About this file

This is a Questions and Answers document issued by Military Sealift Command (MSC) on 28 August 2026 for solicitation N3220525R6131. The document provides clarification on five questions submitted by potential offerors regarding a tug services contract and does not constitute an amendment to the underlying solicitation.

The document addresses key contractual matters including the declared value of USNS CATAWBA (which cannot be determined at the time of issuance), the application of TUGCON proforma provisions regarding owner liability and insurance requirements, and clarification that the prime contractor will be treated as the "Owner" for all purposes related to tug ownership, operation, navigation, manning, maintenance, seaworthiness, and operation—rejecting the possibility of treating the actual tug owner/operator as the Owner while a separate entity serves as prime contractor. The document confirms that the MSC TUGCON 2026 (02-26) proforma will be provided and posted on SAM.gov with an upcoming amendment. Additionally, offers must be submitted via email to both David Anaya (david.c.anaya.civ@us.navy.mil) and Christopher Tomlin (christopher.a.tomlin.civ@us.navy.mil). No specific products, services, response dates, pricing terms, or award information is detailed in this clarification document.

QUESTIONS AND ANSWERS

28 August 2026

The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.

1. Regarding the subject solicitation, please provide the declared value of USNS CATAWBA.

ANSWER: The declared value of USNS CATAWBA cannot be determined at this time.

2. Please clarify how MSC intends the “Owner” provisions of TUGCON to apply under this structure, particularly FAR 52.212-4(j), Risk of Loss – Towing Liability; Part III(h), Insurance; and the associated warranties and limitations of liability applicable to the Tug, Tug Master, crew, and towing operations.

ANSWER: The Contractor and Owner are interchangeable, and terms and conditions of the solicitation and proforma are applicable towards the owner and not the subcontracting party.

MSC is separated from the contractor/owner and their subcontracting arrangement/party.

Terms and conditions in the TUGCON proforma are subject directly to owner/contractor only.

3. Specifically, would MSC permit the actual tug owner/operator to be treated as the “Owner” for purposes of liabilities, warranties, insurance requirements, and protections arising from the ownership, operation, navigation, manning, maintenance, seaworthiness, and actual operation of the Tug, while PCCI remains the prime Contractor and remains responsible for its independently performed scope and overall contract administration?

ANSWER: No, the Owner is considered the prime contractor, and the prime contractor is to be treated as the “Owner” for purposes of liabilities, warranties, insurance requirements, and protections arising from the ownership, operation, navigation, manning, maintenance, seaworthiness, and actual operation of the Tug.

4. Proforma. The solicitation states that proforma documents are available upon request. Please provide MSC TUGCON 2026 (02-26). Part IX(d) makes compliance with Part VIII(A)(11) and Part VIII(A)(12) a condition of eligibility, and those provisions are in the proforma rather than in the RFP.

ANSWER: TUGCON proforma will be provided and posted on SAM.gov with the upcoming amendment.

5. Submission address. Please confirm the email address to which offers should be sent, and any required subject line.

ANSWER: Please email offers to both David Anaya at david.c.anaya.civ@us.navy.mil and Christopher Tomlin at christopher.a.tomlin.civ@us.navy.mil.
