Question/Comment/Feedback Government Response

116 152 Section M, Part II, Para. A

In reference to Past Performance (Section M, Part II, Para. A), the solicitation states: “When proposals are received from contractor entities specifically formed to propose on a particular acquisition (e.g. joint ventures), the past performance evaluation will consider each individual team member. No subcontractor past performance will be evaluated.” Does the reference to “JV team member” throughout the solicitation refer to the legal definition of a joint venture, which assumes a LEGAL entity is formed between two independent vested companies engaged in the joint prosecution of a particular transaction?

If a prime bidder, wishes to utilize one of its legally affiliated companies (Parent Company/Subsidiary Company), can the past performance of both the Parent and subsidiary / affiliate company be evaluated / counted, so long as both the Parent and Affiliate company are bidding together and planning to execute the work together?

Any reference in the RFP to JV team members is referring to the entities that make up a proposed Joint Venture. A “Joint Venture” is a partnership or teaming arrangement that is formed for the purpose of responding to this solicitation when the prime contractor consists of more than one legal entity that form a single legal entity.

Unless any 'legally affiliated companies' are part of a proposed Joint Venture (and are identifed as JV team members) only past performance for the Prime company will be evaluated for Past Performance and Corporate Experience.

The Government will not evaluate a subsidiary/affiliate company's past performance as it has been described in the question

Section L, para 5.3, Section 2 -

CPFF Costs (Lot I and II)

The DRFP directs the use of the SWBS provided in Attachement CA-3. We typically build a WBS using MIL-HDBK-881 and use this WBS to capture costs. Please clarify if 1) the SWBS is the WBS to be used for estimating the installation efforts for the Sample Task, or 2) we should map our -881 WBS to the SWBS, or 3) we should just use our WBS.

If the SWBS is to be used, are we free to add addition Level 3 elements as needed or does everything have to fit within the 5 Level 3 elements provided?

1). Yes, the SWBS is the WBS to be used for estimating the installation efforts for either Sample Task 1 (Lot I) or Sample Task II (Lot 2), as appropriate. As indicated in the instructions contained in Cost Attachment L-10a (Lot 1) or L-10b (Lot 2), the Offeror shall develop a SWBS and SWBS dictionary for Installation related scope only. The SWBS is required to align with the Government provided SWBS structure in CA-3. The Offeror shall expand its proposed SWBS as necessary and develop the SWBS Dictionary in CA-4 for its proposal to a minimum of Level 3 for all SWBS elements.

An Offeror may add additional Level 3 elements as needed.
