SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
A. SPECIAL REQUIREMENTS
REQUESTS FOR SPECIFICATION CLARIFICATIONS:
Offerors are expected to reach a reasonable understanding of the requirements of the solicitation by careful examination and study of the schedule, the applicable work package and by the application of qualified knowledge and experience. In the event that such study and examination establishes a need for correction or clarification, such information should immediately be brought to the attention of the Contracting Officer so official dissemination of such information to all offerors may be made prior to submission of offers.
Requests for clarification shall be sent to the Contracting Officer no later than 14 MARCH 2014, 1600 (EST) in order to allow the Government sufficient time to prepare and issue answers.
RMC L-2-0003 PREAWARD SURVEY (RMC)
The Government reserves the right to conduct a pre-award survey or to require other evidence of technical, production, managerial, financial, and similar abilities to perform prior to the award of a contract.
RMC L-2-0008 WORK AT A GOVERNMENT INSTALLATION (RMC)
If the Schedule requires work to be performed aboard ship while located at a Government installation, Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves as to all general and local conditions, including security requirements that may affect the cost of performing the work, in the event such information is reasonably obtainable. In no event will the failure to inspect the site constitute grounds for a claim after award of the job order/contract.
B. PROPOSAL SUBMITTAL REQUIREMENTS
1. GENERAL
A. Instructions: Offerors shall submit their proposals in accordance with the following preparation instructions. The Government encourages offerors to contact the Contracting Officer in writing in order to request an explanation of any aspect of these instructions. This acquisition will be accomplished in accordance with FAR Part 15 and is 100% small business set-aside, NAICS 336611.
The award will be based on a Lowest Price Technically Acceptable.
B. Time of submission: Proposals are due no later than _1400_ Eastern Time on 28 March 2014.
C. Packaging & Marking: Each volume is to be submitted in sealed boxes or envelopes. The outside of the package shall clearly indicate the offeror’s name and solicitation number. Originals may be shipped in the same boxes as the copies to eliminate excess shipping costs. However, originals shall be separately wrapped inside the container and be clearly labeled on the exterior of the packaging. For hand-carried proposals see RMC L-2-0019.

2. VOLUME I – PRICE PROPOSAL
A. Since adequate price competition is anticipated in response to this solicitation, cost or pricing data is not required with the initial proposal, although data other than certified cost and pricing data is required to ascertain that proposed prices are realistic, fair and reasonable. If only one proposal is received, the
Government may request cost and pricing data to determine that the proposed price is fair and reasonable.
B. Complete blocks 13, 14, 15, 16, 17 and 18 of the RFP Section A, SF 33 and blocks 8, 15 of the RFP
Section A, SF 30. In doing so, the offeror accedes to the contract terms and conditions as written in RFP
Sections A through K.
C. Complete the price proposal information on J-4 showing the total price of each specification item listed in the solicitation.
D. Insert proposed unit and extended prices in Section B for each Contract Line Item Number (CLIN) and
SLIN/ELIN (if any) including any/all option periods.
E. Complete the necessary fill-ins and certifications in Sections F, G and K. Section K shall be returned in its entirety. For Sections F and G, the offeror shall submit only those pages that require a fill-in.
3. VOLUME II TECHNICAL PROPOSAL
Offerors must provide the following information in order for the Government to determine technical acceptability.
(1) Provide documentation that demonstrates the Offeror has performed or is capable of performing three
(3) simultaneous task/deliver orders (TO/DO) to remove existing and install new interior Shpboard Decking.
This documentation must demonstrate that the Offeror has a minimum of six laborers, one quality assurance/safety specialist and one supervisor.
(2) Provide documentation the Offeror has a current, approved Quality Management System (QMS) in accordance with NAVSEA Standard item 009-04; or has submitted a QMS in accordance with NAVSEA
Standard Item 009-04 to the Government for approval.
(3) Provide a copy of a current certification signed by an independent certifying authority of the weight handling capacity of the crane that will be used for material handling on and off Navy vessels at Mayport Naval
Station.
(4) Provide the manufacturer’s recommendations for environmental controls and storage of all materials that will be used to accomplish all work under this contract. Provide a description of facilities that meet or exceed manufacturer’s recommendations for these materials..
(5) Provide documentation the Offeror has an approved EPA Identification Number and its Hazardous
Waste generator status (CSEG, SQG, or LQG).
HQ L-2-0001 ALTERNATIVES TO SPECIFICATIONS OR STANDARDS
(NAVSEA) (AUG 1994)
(a) The Department of Defense is committed to minimizing the incorporation of military and outdated federal and commercial specifications and standards in contracts and is seeking to use alternative, tailored or updated non-government specifications and standards to the maximum extent practicable to satisfy the requirements.
