Responses to the PPI will be provided by Amendment and will be posted to the PIEE solicitation Module (https://piee.eb.mil). Pre-proposal questions will be accepted ten (10) calendar days before the proposal due date, any inquiries made after that date may not be answered.
5. REQUIRED PROPOSAL DOCUMENTS
All items listed below are required for the offeror to be found responsive and the offer to be considered for award. Any unrequested information will not be considered as part of the offer and will not be reviewed.
1. The solicitation requires the evaluation of price and the following non-price factors:
Factor 1 – Corporate Experience Factor 2 – Safety Factor 3 – Past Performance
(A) Price Factor:
(1) Solicitation Submittal Requirements:
(a) STANDARD FORM 1442, SOLICITATION, OFFER, AND AWARD
The offeror MUST complete Blocks 14 through 20c.
In Block 14 provide a Point of Contact with a valid phone number and email address.
In Block 14, provide a Commercial and Government Entity (CAGE) Code (United States firm) or NATO Commercial and Government Entity (NCAGE) Code (non United States firm).

Offerors shall provide their Price Proposal in U.S. Dollars. Award will be made in U.S. Dollars, therefore, the offeror’s bank must be able to accept U.S. Dollars as payment.
(c) SECTION 00 45 00 - REPRESENTATIONS AND CERTIFICATIONS
The offeror MUST have an active registration with System for Award Management (SAM) at the time of proposal submission. If you do not have an active registration with SAM at the time of proposal submission, your proposal shall not be considered for award.

(d) SECTION 00 70 00 – CONTRACT CLAUSES
The offeror MUST fill in the tax relief exemption rate in DFARS252.229-7001 TAX RELIEF (APR 2020) provided in Section 00 70 00 of this solicitation and submit with their proposal (Attachment 3)
(2) Basis of Evaluation: The Government will evaluate price based on the total price, exclusive of the Value Added Tax (VAT) in DFARS 252.229-7001.
Total price consists of CLIN 0001; analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
(i) Comparison of proposed prices received in response to the solicitation.
(ii) Comparison of proposed prices with the Independent Government Estimate.
(iii) Comparison of proposed prices with available historical information.
(iv) Comparison of proposed prices with market survey results.
An evaluation and written determination concerning whether unbalanced pricing exists will be conducted in accordance with FAR 15.404-1(g). If unbalanced pricing exits, the Government will consider the risks of that unbalanced pricing in making the source selection decision.
The Government reserves the right to conduct a price realism analysis of proposed prices it considers to be unrealistically low. If the Government elects to conduct a price realism analysis, it may consider offeror(s)’ understanding of the work, ability to perform the work, or proposed prices received in response to the solicitation, in this analysis and risk assessment. An unrealistically low price may result in the offeror(s)’ proposed price being rejected and the offeror(s)’ proposal being ineligible for award.
Proposals will be evaluated in the following manner: The number of proposals that will be technically evaluated will initially be limited to the lowest priced proposal. If the lowest priced proposal is not found technically acceptable, the next lowest priced proposal will be evaluated. This process will be repeated until the Government identifies a technically acceptable proposal.
(B) NON-PRICE FACTORS:
The Technical Proposal includes the following factors:
(1) Factor 1, Corporate Experience:
(i) Solicitation Submittal Requirements: The offeror MUST provide a minimum of one (1) but no more than two (2) relevant projects for which the Offeror was the prime contractor, sub-contractor or Joint Venture partner.
For a project to be considered relevant, it MUST meet the following requirements:

2. New construction executed by Design-Build (MUST show experience in design or design management as well as construction); and
3. Similar in magnitude with a value of at least $450,000; and
4. Must be at least 70% complete within the last 10 years of the release date of this RFP.
A project is defined as a construction project performed under a contract. Relevant projects must prove experience in both design and construction in order to be considered acceptable for this factor.
If more than two (2) projects are submitted, only the two (2) most recently completed projects will be evaluated.
The Corporate Experience Contract Data Sheet (Attachment 4) must be used to submit Corporate Experience project information. Project descriptions for each project shall explain the detailed scope of work performed and the relevancy to the project requirements of this solicitation. Blocks 8, 9 and 10 from Attachment 4 can be continued on a separate page if additional information is required. For each submitted project, the offeror shall include the contract number, project location, project description, building size, an explanation of -similarity to the current solicitation, dollar value, ending date of the contract, the date the work was completed, and a client point of contact. Offerors must include sufficient information in their proposal to establish the relevancy of their submitted projects.
