The following have been added by full text:

PART 1 – PROPOSAL FORMS AND DOCUMENTS

1. Replace page 99 from document “130710 Revised Final RFP 3820 Volume I” with the attached replacement page – “130710 Final RFP 3820 Volume I Pg.99 Replacement.pdf.”

2. The Phase I proposal due date is extended from Monday, 10 March 2014 at 14:00 Central European Time

(CET) to Friday, 14 March 2014 at 14:00 Central European Time (CET).

PRE-PROPOSAL INQUIRIES

The following Pre-proposal Inquiries are answered:

3. RFP specifies that "a relevant project is further defined as vertical construction projects on Multi-unit Housing, apartment or office building renovation with at least fifty (50) residential units in each project or a multiunit Housing or apartment construction project with at least fifty (50) residential units in each project with a value equal to or exceeding $5,000,000 (or the equivalent foreign currency).” We would like to kindly request if a new Office construction building, or other type of residential buildings such as hotels or retirements homes, each one of them with more than 50 workstations/ residential units, may be considered as relevant projects.

Answer: It is the offeror’s responsibility to submit projects that meet the relevant project definition as indicated in the solicitation.

4. Specifications Volume I (page 99 of 714) states that “To meet the EM 385-1-1 annual training requirements the SSHO may elect to accomplish applicable sections (lessons) of the web based EM 385-1-1 training. For purposes of this contract completion of each EM 385-1-1 training module (lesson) verified by the printed certificate is considered credit for four hours of training. The training may be accessed at the following link:

http://63.88.8.194/construction/index.html.” but the point is that the link is not working. Could you please, inform us about another way to access?

Answer: EM 385-1-1 annual formal training is not required. See attached replacement page 99 indicating the change.

5. Specifications Vol I states that “the Project Manager and on-site Project Superintendent shall complete the course entitled "Construction Quality Management for Contractors" prior to the start of construction. This course is periodically offered at ROICC offices in Italy. Contact the Contracting Officer to schedule attendance in the course”. If we are interested in this course, do we have to schedule attendance when we have passed to Phase II or can we schedule it in Phase I?

Answer: The contractor is responsible to coordinate training as necessary to meet the requirements of the Solicitation. Request should be made with a FEAD or ROICC office.

6. According RFP Part 2, Section UFGS 01 35 13, Page 3, Point 4.2 Model Units, the Contractor shall present model units for the Government’s final inspection within 130 days of Model Unit NTP. Does this mean that the Contractor has 130 days for completing the 7 model units?

Answer: Yes

7. During the 7 model units construction period is mandatory to have onsite (2) Quality Control Managers and (2) Safety and Health Officers? According with RFP Part 2, Section UFGS 01 35 26. 05 20, Page 4, Point 1.5.1.1. "The contractor shall provide a safety oversight team that includes a minimum of two (2) Competent Persons at each project site to function as the Safety and Health Officer (SSHO)". Does project site mean each group of 20 units or the entire Project?

Answer: Only one (1) QC manager and one (1) SSHO are needed during the construction period of the 7 model units. If the contractor chooses to perform major utility work in accordance with 01 3 513 -3.1.2.e and or demo additional units, then an additional QC mgr and SSHO is required.

8. According with RFP Part 2, Section UFGS 01 13 00. 20, Page 3, Point 1.14.1., there are some materials that shall be manufactured in USA (Interior Distribution System, Interior Lighting, CATV, Interior Fire Alarm). How far in advance shall obtain individual export license and project export license according with the point 1.7. in RFP Part 2, Section UFGS 01 30 00. 05 20, Page 4?

Answer: The contractor is responsible to coordinate licenses as necessary to meet the project scheduling requirements of the Solicitation.

9. According with RFP Part 2, Section UFGS 01 32 17. 05 20, Page 3, Point 1.5, does the scheduler need to be onsite?

Answer: No. The scheduler only needs to be on-site during bi-weekly meetings to discuss project schedule updates.

10. According with RFP Part 2, Section UFGS 01 14 00. 05 20, Page 1, Point 1.2 "Temporary fencing and safety barriers shall be installed and approved by Contracting Officer before work is started on removals or demolitions".

Shall be the temporary fencing installed on each house or by groups?

Answer: Temporary fencing must be provided to secure each phased area or model unit in which they are working. Upon completion the temporary fencing shall be relocated to secure the next housing area.

11. PAGE 38 OF 74. PERFORMANCE GUARANTEE OR BONDS: Is it acceptable a performance guarantee of a Spanish’s bank?

Answer: Yes.

