Question/Comment/Feedback Government Response

114 127-128 L(Part B)(1.0)

§867(b)(3)(B) of the FY16 (Public Law 114-92) requires an amendment to the SBA stating, in part, "When evaluating an offer of a small business prime contractor that includes a proposed team of small business subcontractors for any multiple award contract above the substantial bundling threshold of the Federal agency, the head of the agency shall consider the capabilities and past performance of each first tier subcontractor that is part of the team as the capabilities and past performance of the small business prime contractor."

This seems to have been incorporated into 15 USC §644(e)(4)(b)(i). Please provide the Government's basis for the determination that this does not apply to the instant acquisition.

15 USC §644(e)(4)(b)(i) does not apply to our procurement.

This section applies to "bundled or consolidated" contracts; this requirement/solicitation is not bundled or consolidated.