For each submitted project, the offeror shall include the following:
1. If the experience is for a United States Government contract include the contract number and the Government Point of Contact of the Contracting Office or the Contracting Officer Representative.
2. If the corporate experience is not with the US Government, or is a subcontract, the offeror shall provide:
- An electronic copy (PDF or photocopy) of the original contract or subcontract signed by all parties to include: Project title, location by physical project address or coordinates, award value converted into USD, beneficiary Point of Contact information, contract completion date, construction completion date, and a detailed copy of the scope or work translated into English,
- Pictures of the job site showing the construction sign or construction permit with the name, or logo, of the offeror clearly visible
Offerors must include sufficient information in their proposal to establish the relevancy of their submitted projects.
1. All submissions shall be in the English language, documents provided in another language will not be evaluated.
2. The total length for each project shall not exceed ten (10) pages, single sided, with a minimum font size of twelve (12). If more than ten (10) pages are submitted, only the first ten (10) pages will be evaluated.
3. All projects submitted that are outside of the specified time period indicated in paragraph (i) 3 above will not be considered relevant.
4. Proposals that fail to provide all requested data, an accessible point of contact, correct phone number and e-mail address, may result in the project not being evaluated or the project being found not relevant.
If the Offeror is a Joint Venture (JV), relevant project experience shall be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects should be submitted for one of the Joint Venture partners. Offerors are still limited to a total of two (2) projects combined
The offeror may utilize experience of a subcontractor that will perform major or critical aspects of the requirement to demonstrate construction experience under this evaluation factor. The Offeror must provide a letter of commitment and an explanation of the subcontractor’s role in the performance of this contract.
If an offeror is utilizing experience of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF 1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract in order for the project of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. The proposal shall state the specific commitments of technical resources (e.g. personnel, equipment that the affiliate/subsidiary/parent/LLC/LTD member companies commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/are of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the offeror in performance of the contract.
(ii) Basis of Evaluation: To receive an acceptable rating in this factor, the offeror MUST provide a minimum of one (1) relevant project meeting the following requirements:
The offeror must demonstrate experience performing at least one (1) relevant project as defined in the solicitation submittal requirements or one (1) relevant project for one of the Joint Venture partners without shared experience together. The assessment of the offeror’s relevant experience will be used as a means of evaluating the capability of the offeror to successfully meet the requirements of the solicitation. The Government will review a maximum of two (2) projects. An offeror will be rated UNACCEPTABLE if the offeror does not submit the minimum number of relevant projects (one (1)). Any projects submitted in excess of the two (2) for Corporate Experience will not be considered.
(2) Factor 2, Safety:
Solicitation Submittal Requirements: The offeror MUST submit:
1. The company’s Safety Narrative; and
2. The company’s SIGNED copy of the provided Safety Checklist Form, which is provided as
Attachment 5 to this solicitation.
Safety Narrative: The Safety Narrative shall describe the offeror’s safety management approach for its employees and subcontractors identifying the company’s commitment to safety and indicating how the offeror plans to properly manage and implement safety procedures for itself and its subcontractors. The Safety Narrative should pertain to this project solicitation and address specific safety hazards involved in the scope of work such as multiple project sites and/or high risk activities. It shall identify the authorities and responsibilities of the Site Safety and Health Officer (SSHO), as well as provide a plan describing how the offeror will implement a safe working environment for all levels of subcontractors.
The Safety Narrative shall be limited to four (4) pages, single sided. Any pages submitted in excess of the four
(4) page limitation will not be reviewed.
Safety Checklist Form: By signing the provided form the contractor is verifying that if awarded the contract, they will comply with the safety regulations, provide an acceptable safety plan within 30 days of contract award, appoint a competent employee as SSHO in accordance with this contract and the EM 385-1-1, and provide all required Personal Protective Equipment (PPE) to their employees.
