PERFORMANCE WORK STATEMENT (PWS)
PREVENTIVE/CORRECTIVE MAINTENANCE OF MATERIAL HANDLING EQUIPMENT
IN SUPPORT OF NAVSUP FLEET LOGISTICS CENTER SAN DIEGO SITE VENTURA COUNTY
1. General:
1.1 This is a non-personal services contract to provide Preventive Maintenance (PM) and Corrective Maintenance (CM) to Government Owned Material Handling Equipment located at Naval Base Ventura County Site Port Hueneme and Point Mugu. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government. The Contractor is required to determine and staff adequate supervision. The Contractor will define their approach in writing which explains and quantifies proposed on site supervision
1.2 Description of Services: The contractor shall provide qualified personnel, equipment, supplies, tools, materials, supervision, and other items and non-personal services necessary to perform Preventive Maintenance (PM) and Corrective Maintenance (CM) to Government Owned Material Handling Equipment as defined in this Performance Work Statement. The contractor shall perform to the standards in this contract.
1.3 Background: Material Handling Equipment located at Naval Base Ventura County require preventive maintenance to keep them in good working order for Warehouse and Preservation, Packaging, Packing and Marking (PPP&M) personnel use. The equipment also requires corrective maintenance when unscheduled repair is needed due to breakage or malfunction as they occur or as detected (to occur) during PM performance. Commander, Navy Region Southwest (CNRSW) does not have organic capability to provide services, and therefore, contractual support is necessary.
1.4 Objectives: The general objective of the contract is to maintain Material Handling Equipment within manufacturer and Government specifications by having a scheduled preventive maintenance (PM), and the performance of corrective maintenance (CM). PM schedule shall also be used in identifying potential problems and rendering CM before the equipment becomes inoperable. CM will also be used for inoperable equipment deemed not beyond economical repair (BER) by the Contracting Officer Representative (COR).
1.4.1 Corrective Maintenance shall not exceed the amounts in the NTE CLIN. Contractor may only charge for the actual time required and parts used for the service. If during the corrective maintenance, it becomes clear that the service/parts needed will exceed the NTE CLIN the contractor is responsible for stopping performance and promptly notifying the COR.
1.5 Scope: The contractor shall provide PM and CM to Government Owned Material Handling Equipment located at Naval Base Ventura County Site Port Hueneme and Point Mugu as listed in Attachments 1 through 2 to ensure equipment are in good working order when needed.
1.6 Period of Performance: The period of performance shall be for one (1) Base Year of 12 months and four (4) 12-month option years. The Period of Performance reads as follows:

1.7 General Information
1.7.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract.
1.7.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan (QASP). This plan is primarily focused on ensuring that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the performance thresholds.
1.7.3 Recognized Holidays: No Preventive Maintenance (PM) will be scheduled or performed by contractor during following Holidays:

1.7.4 Hours of Operation: The contractor may schedule PM/CM services between the hours of 7AM through 4 PM PST Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must always maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.7.5 Place of Performance: The work to be performed under this contract will be performed at Naval Base Ventura County Site Port Hueneme and Point Mugu.
1.7.6 Type of Contract: The government will award a Firm Fixed Price (FFP)) contract for PM and CM services respectively.
1.7.7 Security Requirements: UNCLASSIFIED
1.7.7.1 Base Access: The contractor shall maintain proper security protocol in accordance with all base regulations.
Security approval for all contractor personnel will be obtained through base security office. Identifications furnished for approved employees shall be returned to the COR by the contractor immediately when such employees are no longer employed under this contract. The contractor is responsible for the cost of their personnel Rapid Gate access.
1.7.8 Special Qualifications: The contractor is responsible for ensuring all employees possess and maintain required State and/or Federal certifications during the execution of this contract. The Contractor is responsible for ensuring all employees possess and maintain any Maintenance and Repair Certification during the execution of this contract.