(b) This solicitation contains military, federal and non-government specifications and standards. To assist in the standardization of military/commercial specifications and standards and to enable the Government to evaluate current commercial practices, offerors are invited to propose (1) alternatives to those mandatory military, federal or commercial specifications and standards listed in this solicitation and/or (2) tailoring of mandatory military or federal specifications and standards identified in this solicitation.
(c) Offerors are invited to demonstrate whether the mandatory military, federal or nongovernment specifications and standards are advantageous to the Government and whether commercial specifications and standards or tailored specifications listed herein would meet the mandatory performance requirements specified in this solicitation.
Offerors should list below any commercial specification or standard and the specification or standard from the solicitation which it would replace. Any proposed tailored specifications should also be listed. Use additional pages as necessary.

A copy of any proposed alternative commercial specifications or standards as well as any tailored specifications and standards shall be included in the offeror's proposal. Rationale which describes the advantages of the proposed alternative shall also be included in the offeror's proposal as detailed in the paragraph entitled "Instructions to
Offerors" contained in Section L of this solicitation.
(d) The Government shall consider the alternative specifications and standards in meeting the solicitation requirements during the source selection evaluation. Evaluation criteria for alternative specifications and standards is contained in Section M of this solicitation. If the Government accepts the proposed alternative specifications and standards, the offeror's proposal may be incorporated into the resultant contract, either in whole or in part, at the
Government's discretion. It is requested that all recommendations be submitted within _14 days from the date of this solicitation. Acceptance by the Government of alternative specifications or standards does not obligate the
Government to conduct discussions under this solicitation.
HQ L-2-0003 FACILITY SECURITY CLEARANCE (NAVSEA) (SEP 1990)
(a) No award will be made to any offeror which does not possess a facility security clearance issued by the Defense
Investigative Service at the confidential level. SERMC will initiate appropriate security clearance action for any apparent successful offeror which does not already possess such clearance. The Government is not obligated to delay award pending security clearance of any offeror.
(b) The security classification of this procurement is specified in the Contract Security Classification Specification, DD
Form 254, attached hereto.
HQ L-2-0005 NOTIFICATION OF POTENTIAL ORGANIZATIONAL CONFLICT(S) OF INTEREST
(NAVSEA) (JUN 1994)
(a) Offerors are reminded that certain existing contractual arrangements may preclude, restrict or limit participation, in whole or in part, as either a subcontractor or as a prime contractor under this competitive procurement. Of primary concern are those contractual arrangements in which the Offeror provides support to , or related laboratories
(if applicable), in support of operation of the office or any of its programs. General guidance may be found in FAR
9.505; however, this guidance is not all inclusive. The Offeror's attention is directed to the "Organizational Conflict of Interest" (or similar) requirement which may be contained in current or completed contract(s) which prohibits the prime or subcontractor from providing certain supplies or services to the Government as described above during the period of the current "support" contract(s) or for a period after completion of the "support" contract(s).
Notwithstanding the existence or non-existence of an Organizational Conflict of Interest (OCI) clause or similar requirement in current or completed contract(s), the offeror shall comply with FAR 9.5 and identify whether an OCI exists and not rely solely on the presence of an OCI requirement.
(b) If a potential conflict of interest exists at any tier, each potential prime offeror is requested to notify the
Contracting Officer within 14 days of the date of this solicitation. The Offeror shall provide: (1) the contract number and name and phone number of the Contracting Officer for the contract which gives rise to a potential organizational conflict of interest; (2) a copy of the requirement; (3) the statement of work (or technical instruction) from the existing contract; (4) a brief description of the type of work to be performed by each subcontractor under the competitive procurement; and (5) any additional information the Contracting Officer should consider in making a determination of whether a conflict of interest exists. The Government may independently verify the information received from the offeror. Notwithstanding the above, the Government reserves the right to determine whether a conflict of interest exists based on any information received from any source.
(c) The Government will notify an offeror of any conflict of interest within 14 days of receipt of all required information. Those offerors deemed to have a conflict of interest may be ineligible for award. Failure to provide the information in a timely manner does not waive the Government's rights to make a conflict of interest determination.
The offeror is notified that if it expends time and money on proposal preparation, such expenditure is at its own risk that the Government will not determine that an organizational conflict of interest exists.
(d) Any potential prime contractor which proposes a subcontractor later determined to have a conflict of interest and deemed ineligible to participate in the current competition, may not be granted the opportunity to revise its proposal to remove the ineligible subcontractor. The Government reserves the right to determine which offerors remain in the competitive range through the normal source selection process.
(e) If the offeror determines that a potential organizational conflict of interest does not exist at any tier, the offeror shall include a statement to that effect in its response to this solicitation.