Basis of Evaluation: The Government is seeking to determine that the offeror has a commitment to safety and that the offeror plans to properly manage and implement safety procedures for itself and its subcontractors. To receive an acceptable rating for this factor the offeror MUST provide:
1. The Company’s Safety Narrative and
2. The company’s SIGNED copy of the provided Safety Checklist Form.
The Safety Checklist Form is provided as Attachment 5 to this RFP. Failure to submit a Safety Narrative and a completed Safety Checklist with the proposal will result in a rating of Unacceptable and you will not be eligible to be awarded the contract without discussions.
(3) Factor 3, Past Performance:
(i) Solicitation Submittal Requirements: The offeror shall provide a past performance evaluation for each project submitted under Factor 1 – Corporate Experience. If a completed Contractor Performance Assessment Reporting system (CPARS) or DD2626 Performance Evaluation (Construction) is available, it shall be submitted with the proposal. If there is not a completed CPARS or DD-2626 evaluation available, then the offeror shall submit the Past Performance Questionnaire (PPQ) for each project included in Factor 1- Corporate Experience.
If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment 6), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Ms. Anna Gulewich, via email at anna.l.gulewich.civ@us.navy.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.
If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror shall complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, offerors should follow-up with clients/references to help ensure timely submittal of questionnaires.
If the evaluation is in other than English, provide a translation of the evaluation into English. Documents provided in a language other than English, without an English translation will not be evaluated.
The Government may review any other sources of information for evaluating past performance. Sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company /subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), and any other known sources not provided by the offeror.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.
Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Corporate Experience. Offerors may also address any adverse past performance issues.
Explanations shall not exceed four (4) pages in total.
Performance awards or additional information submitted will not be considered.
(ii) Basis of Evaluation: The Government is seeking to determine if there is a reasonable expectation that the offeror will successfully perform the required effort. The Government will evaluate the degree to which past performance evaluations and all other past performance information reviewed by the Government (e.g., PPIRS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (e-SRS), performance recognition documents, and information obtained from any other source) reflect a minimum of satisfactory performance considering:
- A pattern of successful completion of tasks;
- A pattern of deliverables that are timely and of good quality;
- How recently the tasks that are identical to, similar to or related to the task at hand were performed.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable”.
II. BASIS OF AWARD
1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest priced, technically acceptable offer.
2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest fair and reasonable evaluated price.
4. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.
III. REQUIREMENTS FOR OFFERORS
It is the responsibility of the offeror to register and obtain the following:
Commercial and Governmental Entity (CAGE) Code for U.S. firms NATO Commercial and Governmental Entity (NCAGE) Code for non U.S. firms.
(https://eportal.nspa.nato.int/AC135Public/scage/CageList.aspx) System for Award Management (SAM) registration to include a Unique Entity Identifier Code.
(https://www.sam.gov/SAM/) **Please contact the Federal Service Help Desk at https://www.fsd.gov/app/sam/ if you have any questions during the registration process**
1. ENGLISH SPEAKING REPRESENTATIVE
At all times when any performance of the work at the site is being conducted by any employee of the Contractor, the Contractor shall have a representative present on the site that is capable of explaining the work operations and receiving instruction in the English language. The Contracting Officer shall have the right to determine without appeal of such decision, whether the proposed representative has sufficient technical and lingual capabilities and the Contactor shall immediately replace any individual not acceptable to the Contracting Officer.
2. JOINT VENTURE REQUIREMENTS

The Joint Venture MUST be formed and valid at the time of submission of the proposal. The offeror MUST include the CAGE code or NCAGE code and Unique Entity Identifier Code of the JV on their proposal. The validated notarized legal document MUST include language that each member of the JV will be jointly and severally liable for the performance of the whole contract and will be incorporated into the contract award if award is made to the JV.
(a) Name of firms that form the Joint Venture and the name of the Joint Venture
(b) Name and title of the corporate officials signing in behalf of each party
(c) Solicitation number
(d) Description of the responsibilities in terms of work category for each partner
(e) The statement "The composition and structure of the Joint Venture will remain unchanged from award to one (1) year after the work has been finally inspected and accepted by the Government.”
(f) Date of issuance of the agreement and notarized signature of the corporate officials signing in behalf of each party.
(g) Statement under oath stating that the Joint Venture(JV) is in compliance at the time of proposal submission with all applicable laws, rules, and regulations. This statement MUST be signed under oath by all members comprising the Joint Venture.

