About this file
This amendment to a solicitation provides responses to contractor questions and extends the proposal due date for a hyperbaric systems support services requirement. The Naval Facilities Engineering Command requires support of hyperbaric systems and issues this solicitation seeking proposals. The amendment responds that only one seed task is included, provides scaled drawings for the seed task, and extends the proposal due date to July 1, 2021. Incumbent contractors held SeaPort-E contracts including task orders on various contract numbers. This requirement is for support of hyperbaric systems at Government installations.

The following have been added by full text:
AMENDMENT 0003
No. Reference Question Government Response
1. Section C.1.4
Section C.1.4 states “Previous acquisitions for this type of work were procured as competitive task orders under NAVSEA’s SeaPort procurement system”. It appears that the previous acquisition for this work was procured through NAVFAC EXWCs ACQ office, not SeaPort. Please provide the contract numbers for the incumbent contractors.
SeaportE contract numbers included many task orders on N00178-04-D-4140. Other contractor numbers have included N47408-04-D-8510, N39430-16-D-1831, N39430-16-D-1832.
2. L.4 Factor 1
Section L.4 Factor 1 refers to a second seed task “…and between the two provides a reasonable representation….”, and in paragraph (i) “…submit a technical proposal and CPM for each seed task.” ;
however, the solicitation only included a single seed task. Please clarify the reference to two.
There is only one (1) Seed Task Order. Please disregard any mentions of Seed Task #2.
3. Seed Task Order Specification 1.15
The seed task specification section 1.1.5 states, “Building drawings and specifications are available for review at the pre-proposal conference.” There is no mention of a preproposal conference in the solicitation. Please clarify both if there is a preproposal conference, and if there is not, how the contractor should approach pricing to the seed task.
The building is currently in the process of being built. There will be no preproposal conference.
Scaled layout drawings are attached. All interface points are identified in the specification. Please see Attachment I.
4. Seed Task Order Specification
Can the seed task building drawings and specifications be provided as part of the solicitation?
Scaled layout drawings are attached. All interface points are identified in the specification. Please see Attachment I.
5. The seed task is nearly identical to the seed task used in the 2016 solicitation for these same services. This would seem to provide an advantage to the incumbent contract holders since they will already have proposals for the seed task from that early effort. How will ACQ mitigate this advantage and ensure a level playing field?
This contract is being awarded as best value to the government. The seed task order is used in conjunction with the technical proposal for the Performance Work Statement to be evaluated.
6. Section C.3.0 “The Contractor shall provide the following documentation according to the delivery scheduled shown in Table 2 and in attachment 1 in Section J.”
Attachment 1 is not provided, and there is no table 2? Please clarify or provide the Attachment 1 and Table 2 specified.
In this section, the table being referenced is the Contract Data Requirements List (CDRL).
Table 2 is listed right below the statement.
Please disregard the mention of Attachment 1 in Section J.
7. Will the government extend the proposal due date to allow adequate time to review and respond to amendments issued with questions and answers?
A one (1) week extension has been granted.
Please submit your proposal by 2:00 PM PST Thursday, 01 July 2021.
N3943021R2305
8. Will the government exclude Attachment G: Safety Data Sheet from the page limitations? The Safety section is limited to three pages total, and the blank Attachment G takes up all three pages.
Attachment G: Safety Data Sheet is excluded from the page limitations required for Factor 3:
Safety.
9. Will the government allow electronic submission of proposals due to ongoing COVID-19 restrictions?
Section L.3 discusses electronic submission.
10. The Small Business Subcontracting Plan requirement refers to Attachment 1. Is it really Attachment A?
Please refer to Attachment E “Individual Small Business Subcontracting Plan.”
11. Is Construction Wage Rate Requirements statute (formerly Davis Bacon Act) invoked on this contract? Page 3, Section C.1.1 General states: “The equipment to be serviced under this contract is classified as equipment or supplies, vice construction. However, when work is being performed at Government installations much of the work is being performed by “laborers” and “mechanics” that are covered by the construction wage rate requirements.”
And page 28, Section I, Contract Clauses references several clauses relative to Construction Wage rates, including FAR 52.222-5, FAR 52.222-6, FAR 52.222-13, and FAR 52.222-30. However, the formal Construction Wage Rate Requirements statute (formerly Davis Bacon Act) FAR 22.403-1 is not listed.
P 19, 1.e. Wage Determinations may be incorporated into future Task Order as required by the Construction Wage Rate Requirements, and Page 26, H.4 WAGE DETERMINATIONS, MINIMUM
WAGE RATES FOR INDIVIDUAL TASK
ORDERS states that Wage Determinations may be incorporated into future Task Order as required by the Construction Wage Rate Requirements.
FAR 52.222-6 “Construction Wage Requirements” is the formal clause that prescribes the statute 40 U.S.C. chapter 31, subchapter IV, which is included in Section I – Contract Clauses. FAR 22.403-1 only summarizes the statute.
12. Are contractors allowed to modify the government’s spreadsheet. Specifically, can we add lines and/or adjust formulas to correspond with how we apply our burdens based on our company’s accounting disclosures?
Yes, contractors may modify the Government’s spreadsheet based on the company’s accounting disclosures.
SECTION A - SOLICITATION/CONTRACT FORM
The required response date/time has changed from 24-Jun-2021 02:00 PM to 01-Jul-2021 02:00 PM.