HQ L-2-0009 SMALL BUSINESS SUBCONTRACTING PLAN (NAVSEA) (JUN 1999)
Offeror shall submit as part of its proposal a written proposed subcontracting plan in accordance with the clause entitled "SMALL BUSINESS SUBCONTRACTING PLAN" (FAR 52.219-9). The plan shall include the
Congressionally mandated five percent (5%) goal for small disadvantaged business concerns or a detailed explanation as to why the goal cannot be included in the plan.
HQ L-2-0010 SUBSTITUTION OF PREVIOUSLY APPROVED SINGLE PROCESS INITIATIVE
(NAVSEA) (MAY 1998)
Your proposal shall identify where you are substituting your previously approved Single Process Initiative (SPI) processes for specified requirements. In addition, offerors should provide the information required by DFARS 252.211-
7005, paragraph (c).
HQ L-2-0012 USE OF NON-DEVELOPMENTAL ITEMS (NDI) (NAVSEA) (MAY 1993)
(a) Use of NDI is the preferred method of satisfying operational requirements of the Navy where such use does not degrade the operational or performance requirements. The term NDI means:
(1) Any item of supply that is available in the commercial marketplace;
(2) Any previously developed item of supply that is in use by a department or agency of the United States, a
State or local government, or a foreign government with which the United States has a mutual defense cooperation agreement;
(3) Any item of supply described in paragraph (1) or (2) that requires only minor modification in order to meet the requirements of the procuring agency; or
(4) Any item of supply that is currently being produced that does not meet the requirements of paragraph (1), (2), or (3) solely because the item:
(i) is not yet in use; or
(ii) is not yet available in the commercial marketplace.
(b) Offerors are encouraged to propose NDI or partial NDI alternatives to conventional R&D or MIL-SPEC production hardware or software requirements of this solicitation at all levels of the work breakdown structure (i.e., end-item, sub-system, component, piece part, etc.). All proposed NDI alternatives shall be clearly identified in the proposal. The intent of the NDI alternative is to provide the Navy with effective and economic solutions to its essential operational requirements.
HQ L-2-0014 NOTIFICATION OF USE OF NAVY SUPPORT CONTRACTORS
FOR OFFICIAL CONTRACT FILES (NAVSEA) (APR 2004)
(a) NAVSEA may use a file room management support contractor, hereinafter referred to as "the support contractor", to manage its file room, in which all official contract files, including the official file supporting this procurement, are retained. These official files may contain information that is considered a trade secret, proprietary, business sensitive or otherwise protected pursuant to law or regulation, hereinafter referred to as “protected information”. File room management services consist of any of the following: secretarial or clerical support; data entry; document reproduction, scanning, imaging, or destruction; operation, management, or maintenance of paper-based or electronic mail rooms, file rooms, or libraries; and supervision in connection with functions listed herein.
(b) The cognizant Contracting Officer will ensure that any NAVSEA contract under which these file room management services are acquired will contain a requirement that
(1) The support contractor not disclose any information;
(2) Individual employees are to be instructed by the support contractor regarding the sensitivity of the official contract files;
(3) The support contractor performing these services be barred from providing any other supplies and/or services, or competing to do so, to NAVSEA for the period of performance of its contract and for an additional three years thereafter unless otherwise provided by law or regulation; and,
(4) In addition to any other rights the offeror may have, it is a third party beneficiary who has the right of direct action against the support contractor, or any person to whom the support contractor has released or disclosed Protected Information, for the unauthorized duplication, release, or disclosure of such Protected
Information.
(c) Submission of a proposal will be considered as consent to NAVSEA's permitting access to any information, irrespective of restrictive markings or the nature of the information submitted, by its file room management support contractor for the limited purpose of executing its file room support contract responsibilities.
(d) NAVSEA may, without further notice, enter into contracts with other contractors for these services. Offerors are free to enter into separate non-disclosure agreements with the file room contractor. (Please contact Director, E
Business Division for contractor specifics.) However, any such agreement will not be considered a prerequisite before information submitted is stored in the file room or otherwise encumber the government.
RMC L-2-0002 PLANS, DRAWINGS, AND OTHER REFERENCE DATA (SERMC)
(a) Drawings, plans and test memos will be available through the following website:

(b) Manufacturers’ instructions manuals and equipment technical manuals concerning shipboard equipment are generally available aboard ship with some available for inspection by offerors at the following location during normal business hours:

(NAVSHIPS 0900-060-0210), and NAVSEA S9300-AW-EDG-010/EPISM (Electric Plant Installation-Standard
Methods) are also available for inspection by offerors at the above address.
RMC L-2-0006 SECURITY REQUIREMENTS AND DESTRUCTION OF CLASSIFIED MATERIAL
(a) If this solicitation involves classified defense information, the offeror must safeguard such information by clearly indicating on all material relating thereto the applicable classification marking as set forth in the Contract Security
Classification Specification (DD Form 254), if attached hereto (Section J), or other written notification, and by maintaining security controls in accordance with the provisions of the "Security Requirements" clause contained in this solicitation. If no offer is to be submitted or if the offeror receives notification that he is no longer being considered for award, the offeror must destroy all such classified material in accordance with the Industrial Security
Manual for Safeguarding Classified Information (Attachment to DD Form 441).
