N321B FUTURE OPERATIONS
TANKER PERFORMANCE WORK STATEMENT
MSC TANKTIME
VESSEL(S) REQUIRED:
One clean, approved, U.S. Jones Act Vessel, double hull tanker with an Inert Gas System (IGS) and Segregated Ballast Tanks (SBTs) that is capable of carrying a minimum of 310,000 BBLS of clean petroleum products (intention JP5, JAA, F76) within the vessel’s Natural segregation in designated cargo tanks with double valve isolation and with the following minimum particulars:
a) Vessel must be a party to the SIRE system and provide a current Q-88 with offer (no more than 60 days old). Q-88 must detail current acceptances and dates of inspection.
b) Owners must provide list of approvals that include the inspection dates and expiry dates.
c) c) Owner must provide date of last SIRE report on the vessel, which has been registered in the revised SIRE register. This SIRE report must be less than 6 months old at all times during the performance of this contract.
d) Owner must confirm acceptances received and/or retained by the vessel since the last sire report.
e) Owner must confirm that the vessel has not been rejected or refused by any Charterer since the inspections leading to the said SIRE report.
f) Owner must confirm vessel has vetting approval from at least two oil majors providing date of vetting and name of major, at least one vetting approval must be less than 6 months old at the time of the offer.
g) Vessel’s age shall be less than 20 years for the duration of the charter, vessels that will exceed 15 years during the charter period must be enrolled in their classification society’s Condition Assessment Program (CAP) and be rated CAP 2 or better
h) Vessel cannot exceed a maximum LOA of 213 meters.
i) Vessel cannot exceed a maximum Beam of 32.31 meters
j) Vessel must have SBTs.
k) Vessel must have an IGS.
l) Vessel cannot exceed a maximum manifold height above water line of 14 meters
m) Vessel must have the ability to load minimum of 310,000 bbls F-76 not to exceed a laden draft of 12.47 meters with Max DWT of 50,000 MT
n) Equipped with a minimum of a 10-ton boom lift capacity at the manifold for lifting cargo hoses.
o) Minimum of three segregations with double valve isolation between each segregation.
p) Vessel must be able to machine wash cargo tanks, as applicable, while underway.
q) Vessel must be able to clean, mop, dry and inert cargo tanks within three (3) days’ notice by the Government during performance of the charter when required.
r) Ability to perform Cargo Operations at offshore petroleum facility
s) Vessel must be able and equipped to perform cargo operations pier side
t) Ability and equipped to perform Cargo Operations at anchorage (lightering).
u) Ability and equipped to perform Cargo Operation via Refueling at Sea (CONSOL).
v) Vessel must be capable of maintaining a minimum Speed of Advance (SOA) of 13 knots in moderate weather (Force 5).
w) Must have a minimum of 5 berths available for additional government embarked personnel.
x) Owner must provide a copy of vessel’s current Class Society issued Safety Management Certificate.
y) Owner must provide a copy of vessel’s current Flag State issued International Ship Security Certificate.
z) Owner must provide a vessel stowage plan demonstrating the vessel’s ability to load a minimum of 310,000 BBLS of JP5 while not exceeding a laden draft of 12.8 meters.
aa) Owner must confirm vessel will arrive at load port in a clean, gas-free condition, and be ready for internal tank inspection by Quality Assurance Representative (QAR). Ensure any adjacent tanks are also clean and gas free. Contractor shall provide (Owner's account) a Certified Marine Chemist to certify tanks safe for entry for internal tank inspection by Government and/or Charterer representative. Certified marine chemist must enter all cargo tanks in advance of the QAR and perform a full four corner entry inspection. Certified marine chemist’s inspection must include all tank pockets identified by the QAR to the satisfaction of the QAR. If a prior (last and next to last) cargo contained a percentage of benzene, owner’s certified marine chemist must arrive equipped with benzene detection tubes to measure toxicity for benzene content. All safe for entry / toxicity / flammability assessments will be performed in the presence of the inspecting QAR. Contractor will provide time needed to re-inert after inspection.
ab) Owner must provide, if vessel cargo tanks have heating coils, coil type or composition (such as stainless steel, copper, etc.).If vessel cargo tanks have heating coils, owner must provide the date heating coils were last pressure tested and the results of the test (passed or failed). Date of last pressure test cannot exceed 12 months for duration of this charter. Vessel tanks with copper or yellow metal compounds are normally not acceptable for Jet Fuel cargoes.
ac) Owner must provide, if vessel cargo tanks are internally coated, provide the coating type (epoxy, inorganic zinc, etc.). Coal tar coating is not acceptable. If tanks are not coated then state “none”. Coatings that are incompatible with the fuel to be carried will be rejected.
ad) Owner must provide copies of Certificates of Quality for vessel’s last three cargoes. These Certificates should contain all test data required by specification for the products that were previously loaded (last three). Vessel Certificates of Quality from vessel post-load samples are preferred, but if unavailable shore tank Certificates of Quality representing quality of product loaded are acceptable. The Certificates of Quality should contain the test data required by the specification for the product which were loaded. They shall be submitted for each shore tank as well as the vessel tanks after loading (composite sample). Results of “typical” are not acceptable. Additionally the following are required for the specific products mentioned:
1. Naphtha / Condensates: Mercaptan Sulphur, reported in “parts per million” (ppm) or “mass percent”, or Doctor Test (ASTMD 4952). Otherwise, Certificates of Quality should contain the test data required by the specification for the products which were loaded.
