All other terms and conditions remain unchanged.

D’ATTESTAZIONE (SOA) CERTIFICATION:

RFP requires, for the four work categories indicated, the Classification IV corresponding to works of amount equal up to Euro 2.582.000 (about $ 3,150.000). Since RFP provides for task orders of amount up to $1,000,000, the correct Classification should be Classification III (works of an amount equal up to Euro 1.033.000,00 about $ 1,260.000), as it was the case in the previous MACC solicitations. Such an increase could greatly limit the competition. Please confirm with urgency if the Government will correct the Classification and bring it to Classification III?

SOA Classification Categories have been corrected and now reflect Classification III. Reference paragraph 1 above for details.

2 In RFP Pg. 7, point b. (1) - 1.10 SOCIETA’ ORGANISMI

D’ATTESTAZIONE (SOA) CERTIFICATION:

refers to the possibility to use subcontractors to meet the qualification standard, this means that if we do not own one or more SOA categories, can we attach the SOA certificate of a subcontractor? Please Confirm.

The Italian Law does not allow to use of subcontractor's SOA certificate unless for some particular cases. As such, it is a consolidated practice in United States Government (GOV) solicitations to allow the contractor use the subcontractor's SOAs. Therefore, what is written in the solicitation is correct.

Offeror could use an unexpired subcontractor's SOA Certificate. GOV can accepts subcontractor's SOA Certificate if the work covered by that category is all performed by the same subcontractor that furnished the SOA.

Further, this can be accepted for a maximum of two specialized categories (OG3 and OG6). In other cases the Offeror has to establish a Joint Venture with the qualified companies. Using Sub's SOAs, Offeror has to submit a letter of commitment, by which Offeror declares to use the subcontractors that furnished the SOA category.

D’ATTESTAZIONE (SOA) CERTIFICATION:

is indicated: ” (1) An unexpired SOA Certificate (including joint venture partner, consortium partners or subcontractors that will be utilized to meet the qualification standard).”

Is it necessary for consortia to have their own SOA certificate in the name of the consortium itself and in addition the certificates of the consortium partners or are only the certificates of the consortium partners sufficient?

As established by the Italian Law consortium, SOA certificates are sufficient for a Consortium to participate to the solicitation. Consortium participation is subject to the clause that the Consortium specify in advance (at the submission of the offer) who is the consortium partner that will perform the works in the case of award of the contract (in this case for all Task Orders of the Micro MACC). Also, it is required that the Offeror submits a letter of commitment between Consortium and partner involved.

4 1) Concerning the EXPERIENCE works performed with the Government, do we need do submit the ATTACHMENT 2A Form PPQ to be signed by the Government ? Or will you go through CPARS ?

Yes, contractor must submit the PPQ.

5 2) We strongly believe that SOA Classification Requirements (see page 7, par. 1.10) are not commeasured to the value of the Micro MACC works, i.e. from 0 k to 1.5M. In the previous Mini MACC a CLASSIFICATION I was required.

SOA Classification Categories have been corrected and now reflect Classification III. Reference paragraph 1 above for details.

6 3) Solicitation Section 00600, “Representations, Certifications, and Other Statements of Offerors” is missing.

Please refer to clause 52.204-8

ANNUAL REPRESENTATIONS AND

CERTIFICATIONS (OCT 2018) in the RFP. Which allows the offeror to use an Active SAM registration to complete this requirement.

7 4) Due to Christmas holiday and staff reduction because of COVID outbreak, we request a time extension of at least 30 days for the submittal of the Phase I Proposal.

Proposal Due Date Has Been Extended From Monday 25 January 2021 to Monday 01 February 2021 1400 Central European Time (CET) per Amendment 0001.

8 FACTOR TWO – EXPERIENCE > Construction and Design Experience

As per RFP (page 14 and 15), Offeror have to submit Past Performances that demonstrate a similar magnitude with a construction value from $0k - $1.5M.

Please confirm that Projects whose Construction vale is exceeding $1.5M are acceptable, for both Construction and Design experiences.

Construction projects exceeding $1.5M are not acceptable.