(b) Clearance for visit to Naval establishments will be handled in accordance with the provisions of the Industrial
Security Manual for Safeguarding Classified Information (Attachment to DD Form 441). Requests for visits to the
Regional Maintenance Center shall be forwarded to Code 190.
RMC L-2-0010 GOVERNMENT PROPERTY IN POSSESSION OF OFFERORS
This solicitation does not authorize the use, in performing the work under this solicitation, of any Government property except those items, if any, of Government furnished property specified in Section J. If the offeror or any anticipated subcontractor requires the use, in performing the work proposed under this solicitation, of any other items if Government property in their possession or otherwise, under a facilities contract or other agreement independent of this solicitation, then the offeror shall so state by submitting the following with the offer:
(a) A list of description of all Government property in possession of the offeror and his anticipated subcontractors proposed to be used in a rent-free basis under this contract, which property is accountable under other contracts.
(b) Identification of the facilities contract or other instrument under which the property is held, and the written permission of the Contracting Officer having cognizance of the property for use of that property.
(c) The months during which such property is to be available for use, which shall include the first, last, and all intervening months, and with respect to any such property which is to be used concurrently in performance of two or https://nesdr.nnsy.navy.mil/webjedmics/index.htm more contracts, the amounts of the respective uses in sufficient detail to support the pro-ration required by FAR
45.205, and
(d) The amount of rent, which would be charged for such use, computed in accordance with FAR 45.4, Contractor
Use and Rental of Government Property.
RMC L-2-0015 USE OF OZONE DEPLETING SUBSTANCES (AUG 93)
(a)In accordance with Section 326 of Pub. L. 102-484, the Department of Defense is prohibited from awarding any contract which includes a DoD-directed specification or standard that requires the use of a Class I ozone-depleting substance (ODS) or that can be met only through the use of such a substance unless such use has been approved by a senior acquisition official (SA)). The SAO approval is based on a technical certification that no suitable substitute for the ODS is currently available.
(b) To comply with this statute, the Navy has screened the specifications and standards associated with this solicitation. To the extent that ODS requirements were revealed by this review they are identified below:

(c) If offerors possess knowledge about any other Class I ODS required directly or indirectly by the specification or standards, the Navy would appreciate such information in your response to this solicitation. Offerors are under no obligation to comply with this request and no compensation can be provided for doing so.
RMC L-2-0019 HAND CARRIED PROPOSALS
All proposals being hand-carried must be delivered by the Contractor's representative to the bid box on the second floor of Southeast Regional Maintenance Center (SERMC), Building 1488, Massey Avenue, at Naval Station
Mayport. Proposals will not be accepted at any other location unless otherwise specified in the solicitation or an amendment to the solicitation.
All proposals must be secured in a sealed package clearly marked with the contractor's name and the Solicitation number and addressed to SERMC, Contracts Department.
Contractors must affix a date/time receipt to their proposal package available by the Bid Box outside the Contracts
Department, immediately prior to placing the proposal into the bid box.
Proposal packages that will not fit into the bid box will be turned over to personnel from SERMC Contracts
Department only. Proposals will not be accepted by personnel from any other department or the mailroom.
Application for access to Naval Station Mayport must be made through SERMC Security at least 48 hours prior to the time access is required to SERMC for delivery of contractor's proposal. Information regarding access is contained in clause RMC L-2-0006(b) and the below clause BASE ACCESS REQUIREMENTS. A proposal may be considered late if a contractor is unable to gain access to SERMC in order to hand-carry a proposal.
Prospective offerors shall refer all questions pertaining to security clearances and access to Naval Station Mayport to
SERMC Security Manager (904-270-5126, Extension 3294).
BASE ACCESS REQUIREMENTS
Individuals accessing the Naval Station with a Naval Station Mayport Contractor Activity Badge will have restricted and limited access while individuals that enroll in the RapidGate Program should have streamlined access to the
Installation.
Non-RapidGate Participant (Contractor Activity Badge):
1. Limited access onto the installation through Gate 5A (Commercial Gate).
2. One hundred percent mandatory vehicle inspection during each access.

2. Only subject to random vehicle inspections.
3. Access will be allowed during times needed to perform business on the installation.
4. Access for up to one year.
5. Ability to use the fast lane at the Pass and ID Office to pick up credentials.
This is an optional program. Access procedures for all personnel may change at any time due to installation requirements. For information regarding RapidGate Program, upcoming changes to security requirements, or to enroll, call RapidGate at 1.877.727.4342.
The Government is not responsible for any delay or disruption due to access into the installation.
