and performance of the NECC mission. The total value of the contract was $1,391,554.69.

4. Exception to posting the acquisition on SAM.GOV for 30 days.

The authority which permits not posting the solicitation on SAM.GOV for at least thirty days is FAR 6.302-2(b)(2) - Unusual and compelling urgency. This authority applies when delay in award of a contract would result in serious injury, financial or other, to the Government.

NECC Patrol Boat 34PB0815 was taken out of service and the custodian, MSRON-10, placed the vessel in lay-up in preparation for the service life extension and modernization overhaul. The work package contained the most recent mechanical and technological equipment upgrades required for the vessel to accomplish its assigned mission tasking of providing security to high value assets.

J&A Number: N40027_24_0003

Because of the very short time frame in which to repair/overhaul the boat to return the boat to NECC for its assigned mission, an initial plan was to use an existing boat IDIQ contract to solicit/perform this procurement. On 24 September 2024, it was determined that the IDIQ was not exercised for this option year.

As such SERMC issued RFP N4002724R0012 on SAM.gov on September 25, 2024, 06:31 pm EDT with proposals due September 26, 2024, 04:00 pm EDT. No proposals were received.

On September 26, 2024, 04:28 pm EDT the proposal due date was revised to 2:00 PM SERMC Local Time, 27 September 2024. One proposal was received before the deadline.

On Friday September 27, 2024, as required per the NCH 53.215 Contracting by Negotiation, SERMC notified NAVSEA 024C of a One Offer situation on RFP N4002724R0012 for a ‘C’ type of contract for NECC Small Boat 34PB0815. Conditional approval was granted on 27 September 2024. The condition for approval was for SERMC to provide proof of synopsis after award.

Based on the above, and as authorized by FAR 6.302-2(b)(2) it was determined that the publicizing and response requirement of allowing for a 30-day response time for receipt of bids or proposals from the date of issuance of a solicitation was unattainable due to the urgency of the requirement.

5. Determination that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer will determine fair and reasonable pricing using the Independent Government Estimate and other than certified cost and pricing data.

6. Other facts supporting the justification for not posting on the Government Point Of Entry (GPE) SAM.GOV for 30 days

The RFP was posted on SAM.gov as a Small Business Set Aside to solicit sources capable of supporting an overhaul on NECC Small Boat 34PB0815. Prospective offerors were required to possess an Agreement for Boat Repair (ABR). Because delays associated with synopsizing and posting IAW the FAR would have resulted in a delayed performance period, and impacted Navy NECC mission, the requirement was not synopsized as required by the FAR.

Specifically, these vessels are required to complete a service life extension and modernization overhaul availability every 6 years. Vessel 34PB0815’s last overhaul/maintenance availability was conducted in 2016. The FY22 and FY23 maintenance

J&A Number: N40027_24_0003 availabilities for this vessel were cancelled due to funding shortfalls.

Due to the contractor furnished material (CFM) required to support the service life extension and modernization overhaul, the contract needed to be awarded NLT 30 September 2024 to support the long lead time material requirements. This award date would thereby support availability completion NLT date of 30 January 2026 followed by mission tasking in the second quarter of FY26. If award was not made by 30 September 2024, LLTM ordering would have been delayed and vessel 34PB0815 would have a high risk of missed mission tasking scheduled for the second quarter of FY26. There are no other boats that could have taken on this tasking.

7. Actions, if any, the agency will take to remove or overcome any barriers that led to restricted consideration before any subsequent acquisition for supplies and services is made.

As the root cause for not posting the solicitation for 30 days on SAM.GOV was due to not exercising the IDIQ for the current option year, there was not a specific barrier to remove.

However, instructing the customer to identify similar future requirement earlier to meet the synopsis and posting requirements will avoid curtailing the process in the future.
