QUESTIONS AND ANSWERS

The following are answers to questions received from potential offerors.

1. Given the Christmas and New Year’s holidays that fall between solicitation issue date and offer due date, we request that offer due date be extended to 3 February 2022 to allow more time to submit responsive and competitive offers.

ANSWER: The Government is willing to extend the offer due date for two weeks to 27 January 2021 and RFP offer due date will be updated in this amendment.

2. The prepopulated # of Days for Fuel Underway (laden) and In-Port Idle on the Fuel Consumption Data

Tab of Attachment B account for the Base Year, all 4 Option years, and FAR 52.217-8. In Attachment B of previous RFP N32205-16-R-3516, the prepopulated # of Days on the Fuel Consumption were for the Base Year only. Please confirm the Fuel Consumption Data Tab has the correct number of days for Fuel Underway (laden) and In-Port Idle, and calculations should be done basis the Base Year, all 4 Option years, and FAR 52.217.

ANSWER: The Fuel Consumption Data Tab has the correct number day for Fuel Underway (laden) and In-Port Idle, and Total Evaluated Fuel will be calculated using the basis of the base year, all 4-option years, and FAR 52.217-8.

3. Part X(f) of the RFP states that proposals/modifications must be submitted via email, while Part X(h) mentions hard copies of the proposal and two CDs or DVDs. Please advise if e-mail only submissions of proposals are acceptable or if proposals must also be submitted as hard copies and two CDs or DVDs. If hard copies are required, please advise how many copies should be submitted. Additionally, please advise what content should be included on the two CDs/DVDs.

ANSWER: Proposals must be submitted via email and hard copies or CDs/DVDs are not required. Part X(h) will be revised to reflect this change in ths amendment.

4. Part X(x) of the RFP states that “Each offer shall be clearly labeled, and complete with the following parts: Critical Submission Data; Business Proposal; Technical Proposal; Past Performance Proposal;

and Price Proposal”. However Parts X(ab) and XI(2) state “Offerors do not submit Past Performance information” and “The Government will search CPARS for each offeror’s three most recent and relevant government contracts for the ocean transportation of cargo”, respectively. Please confirm the Government will review Offerors’ Past Performance in CPARS and Offerors do not need to include a separate compilation of Past Performance as a part of their Proposal?

ANSWER: Yes, the Government will review Offeror’s Past Performance in CPARS and Offerors do not need to submit Past Performance information.

PART X. INSTRUCTIONS TO OFFERORS – LONG TERM CHARTER

FAR 52.212-1 (ADDENDUM) ADDITIONAL INSTRUCTIONS TO OFFERORS--

COMMERCIAL ITEMS)

In accordance with FAR 12.302 (Tailoring of provisions and clauses for the acquisition of commercial items) the following shall take precedence over the un-tailored paragraphs

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) This procurement is a FAR Part 12 acquisition being conducted under FAR 15.101-2 and FAR 15.306 procedures.

(c) Submission of offers. (Tailored) Submit signed and dated offers to the point of contact specified in Block 7 of the SF 1449 at or before the exact time specified in this solicitation.

Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show --

(1) The solicitation number;

(2) Reserved (Tailored);

(3) The name, address, and telephone number of the offeror;

(4) Terms of any express warranty;

(5) Price and any discount terms;

(6) “Remit to” address, if different than mailing address;

(7) A completed copy of the representations and certifications at FAR 52.209-5 (XII)(c)(1));

FAR 52.209-7 (XII(c)(2)); FAR 52.209-11 (XII(c)(3)); and FAR 52.212-3 (XII(c)(4)) (see FAR 52.212-3(b)) for those representations and certifications that the offeror shall complete electronically). (Tailored)

(8) Acknowledgment of Solicitation Amendments;

(9) Previous Five Year Voyage Itineraries. Offerors shall provide a previous voyage itinerary for each proposed vessel. The itinerary shall include every port visit for the period November 2015 to the date of the offer. Provide ports, dates, and reason for visit.

For repair or maintenance periods, include a brief description of the work conducted.

(d) The Government intends to award one (1) contract under this RFP. The contract will have a performance period that will last for one firm year with three one-year and one 11-month optional periods. This acquisition is conducted as 100% small business set aside.

(e) Potential Offerors requesting additional information or clarifications relating to this solicitation shall submit their request in writing by email to F. Carley Orvin at franklin.orvin@navy.mil and Christopher Tomlin at christopher.tomlin1@navy.mil.

Questions regarding the solicitation must be submitted no later than 1:00pm local time, 14 days after the solicitation was issued; otherwise questions may not be answered prior to the solicitation closing. Offerors shall submit questions to this solicitation using the Request for Clarification and Question form provided as Attachment F to this solicitation. Each question shall be submitted on a separate form. Questions shall be submitted to the Contracting Officer and Contract Specialist identified in this solicitation. Questions submitted not using this form, or that combine more than one question per form, may not receive a response. No telephonic responses will be provided.

(f) Proposals/modifications must be submitted via e-mail in Adobe Acrobat (.pdf) format, and must be compatible with Adobe Acrobat Reader 8.0 or later version.

Proposals/modifications must contain either a verifiable electronic signature (e.g. PKI enabled certificate), or a scanned image of the handwritten signature of the Offeror or Offeror's agent. Offerors are advised that delays in the receipt of e-mail do occur, and the Offeror is solely responsible for timely receipt of offers by the Government regardless of any problems or delays related to computer hardware or software systems including, but not limited to, servers and firewalls. An E-mail proposal that resides on a Government server, but has not appeared in the designated E-mail inbox by the due date and time for proposal submission will be considered late. Offerors are advised that the Government may be unable to receive other types of electronic files (e.g., .zip files) or files in excess of 20 megabytes.

For electronic proposal/modifications, the only acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time and date set for receipt of offers is the receipt of the E-mail proposal, readable, in its entirety in the designated E-mail inbox by the due date and time for proposal submission. Any other timestamp or meta-data of the Offeror's sent e-mail shall not be construed as sufficient documentation of the Government's receipt of an e-mailed offer. It is the Offeror's responsibility to ensure the proposal has been received in the designated E-mail inbox by the due date and time.

(g) For With respect to FAR 52.215-1(d), unless offeror proposes a shorter period, by submission of an offer, offeror agrees that its offer, including any timely revisions thereto, shall remain valid until the Government makes award under this solicitation. The foregoing does not preclude an offeror from withdrawing its offer prior to award.