2. Gasoline (Motor or Aviation): It must be stated whether the previous product was “leaded” or “unleaded”. This is needed to determine cargo tank “safe entry” testing requirements.
ae) Owner must confirm if the last three cargoes carried were FAME (Fatty Acid Methyl Esters) free. If tanks did contain FAME owners must provide a statement stating the vessel cargo tanks were cleaned and conditioned in accordance with the guidance in Energy Institute HM50.
af) Owner must confirm vessel must be able to take upper, middle, lower, bottom, and all level samples of the cargo (to include OBQ & ROB) without contaminating them from the sampling location. If unable to do so or if the sampling location is contaminated or suspected to be contaminated, Charterer will require open sampling on a tank-by-tank basis, consistent with safety and local terminal regulations.
ag) Owner agrees where cargo is carried after contract award and prior to delivery to provide cargo type/description prior to loading, and applicable Certificates of Quality (to include all test data required in the initial RFP) for review within 48 hours after loading said cargo. Test shall be on a sample taken from the ship versus a representative sample from a shore facility. Any rejection of the Certificates of Quality by the Government shall result in the Government cancelling this contract at no cost to the Government.
ah) Vessel must meet all MSC requirements for reporting. Vessel shall provide position/status reports in port and at-sea every six (6) hours daily at 0000, 0600, 1200, and 1800 hours local Washington, DC time (GMT-5 EST/GMT-4 EDT) and 72/48/24/12 hrs. Pre-arrival notifications for all ports to Area Command and COMSC PM35. Reports shall be sent to the following email addresses:

ai) Vessel will be required to submit a MONTHLY VOYAGE ABSTRACT form on a monthly basis and emailed to WNYD_HQTANKERS@NAVY.MIL no later than the 1st day of the month following the month of performance. For time charters that complete prior to the end of the month, the report must be received no later than two calendar days after completion of charter (off-hire). Entries must start with the date the ship presents NOR and is accepted on hire. All columns must be completed as noted. Pull down menus for columns C, X and Y are the only comments to be use. Built in macros/formulas are not to be altered. Contractor Facility Clearance.
aj) Contractor Facility Clearance. The Contractor shall possess a SECRET facilities clearance at time of proposal submission (See Part X and Part XI for proposal instructions and award criteria), which shall be incorporated at contract award in the required DD 254 (See Attachment D).
ak) Personnel Clearances: The Master, Chief Officer, and an additional officer (deck or engineering) shall have a completed investigation comparable to at least a National Agency Check and adjudication indicating eligibility for access to SECRET.
al) Chemical, Biological and Radiological Defense (CBRN-D)
a. CBRN-D Requirements.
i. General. Military Sealift Command in the W-143 CRBN Warehouse Norfolk, Virginia centrally manages CBRN-D material. The Government will provide all CRBN-D. At no time should the Contractor procure an off the shelf commercial CBRN-D equipment unless otherwise directed by the Charterer. The Contractor shall contact the N-44 Logistics to request replacement of CBRN-D items that have been expended, damaged or have exceeded their shelf life or require calibration. The request must include the Shipping address and the point of contact name and phone number. The Master will submit CBRN-D complete inventory in the format designated by MSC of all and CBRN-D equipment required by the allowance equipage list (AEL) in accordance with the required reports, records and log (CDRLs) section of contract. Up
ii. Upon receipt of all and CBRN-D material, the Ship will sign and date the receipt document, annotate material received and fax and or EMAIL a copy to the Shipper (MSC Central Storage Facility) within ten days.
b. CBRN-D Equipment and Training.
i. The Contractor shall adhere to MSC’s standard provisions concerning CBRN-D found in Attachment K and L. The Contractor will assign a licensed Deck Officer as CBRN-D Officer who shall perform the duties as described below and in accordance with COMSCINST 5530.3 (Series). The Contractor shall train crewmembers as specified in COMSCINST 5530.3 (Series). The Contractor will reconfigure a space as necessary to function as a decontamination station as specified in Attachment L. Any transfer or disposal of CBRN-D equipment will be reported to the cognizant MSC Area Commander and Squadron Commander in accordance with FAR CLAUSE 52.245-1, entitled ‘Government Property’.
c. CBRN-DO Officer Duties. The CBR-DO Officer will perform the following duties:
a. Ensure all CBRN-D equipment is properly stored and maintained at authorized levels in accordance with COMSCINST 5530.3 (series).