1.7.9 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The Contracting Officer (KO), Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.7.10 Contracting Officer Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: ensure that the Contractor performs the technical requirements of the contract;
perform inspections necessary in connection with contract performance; maintain written and oral communications with the Contractor concerning technical aspects of the contract; issue written interpretations of technical requirements, including Government drawings, designs, specifications; monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. An appointment letter issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting contract.
1.7.11 Alternate Contracting Officer Representative (ACOR) Alternate Contracting Officer Representative (ACOR) may be identified and appointed to perform duties in the absence of the COR. ACOR will perform the same functions as the COR and will be designated in writing by the Contracting Officer.
1.7.12 Technical Assistant (TA). Technical Assistants (TA) are assigned on-site to provide technical assistance and support to the COR in the administration of the contract. TA may assist the COR in executing assigned inspection and monitoring duties. However, TAs may not provide any technical direction or clarification directly to the contractor. TA is not authorized to take any action, either directly or indirectly, that could result in a change in the cost/price, quantity, and quality, place of performance, delivery schedule, or any other terms or conditions of the contract.
1.7.13 Key Personnel: None
2. Definitions and Acronyms:
2.1. Definitions:
2.1.1. BER EQUIPMENT. Beyond-economic-repair-equipment - inoperable equipment for which repair cost is estimated to exceed acquisition cost by 25% or more.
2.1.2. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.3. CONTRACTING OFFICER (KO). A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: KO is the only individual who can legally bind the government.
2.1.4. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.5. CORRECTIVE MAINTENANCE (CM). Unscheduled repair required to restore equipment to operational condition within manufacturer predetermined tolerances and limitations. CM evolves from equipment failure or indications of equipment degradation making equipment failure likely. CM includes, but not limited to adjustment, alignment, and/or replacement of malfunctioning part or component.
2.1.6. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.7. DELIVERABLE. Anything that can be physically delivered but may include non-manufactured items such as meeting minutes or reports.
2.1.8. EMERGENCY SITUATION. Equipment malfunction that may cause complete shutdown of Warehouse and Preservation, Packaging, Packing and Marking (PPP&M) operation.
2.1.9. MAINTENANCE. Set of actions taken to ensure that equipment perform their intended function when required.
2.1.10 PERIODICITY. Frequency of performance of Manufacturer prescribed maintenance service for the specific equipment; expressed in Monthly (M), Quarterly (Q), Annually (A), and Every Other Month (EOM).
2.1.11. PHYSICAL SECURITY. Actions that prevent the loss or damage of Government property.
2.1.12. PREVENTIVE MAINTENANCE (PM). Scheduled maintenance performed on equipment to keep it in good working condition and operating within manufacturer predetermined tolerances and limitations. PM may include inspection, cleaning, lubricating, calibrating, adjusting or replacing “Bench Stock” – i.e. nuts, bolts, screws, electrical fittings, solder and/or flux, oil grease, cleaning supplies.
2.1.13. QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.14. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.15. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of a product or service shall meet contract requirements.
2.1.16. SUBCONTRACTOR. One that enters a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.1.17. WORKDAY. Monday through Friday except Holidays.
2.1.18. WORK WEEK. Monday through Friday, unless specified otherwise.
2.2. Acronyms:

3. Incidental to Place of Performance:
3.1. Services: NONE
3.2 Facilities: PM and CM services shall be performed at Government facilities where equipment is located.
3.3 Utilities: The Government will provide basic utilities to include electrical power for tools needed for contract performance. The Contractor shall instruct employees in utilities conservation practices. The contractor shall be responsible for operating under conditions that preclude the waste of utilities to accomplish PM or CM maintenance.
3.4 Equipment: NONE
3.5 Materials: NONE
4. Contractor Furnished Items and Responsibilities:
4.1 General: The Contractor shall furnish all supplies, equipment, and services required to perform work under this contract that are not listed under Section 3 of this PWS.
4.2 Materials. The Contractor shall furnish materials, supplies, and equipment necessary to meet the requirements under this PWS.