12. PAGE 21 OF 74. 2.2 EVALUATION FACTORS FOR AWARD – PHASE II NON-PRICE FACTORS-

FACTOR 5 – TECHNICAL SOLUTION

We would need to know about technical solution scope to what we mean. If it is a complete or preliminary project?

Answer: Factor 5 – Technical Solution will be evaluated in Phase II of the solicitation

13. PAGE 23 OF 74. The Offeror may utilize experience of a design subcontractor to demonstrate design experience.

Must the design subcontractor have the DUNS, NCAGE CODE and register in SAM If we do a partnership agreement, teaming agreement, or letter of commitment with the design subcontractor, although Construcciones Sánchez Domínguez-SANDO, S.A. was the only offeror?

Answer: DUNS, NCAGE CODE and SAM registration is not required if the designer will be a subcontractor.

14. RFP Page No:15 Paragraph No:1.11 CLASIFICACION DE EMPRERAS DE OBRAS CERTIFICATION

It is written that we should have a certificate but we do not know how to and from where obtain this Certificate.

Could you please clarify how can we have this certificate with a Website Link or address?

Answer: It is the offeror's responsibility to obtain the proper certifications in accordance with the Solicitation.

15. According to section 1.5 in the RFP, SAM registration is required for all offerors. If the offeror is a Prime Contractor in partnering agreement or team agreement with one or two Design firms, how to proceed with the SAM registration in this case?:

- Only the Contractor is required to be registered?

- Every single member of the agreement must be registered?

- Everyone is required to be registered as a unique offeror (similar to a JV)?

Please, clarify.

The same question arises regarding DUNS number and NCAGE code (section 1.6)

Answer: In the case of an offeror with proposed subcontractors, only the offeror is required to be registered in SAM. Registration in SAM requires a DUNS Number and CAGE/NCAGE Code.

16. EVALUATION FACTORS FOR AWARD; Factor 1- Technical Approach: May an A/E firm be included as design team in two different offers of two different contractors.

Answer: The offeror is responsible for preparing their offer. There is no prohibition against different offerors proposing to use the same design firm.

17. In order to demonstrate Construction Experience, RFP requires that “projects submitted for the offeror shall be completed within the past five (5) years of the date of issuance of this RFP” (section 2.2 - page 22). Due to the current economical crisis, the number of residential projects in Spain has decreased hugely in the last five years, so the available projects are not very representative of the actual experience of the companies.

Could this five years period be increased at least in two more years (past 7 years) in order to really represent the experience of the companies?

This request should also apply to “Design Experience”

Answer: The solicitation requirement remains unchanged.

18. RFP page 12 of 71 states that “FOR THE PURPOSES OF THIS SOLICITATION, A JOINT VENTURE (JV) REFERS TO A U.S.-STYLED FORMAL LEGAL ENTITY IN THE NATURE OF A PARTNERSHIP COMPRISED OF TWO OR MORE PERSONS OR COMPANIES. EACH JOINT VENTURE MUST PROVIDE ONE (1) CAGE/NCAGE

CODE, ONE (1) DUNS NUMBER FOR THE JOINT VENTURE AND ONE (1) DUNS NUMBER FOR

EACH MEMBER COMPRISING THE JOINT VENTURE. EACH JOINT VENTURE MUST BE REGISTERED

IN THE CCR USING THE NAME OF THE JOINT VENTURE.”

We would like to inform you that the Joint Venture legal figure does not exist in Spain, our legal vehicle to perform these kind of commercial agreements is the UTE (Unión Temporal de Empresas), which is recognized by the Kingdom of Spain Law. The main difference between JV and UTE is that you need to have been already awarded a contract to be able to create a UTE, under the Spanish Law, because this contractual vehicle must have a specific commitment.

At this point, we would like to have the possibility to submit only the DUNS and NCAGE of the companies forming the UTE, and not the DUNS and NCAGE of the new entity.

Only once you have been awarded the contract, and not before, you will be able to register this new entity (composed by the two or more companies forming the UTE) in the Registro Mercantil and obtain the CIF (equivalent to the VAT Number). Once you have the CIF number you will be able to request the DUNS number of the new entity.

Therefore, we would like to kindly request you to include the particularities of the Spanish Law, as the host country, and:

- Include the use of the UTE and,

- Allow the companies to submit after the award the DUNS and NCAGE of the new entity, submitting in the bid proposal the DUNS and NCAGE of the entities that will compose the future UTE together with a letter of commitment of forming the UTE, sealed and signed by the parties, once awarded the contract.

Answer: Only one DUNs and CAGE code can be submitted either by an offeror, a joint venture, or a UTE.

19. Please could you clarify if will be issued another RFP for Phase II? Factor 4 and 5 are not described in the current RFP.

Answer: This information will be provided during Phase II of this solicitation.