b. Ensure all CBRN-D equipment is inspected at least quarterly, with results of inventory entered into the deck log.
c. Replace and/or update deficient, missing or out-of-date equipment; submit RADIAC meters for calibration when due.
d. Advise the Master on procedures required as outlined in COMSCINST 3541.5 (Series) (Damage Control Manual).
e. Provide MSC Program Office with annual CBRN-D inventory.
d. CBRN-D Officer Training. The Vessel’s CBRN-DO Officer shall be trained as specified COMSCINST 5530. 3 (Series) and COMSCINST 3541.5 (Series)
e. Government Tests and Inspections. The Government has the right to periodically inspect the Vessel’s CBRN-D equipment, the CBRN-DO Officer’s qualifications and crewmembers’ training records, and test the operability of installed CBRN-D systems. A report of the inspection will be provided to the MSC HQ, N-32 Master, cognizant MSC Area Commander and Squadron Commander.
am) Anti- Terrorism / Force Protection
a. Anti- Terrorism / Force Protection Requirement
i. The Contractor shall adhere to MSC’s standard provisions concerning AT/FP found in Attachment G.
ii. General. The Government shall provide the ship with small arms, a class 5 gun safe, armory and magazine for use by the ship’s crew to provide Force Protection (FP) within the lifelines of the ship. Ammunition will be provide in accordance with ship’s classified SHIPFILL and consistent with the type and quantity of weapons on board. The Master is responsible for the custody of all small arms onboard and shall maintain custodial control and accountability, by serial number.
iii. The Ordnance Accounting Ashore (OAA) will be responsible for all Ammunition Transaction Reporting (ATR) and Periodic Lot Reporting (PLRs). Ship’s Master is responsible for receiving ammo and notifying OAA via email or phone of all ammo transaction.
b. Small Arms Training
i. Small Arms Training will be conducted annually IAW COMSCINST 5530.3 (Series). At least five (5) Mariners shall successfully complete US. Navy annual Small Arms Training in accordance with OPNAVINST 3591.1 (Series) and COMSCINST 5530.3 (Series). The Contractor will assign one of the licensed Officer to be designated as the Certified Anti – Terrorism Officer through completion of Military Sealift Command Force Protection Officer (FPO) Level II training.
ii. The AT/FP Officer is then certified to provide Level I and Basic Individual, Awareness Training to the vessel’s crew
c. Physical Security
i. Contractor will comply with all applicable provision of COMSCINST 5530 (Series) Ship Board Physical Security
ii. Ship’s Master will ensure that the crew is aware of the importance of access control and will ensure proper procedures are complied with IAW COMSCINST 5530.3 (Series).
an) The contractor shall be responsible for Controlled Cryptographic Instruments (CCI), such as a STE-III telephone, issued by the MSC operational or administrative Commander. The Contractor shall provide a secure space onboard the ship for use of CCI equipment and shall designate accountable personnel as specified by DODINST 5520.22 Series (National Industrial Security Program Operating Manual). The Contractor may also be issued COMSEC keying material which requires two-person integrity (TPI) be maintained onboard the ship as specified in DODINST 5520.22 Series. Any two ship's officers who hold a SECRET clearance granted by DISCO are acceptable as COMSEC keying material users. Physical safeguards for all classified material shall be provided by Contractor personnel as specified in DODINST 5220.22 Series. "The Contractor shall install, maintain, and operate COMSEC equipment for the U.S Government as well as electronically communicate classified national security-related information by COMSC protected means."
ao) Contractor performance requires that designated personnel employed onboard the ship have access to SECRET information regarding the operational employment and safe navigation of the ship. For operational matters, the Master, Chief Mate, and any additional officer (deck or engineering) shall have a completed National Agency Check and a SECRET clearance granted by DISCO. Only U.S. citizens have access to classified material. The Contractor shall, on a semi-annual basis, provide COMSC N15 an updated list of all crewmembers who are designated to have access to classified information. The Contractor shall ensure any classified information disclosed to its employees is not further released or made available to other employees, or any other person who does not have a comparable clearance and a "Need to Know."
ap) CONSOL: Stations, Equipment and Training.
i. The Contractor shall adhere to MSC’s standard provisions concerning CONSOL found in Attachment M. The Contractor shall train crewmembers at underway replenish training facilities at either Port Hueneme, CA or Little Creek, VA . The Contractor will reconfigure two areas on deck as necessary to function as CONSOL stations as specified in Attachment M. The Contractor will provide permanent CONSOL structures and procure any off the shelf commercial CONSOL loose equipment as directed by the Charterer.
aq) Confirm that owners agree to all other terms and conditions as per TANKTIME 10/13. Counters to TANKTIME 10/13 terms are not acceptable until written confirmation is provided by the charterer.
ar) Attachment A – Government Furnished Property (GFP), contains the government furnished property that will be provided under this contract to the contractor.
