2. EVALUATION CRITERIA

Quotation Evaluation Factors

As per FAR provision 52.212-2, the Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

This procurement is covered by the World Trade Organization Government Procurement under the policy at DFARS 225.401-70 - End products subject to trade agreements.

The Government will evaluate offers in accordance with the policies and procedures of FAR Part 25. The Government will evaluate offers of U.S.-made or designated country end products without regard to the restrictions of the Buy American statute. The Government will consider for award only offers of U.S.-made or designated country end products unless the Contracting Officer determines that there are no offers for such products or that the offers for such products are insufficient to fulfill the requirements of the solicitation. Per DFARS Part 225.502, the following procedures for acquisitions subject to the World Trade Organization Government Procurement Agreement shall be used:

Consider only offers of U.S.-made, qualifying country, or designated country end products, except as permitted by

225.403 or 225.7703-1.

Basis for Evaluation and Ratings:

1. The Government intends to evaluate and award a contract without discussions with Offerors (except minor clarifications such as the relevance of an Offeror’s past performance information and adverse past performance information to which the Offeror has not previously had an opportunity to respond, or to resolve minor or clerical errors). Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a price and non-price evaluation factor standpoint.

2. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with Offerors in the competitive range; and to award the contract to the Offeror submitting the proposal determined to represent the best value, i.e. the proposal most advantageous to the Government, price and other factors considered.

3. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

4. The Subjective Tradeoff process is selected as appropriate for this acquisition. The Government considers it to be in its best interest to allow consideration of award to other than the lowest priced Offeror or other than the highest technically rated Offeror.

5. Any proposal found to have a deficiency in meeting the stated RFQ requirements or performance objectives will be considered ineligible for award, unless the deficiency is corrected through discussions. Proposals may be found to have either a significant weakness or multiple weaknesses that impact either the individual factor rating or the overall rating for the proposal.

Evaluation Factors

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

I. Price Factor II. Non-Price Factor

i. Specification Compliance

ii. Experience

iii. Past Performance

The Non-Price Factor is approximately equal to the Price Factor. The importance of price will increase if the Offerors’ non-cost/price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-cost/price proposal’s superiority to the Government. Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price factors considered.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