5. Specific Tasks:
5.1 Contract Award/Acceptance.
5.1.1 Initial Inspection of Equipment. The Contractor shall perform the initial inspection of all equipment at each Material Handling Equipment location listed in Attachments 1 through 2 within 30 days after contract award date.
The inspection result shall be submitted to the COR in the form of Equipment Status Report – Initial described as follows:
5.1.1.1 Equipment Status Report. The contractor shall provide results of the equipment evaluation/analysis in the form of a report to the Contracting Officer’s Representative (COR) within 5 days after the initial inspection period.
The report shall identify the equipment by location, serial, and model number, operable or not operable, required parts and labor (when necessary), to restore equipment to working condition as specified in the manufacturer’s manual.
5.1.1.2 Government Action. The COR will provide a written response within 15 days from receipt of the report. The Government reserves the right to determine if replacement or recommended repairs will be accomplished.
Equipment determined to be beyond economical repair (BER) will be deleted from attached listings (Attachments 1 through 2) and shall not be included in the PM schedule. Government reserves the right to replace the equipment (with similar function/capacity equipment) removed from list as result of contract acceptance inspection result during the life of the contract at no additional cost. Repair of equipment determined eligible for repair shall be accomplished in accordance with the requirements set forth in the manufacturer manual.
5.1.1.3 PM Schedule. The contractor shall submit to the COR a written PM schedule for all the equipment listed in Attachments 1 through 2 within thirty (30) days after contract award. The schedule shall address following:
equipment location, description, manufacturer, model name/#, quantity, periodicity, and PM schedule date.
5.1.1.4 Addition and deletion of equipment during POP. There will be no change in the Firm Fixed Price portion of the contract during POP for as long as the change is within plus or minus five percent (i.e. ± 5%) of the total number of pieces of Material Handling Equipment in specific site recorded at the time of contract award. Government replacement of equipment will be performed one for one of similar form, fit, and function – e.g. remove one forklift, add one forklift of similar size and capacity with the one removed. Contractor shall be responsible for identifying variances greater than 5% and shall forfeit any claim for equitable adjustment should it fail to notify the COR within 60 days from date the additional equipment (that exceeded the 5% limit) was put in service.
5.2 Basic Services. The contractor shall provide fully qualified and accredited technicians to provide PM and CM services as required in this PWS. PM is performed as scheduled, while CM may be performed during PM performance, it may also be performed during separate visit as requested by the COR. PM and CM shall be performed with the main objective of having ALL equipment to be in operational status when needed. The contractor shall also perform troubleshooting, removal, repair, installation, and testing of electrical and mechanical systems and sub-systems after repair and overhaul of equipment to Original Equipment Manufacturer (OEM) specifications.
5.2.1 Preventive Maintenance (PM). Preventive Maintenance shall be performed in accordance with the prescribed schedule for each piece of equipment listed in Attachments 1 and 2. Maintenance shall follow Original Equipment Manufacturer (OEM) instructions, technical manuals, and applicable directives to maintain equipment in optimal working condition.
5.2.1.1 PM tasks shall include, at a minimum: Inspecting the starter battery’s physical condition, testing voltage/state of charge, topping off with distilled water as required, and replacing batteries with a charge below 50%. Checking and topping off all fluid levels, including but not limited to: Hydraulic fluids; Diesel exhaust fluid (DEF); and Distilled water for electric forklift traction batteries. Inspecting tires for wear and proper inflation.
Verifying operational safety features (horn, lights, backup alarms, seat belts, etc.). Lubricating moving parts per manufacturer specifications. Ensuring proper functioning of brake systems. Cleaning and clearing forklift air filters, radiators, and cooling systems. At least once annually, each forklift must undergo a comprehensive inspection IAW the “Fork Maintenance Inspection Form” in NAVSUP P538. Forks shall be inspected and certified to be free of defects, including clear manufacturer Safe Working Load (SWL) markings, absence of surface cracks or weld failures, and blade straightness and overall condition. Certification documentation shall be included in the PM report submitted to the COR.