9 FACTOR TWO – EXPERIENCE > Design Experience

RFP (page 15) says that Projects submitted for the Offeror shall be completed by the design team within the past five (5) years of the date of issuance of this RFP.

Please confirm that completed Design Projects, whose Construction phase is currently in progress, are acceptable.

Per the RFP page 15: Projects submitted for the Offeror shall be completed by the design team within the past five (5) years of the date of issuance of this RFP.

Construction projects have their own separate requirements in the Construction Experience Factor.

10 FACTOR TWO – EXPERIENCE >

USG, please confirm that it is possible submitting as Corporate Experience a Project whose Construction Phase is 92%completed, stuck from months for reasons beyond Contractor responsibility.

Per the RFP, Projects submitted for the Offeror shall be completed within the past five (5) years of the date of issuance of this RFP.

11 Section 2.2 FACTOR 1 – Technical Approach:

Par. (a) (1) the requirement is:

“The Technical Approach narrative shall be limited to one (1) double-sided page (or two (2) single-sided pages) including the organizational chart.”

Being the page limits very narrow, we ask the possibility to include the organizational chart in a separate page from the required two for the technical approach, then use a third page for this purpose.

The Technical Approach narrative shall be limited to one (1) double-sided page (or two (2) single-sided pages) EXCLUDING the organizational chart.

The organizational chart must be on one separate sheet.

12 Section 1.7 Phase I:

The requirements is:

“Proposal are due no later than Monday 25 January 2021 at 14:00 Central European time (CET).”

Considering that the RFP has been posted on 21 December 2020 (Christmas time with red / orange zone all over Italy for movement) and considering the COVID emergency situation with difficulties to move and contact any potential partners, subcontractors and designers in order to have the necessary time to produce and collect all the documentation required by the RFP, we ask You to extend the proposal due date of 10 days, so to have the possibility to provide a good proposal.

D’ATTESTAZIONE (SOA) CERTIFICATION:

For the four work categories indicated in RFP N33191-21-R- 4006, it requires Classification IV, corresponding to works of an amount of up to €2,582,000 (approximately $3,150,000).

Since RFP provides for task orders of an amount of up to $1,000,000, the correct Classification should be Classification III (works of an amount equal or up to €1,033,000, approximately $1,260,000), as it used to be in the previous MACC solicitations. Such an increase could greatly limit the competition, and furthermore, according to the procedures of the Procurement Code, to determine the Classification to be requested, it is based on the maximum volume of work to be carried out for those Classifications. Based on this information, is it possible to please evaluate and possibly correct/change the Classification by bringing it down to Classification III?

SOA Classification Categories have been corrected and now reflect Classification III. Reference Paragraph 1 above for details.

14 Phase I:

Section 1.10 Par. b. (2) The requirements is:

“Current self-certification documentation required by art. 38 of

DL 163/06”

Please, note that the indicated art. 38 has been superseded by art. 80 DL 50/2016 and needs to be applied in replacement of the indicated art. 38.

Reference DL 163/06 is hereby replaced by DL 50/2016.

Therefore, Offerors must provide self-certification documentation required by art. 80 DL 50/2016.

15 Phase I:

Section 1.10 Par. a The requirements is:

“the following qualification standard shall met by the offeror for the overall MACC: Category OG1 Classification IV - Category OG3 Classification IV - Category OG6 Classification IV - Category OG11 Classification IV” with a total aggregate maximum value of $ 25,000,000.

Please, looking at the previous MACC Contract the requirements were “Category OG1 Classification IV - Category OG3 Classification II - Category OG6 Classification III - Category OG11 Classification III” with a total aggregate maximum value of $ 95,000,000.

We ask You if the categories required for this Micro MACC will remain these or will change in consequence of the total aggregate maximum value that is less then the other similar contract, this just to organize our team according to the work.

Referred “aggregation” of the classification is not applicable to this type of contract. Aggregation of the SOA is valid for a single construction contract, not for a multiple task order contract as this.

16 In the absence of responses of the 3 PPIs sent, we kindly request if the Government can extend the proposal due date of 15 days in consideration of the minimum time necessary for the company management organization in order to structure itself properly according to the PPIs responses that we will receive