52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE ACQUISITION (NOV 2021)
(a) Definitions. As used in this provision--
“Discussions” are negotiations that occur after establishment of the competitive range that may, at the Contracting Officer's discretion, result in the offeror being allowed to revise its proposal.
“In writing or written” means any worded or numbered expression that can be read, reproduced, and later communicated, and includes electronically transmitted and stored information.
“Proposal modification” is a change made to a proposal before the solicitation's closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.
“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer as the result of negotiations.
“Time”, if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.
(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of any amendment to this solicitation by the date and time specified in the amendment(s).
(c) Submission, modification, revision, and withdrawal of proposals. (1) Unless other methods (e.g., electronic commerce or facsimile) are permitted in the solicitation, proposals and modifications to proposals shall be submitted in paper media in sealed envelopes or packages (i) addressed to the office specified in the solicitation, and (ii) showing the time and date specified for receipt, the solicitation number, and the name and address of the offeror.
Offerors using commercial carriers should ensure that the proposal is marked on the outermost wrapper with the information in paragraphs (c)(1)(i) and (c)(1)(ii) of this provision.
(2) The first page of the proposal must show--
(i) The solicitation number;
(ii) The name, address, and telephone and facsimile numbers of the offeror (and electronic address if available);
(iii) A statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation and agreement to furnish any or all items upon which prices are offered at the price set opposite each item;
(iv) Names, titles, and telephone and facsimile numbers (and electronic addresses if available) of persons authorized to negotiate on the offeror's behalf with the Government in connection with this solicitation; and
(v) Name, title, and signature of person authorized to sign the proposal. Proposals signed by an agent shall be accompanied by evidence of that agent's authority, unless that evidence has been previously furnished to the issuing office.
(3) Submission, modification, revision, and withdrawal of proposals.
(i) Offerors are responsible for submitting proposals, and any modifications, or revisions, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that proposal or revision is due.
(ii)(A) Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or
(2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(3) It is the only proposal received.
(B) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(iii) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(iv) If an emergency or unanticipated event interrupts normal Government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(v) Proposals may be withdrawn by written notice received at any time before award. Oral proposals in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile proposals, proposals may be withdrawn via facsimile received at any time before award, subject to the conditions specified in the provision at 52.215-5, Facsimile Proposals. Proposals may be withdrawn in person by an offeror or an authorized representative, if the identity of the person requesting withdrawal is established and the person signs a receipt for the proposal before award.
(4) Unless otherwise specified in the solicitation, the offeror may propose to provide any item or combination of items.
(5) Offerors shall submit proposals in response to this solicitation in English, unless otherwise permitted by the solicitation, and in U.S. dollars, unless the provision at FAR 52.225-17, Evaluation of Foreign Currency Offers, is included in the solicitation.
(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.
(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.
(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.
(d) Offer expiration date. Proposals in response to this solicitation will be valid for the number of days specified on the solicitation cover sheet (unless a different period is proposed by the offeror).
(e) Restriction on disclosure and use of data. Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, shall--
(1) Mark the title page with the following legend: This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed--in whole or in part--for any purpose other than to evaluate this proposal. If, however, a contract is awarded to this offeror as a result of--or in connection with-- the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting contract. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and
(2) Mark each sheet of data it wishes to restrict with the following legend: Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.
(f) Contract award.
(1) The Government intends to award a contract or contracts resulting from this solicitation to the responsible offeror(s) whose proposal(s) represents the best value after evaluation in accordance with the factors and subfactors in the solicitation.
(2) The Government may reject any or all proposals if such action is in the Government's interest.
(3) The Government may waive informalities and minor irregularities in proposals received.
(4) The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
(5) The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit cost or prices offered, unless the offeror specifies otherwise in the proposal.
(6) The Government reserves the right to make multiple awards if, after considering the additional administrative costs, it is in the Government's best interest to do so.
(7) Exchanges with offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.
(8) The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
(9) If a cost realism analysis is performed, cost realism may be considered by the source selection authority in evaluating performance or schedule risk.
(10) A written award or acceptance of proposal mailed or otherwise furnished to the successful offeror within the time specified in the proposal shall result in a binding contract without further action by either party.
(11) If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(i) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(ii) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(iii) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(iv) A summary of the rationale for award.
(v) For acquisitions of commercial products, the make and model of the product to be delivered by the successful offeror.
(vi) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.