5.2.1.2 PM Frequency. PM Schedule as shown in Table 1below:

Notes:
1. For equipment with asterisk, in addition to scheduled PM, Steam Cleaning will be performed once a year.
2. For equipment with dagger, in addition to scheduled PM, Opacity Testing will be performed within 12 months of the previous test in accordance with state and federal regulations
3. For equipment with double-dagger, in addition to scheduled PM, collaboration of the scale will be performed once a year.
4. For equipment with hashtag, in addition to scheduled PM, Fork Inspections will be performed once a year.

5.2.1.3 Equipment Operating and Maintenance Standards. All PM services must be completed in accordance with OEM standards and documented in official maintenance logs. The contractor is responsible for ensuring all preventive actions maintain equipment in a condition that meets or exceeds OEM performance specifications.
Deviations from the maintenance schedule or OEM recommendations require prior written approval from the COR.
5.2.2 Corrective Maintenance (CM). Corrective Maintenance consists of services needed to restore equipment to full operational condition within OEM and Government-defined tolerances. Unless otherwise approved by the COR due to extenuating circumstances, all CM shall be completed within three (3) working days from the date of COR approval. If a delay is expected, the contractor shall: notify the COR in writing with justification and a proposed target completion date and receive COR written approval for the new timeline. The Government reserves the right to enter a contract with an alternate vendor to complete CM if delay risks extended down time. CM performance shall be performed on equipment when triggered by one of the following:
5.2.2.1 Routine COR request. Contractor shall provide a written cost estimate for all repairs within 2 business days from the date request is submitted by COR. The cost estimate shall include equipment description, number of hours required to affect the repair and the associated labor cost, replacement parts name and cost, and the grand total cost of the CM. CM shall be performed no more than three (3) working days from date cost estimate is approved by the COR. All cost estimates for CM or repairs must be approved by the COR. Communication will be by Email for routine requests.
5.2.2.2 CM requirement identified during PM. If a CM need is identified during PM, it shall be addressed during the same visit if it can be completed during normal working hours (see Section 1.6.4), and it does not delay the originally scheduled PM services for other equipment. If not feasible, contractor must notify the COR for approval of a follow-up visit and resume repair during the next PM cycle only with COR concurrence. COR approval is not required if CM is discovered during PM, and no additional parts or labor costs are incurred. All other CM requiring parts and/or labor cost must be approved by the COR.
5.2.2.3 Emergency COR request. In emergency situations CM must begin within one (1) business day (24 hours) of COR notification. Verbal cost estimates are permitted over the phone but must be followed by written email confirmation and COR approval before repair commences.
5.2.2.4 The contractor shall provide a PM and CM report of performed services to the COR within 2 business days following service of inoperable or malfunctioning equipment. Report shall include all labor, parts, fluids, transportation, and any other requirements to complete the PM check or CM repair, or emergency repair. An equipment log will be utilized and maintained by the contractor to record all services rendered.
5.2.3 Parts. All parts must be brand new OEM unless otherwise approved by the COR. Reconditioned or refurbished parts may be used only with COR approval and documentation proving it is customary industry practice.
Contractor shall demonstrate fair pricing within ±5% of commercial pricing, using sources such as: OEM/distributor websites, Public vendor catalogs, Manufacturer price schedules. All part purchases must receive COR pre-approval.
No separate material handling charges or credit card fees may be included.
