SECTION L

INSTRUCTIONS TO OFFERORS

1.0 GENERAL

(a) The Government intends to award a contract that results from this solicitation to the responsible Offeror whose proposal is the most advantageous to the Government under the selection criteria set forth in Section M of the solicitation. The Government may reject any or all proposals if such action is in the Government’s interest.

Exchanges with Offerors after receipt of a proposal do not constitute a rejection or counteroffer by the Government.

(b) The Offeror shall submit all information required by this RFP. Proposals that do not comply may be considered nonresponsive and may render the Offeror ineligible for award. The Offeror’s proposal shall be based on the requirements contained in this RFP (including those documents, exhibits, and other attachments to the RFP identified in Section J).

(c) The Government intends to evaluate proposals and award a contract upon initial proposals. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms in relation to the evaluation criteria. However, in accordance with the clause FAR 52.215-1, Instructions to Offerors - Competitive Acquisition, the Government may contact all or a limited number of Offerors with questions concerning their responses.

(d) Offerors are hereby notified that a competitive range of the most highly rated Offerors may be established for the purpose of efficiency.

(e) The solicitation will be announced on FEDBIZOPPS and will be made available only through the internet at https://www.fbo.gov.

(f) Offerors are hereby notified that the Government may post additional information to the FEDBIZOPPS web site relating to this solicitation (e.g. responses to questions, amendments, etc.). It is the Offeror’s responsibility to check the web site for any such information.

(g) It is the Offeror's responsibility to identify to the Contracting Officer at the earliest possible time, but prior to the closing date, any ambiguities, discrepancies, inconsistencies, or conflicts between the Statement of Work (SOW) and other solicitation documents attached hereto or incorporated by reference. All questions shall be submitted via email to KYPT_TeamSub_TIH@navy.mil. Only questions transmitted electronically will receive a response.

Offerors are requested to submit questions within twenty (20) days after release of the RFP in order to allow the Navy adequate time to prepare and issue responses to all Offerors prior to the date and time set for receipt of proposals. While questions may be submitted up to the time of solicitation closing, the Contracting Officer cannot guarantee those late-submitted questions will be thoroughly answered in advance of closing. It is the Government's intention that questions and responses will be provided via an amendment to the solicitation which will be posted at https://www.fbo.gov. Information provided with each question shall include the document name, document date, specific page, paragraph, clause or other definitive citation requiring clarification.

(h) Reference material will be provided by the Navy on an Electronic Technical Information Center (E-TIC). While the material will be unclassified technical information related to the Technical Insertion Hardware (TIH) effort, it may still be restricted by the Arms Export Control Act. In accordance with Department of Defense (DOD) Directive 5230.25, access to export-controlled technical data must be through the company's designated Joint Certification Program (JCP) Point of Contact (POC)/Data Custodian.

(i) To apply for access to the E-TIC for the TIH 20/22 Solicitation, the Offeror must have a valid PKI certificate and be able to supply its JCP number. The Offeror’s designated JCP Data Custodian must fill out an Advanced https://www.fbo.gov/