5.2.4 Reporting Requirements. T Contractor must immediately report any delays or abnormal conditions affecting maintenance completion to the COR via phone, in person, or email. Contractor must report within 1 hour any incident of injury to contractor personnel or any damage to government equipment or property. The contractor shall notify the COR promptly if any of the following are observed:
5.2.4.1 Hazardous faults that endanger personnel or mission.
5.2.4.2 Failure to complete installation or maintenance due to faulty design or material.
5.2.4.3 Conditions arising from poor manufacturing or repair workmanship.
5.2.4.4 Equipment degradation due to environmental exposure.
5.2.4.5 Any condition preventing proper operation of equipment.
5.2.4.6 Failure to meet OEM performance standards.
5.2.5 Deliverables. The contractor shall deliver the following to the COR within 2 business days of service completion: PM/CM Service Report (including labor, parts, and materials). Updated Equipment Service Log (Technical Exhibit 2).
6. Special Instructions:
6.1 Technical Discrepancies. Unresolved maintenance discrepancies between the COR and contractor shall be referred to the OEM engineering authority for adjudication.
6.2 Safety. The Contractor shall comply with all safety regulatory guidance including those as detailed in appropriate Occupational Safety and Health Administration (OSHA) and Environmental Protection Agency (EPA) instructions; the contractor shall be responsible for the safety and accountability of all its employees; the contractor shall provide common Personal Protective Equipment (PPE) for team members. Some examples of PPE include safety shoes, safety eyeglasses, ear plugs, gloves and trade specific PPE such as welding gear for welders and arc flash gear for electricians.
6.3 Workspace. Equipment on jacks shall be roped off, posted with multiple warning signs and all unauthorized personnel kept clear of the equipment in the area. Work areas shall be kept neat, free of other loose equipment as they may present a hazard to personnel and equipment.
6.4 Equipment Movement. Equipment being moved shall require appropriate guides. Only qualified and licensed drivers shall be permitted to operate forklifts, and other motor vehicles. If is equipment is required to be transported from Naval Base Ventura County to an appropriate repair facility it shall be the contractor’s responsibility to coordinate and execute the transport. Any cost associated with this movement shall be documented on the repair work order and approved prior to execution.
6.5 Fire. The Contractor shall adhere to general fire safety precautions. Used waste, rags and other combustible material shall be the responsibility of the contractor and disposed of properly. Oily rags shall not be left on equipment. Oil, grease, and fuel spills shall be immediately cleaned or covered with absorbent material, and it shall be the responsibility of the contractor for cleanup and disposal.
6.6 Hazardous Materials. The Contractor shall perform duties as are necessary for proper control, issue and disposal of hazardous and non-hazardous chemicals used during maintenance and repair in accordance with all local, state, and federal laws. The contractor shall be responsible for the disposal of all HAZMAT generated by any maintenance or repair.
6.7 Equipment and Tool Care. The contractor shall clean all equipment of residue resulting from their work.
6.8 Rescheduling. All rescheduling requests shall be communicated through the COR via email, phone, or in person.
7. Applicable Reporting:
7.1 Notification of Delays. The Contractor shall promptly notify the COR of any accomplishments or conditions that may impede the performance or completion of maintenance or repairs. Notification may be conveyed via phone call, in-person communication, or email, ensuring timely communication.
7.2 Reporting Damage and Injury. The Contractor shall report all available facts relating to each instance of damage to government property/material or injury to contractor personnel to the POC within one hour of the occurrence.
7.3 Advisory Reporting of Conditions or Deficiencies. The Contractor shall advise the COR promptly of the following conditions or deficiencies:
7.3.1 A condition or material fault posing hazards to personnel, equipment, or missions.
7.3.2 Inability to perform prescribed installation or maintenance actions or achieve operational characteristics or durability due to faulty design or materials.
7.3.3 Conditions directly resulting from poor-quality workmanship during manufacture, modification, repair, or overhaul.
7.3.4 Deterioration of installed components or operational equipment due to climatic or environmental conditions.
7.3.5 Conditions preventing the operation of equipment by operators.
7.3.6 Failure of equipment to meet published OEM operational standards.

The contractor service requirements are summarized into performance objectives that relate directly to mission essential items. The performance threshold briefly describes the minimum acceptable levels of service required for each requirement. These thresholds are critical to mission success.
